This statement (“Privacy Policy”) describes the types of personal data that Aviant may collect and process about you if you use Aviant’s or Kyte’s websites, have opened an account with us, downloaded Kyte (our mobile application, the “App”), use our Services (as defined in our Terms of Services ) or requested information from us.

 

"You," "your," and "User" mean each and every person who accesses or uses our Site or any Service (as defined in the applicable Terms of Service). The words "Aviant," “us,” and “we” mean Aviant AS.

Aviant may change this Privacy Policy at any time by posting the revised Privacy Policy on this website and indicating the effective date of the revised Privacy Policy. You will be notified of any material changes to this Privacy Policy via email.

 

1             The data Aviant collects

 

Aviant is the controller of all of your personal data that Aviant collect.

 

Aviant collects your personal data when you use Aviant’s websites, the App and/or Services, create a new account, and add or update information in your account.

 

In connection with providing the Services, Aviant processes information about its Users to pursue its legitimate interests, in order to fulfill the contract and administrate the customer relationship. The User personal data we collect is:

2             Storage of personal data

 

Aviant retains each data for the following period:

3             Purposes and legal basis for data collection and processing

 

Aviant processes your personal data to pursue legitimate interest and in order to fulfil Aviant contract with you and to provide you with the Services. This includes the following purposes:

 

Website

·           Processing of data to track engagement, and verify how many people accesses the webpage and from where in the world they are accessing it, and possible new places to make Deliveries available.

·           Processing of data to define the launch of our service in suitable locations.

 

App

·           Processing of data to collect information on the Users that will order and receive the Delivery. The services require a location of the delivery of the products and, Aviant needs to be able to confirm with the User if it has received or not the product (via email or phone number).

·           Processing of data to (i) launch our services in suitable locations, and (ii) perform deliveries of ordered goods.

·           Providing general customer support including the solution of problems with your account and/or the Delivery, handle disputes, providing other services within the scope of customer service.

 

Aviant also processes your personal data in order to fulfil legal obligations to which Aviant is subject. This includes the following purposes:

 

·           Complying with information requests from third parties based on any statutory information rights they have against Aviant;

·           Ensuring the information security of the Services; and

·           Retention and storage of your personal data to comply with specific legal retention requirements.

 

4             Cookies Policy

 

Cookies are text files containing small amounts of information which are downloaded to your computer or mobile device when you visit our website or open the App and allow us to recognize your device.

 

By entering our websites or opening our App, you consent to cookies being used. If you do not want to accept our use of cookies, you can withdraw your consent by changing the options of the browser or by opting out of our collection of cookies.

 

We use cookies from a third party, Google, to provide us with analytics and intelligence about our wesites and Apps which may also be used to define our own business strategies. Google uses programming code to collect information about your interaction with our websites and Apps, such as the pages you visit, the links you click on and how long you are on our sites. These cookies allow us to employ data analytics so we can measure and improve the performance of our site and provide more relevant services to you. We use them to track engagement, and verify how many people accesses the websites and App and from where in the world they are accessing it, and possible new places to make Deliveries available. These include, Google Analytics and Google Firebase Crashlytics.

 

 

5             International Data Transfers

 

Aviant stores and processes all your personal data within the European Economic Area.

 

Aviant may transfer data collected throught cookies to the United States. The personal data will be anonymized  so that only analytics data is transferred, and it cannot be linked directly to you when located in the United States. You may request information on the legal ground for the transfer by contacting us.

 

6             With whom we share your information?

 

Aviant will not share personal data of its users with any third parties, except when we have legal grounds for sharing the data or it is required under any statutory obligations to  which Aviant is subject.

 

We share your data only with our processors, with the sole purpose of providing the service to you.

 

·           We use Vipps as processor for conducting payments.

·           We use Google when collecting information through cookies.

 

7             Your rights as a data subject

 

7.1            Your rights

 

You have the right to request:

 

·           access your personal data that is being processed by us. You may request information on the purposes of the processing, the categories of personal data concerned, the envisaged period for which the personal data will be stored, any available information as to the personal data’s source, amongst others. Your right to access may be limited by national law;

·           rectification of inaccurate personal data concerning you. Considering the purposes of the processing, you have the right to have incomplete personal data completed, including by means of providing a supplementary statement correction of any errors in the personal data we have stored about you,

·           deletion of personal data concerning you, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;

·           receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller ('right to data portability'); and

·           lodge a complaint with a supervisory authority.

 

Your personal data will be deleted when the data is no longer needed for the processing purposes specified in Section 2 above.
