Sturdy Used Gear Consignment Agreement
Consignment Terms
- Unless otherwise required by Sturdy Used Gear, this agreement shall apply to all consignments made by The Consignor on or after the date of this agreement.
- Consignor agrees to not have consigned item(s) for sale or posted elsewhere.
- Consignor forfeits any unclaimed monies in their account to Sturdy Used Gear after 2 years from date of item sale if account is inactive.
- Consignor warrants that all items are his/her own property, are in good condition, and gives Sturdy authority to remove any consignment items deemed unsellable by Sturdy. If an item is deemed unsellable and donation is not allowed, Sturdy will make one attempt to contact the consignor. After that contact, consignor has 7 days to pick up item(s)
Item Value, Consignor Fee, and Payouts
$0 - $300.00 —--------------------------------> Consignor takes 50% Cash or 60% Store Credit
$300.01 - $600 —----------------------------> Consignor takes 60% Cash or 70% Store Credit
$600.01+ —-------------------------------------> Consignor takes 70% Cash or 80% Store Credit
All payouts default to store credit unless otherwise requested. Payouts are available via check (free with in-store pick-up, $.50 fee for mailed checks) or secure ACH Direct Deposit in the Consignor Portal ($2.50 fee per deposit).
Automatic Markdown Timeline
30 Days —----------------------------> 10%
60 Days —----------------------------> 25%
90 Days —----------------------------> 50%
It is the consignor’s responsibility to pick up items if they do not want the price to be reduced.
Time Limit
Items may be picked-up after the 90th day from consignment date. If item(s) are not picked-up by the 100th day, the item becomes property of Sturdy Used Gear. Sturdy Used Gear holds the right to sell or donate the item(s) at its discretion.
Additional Consignment Terms
Sturdy Used Gear reserves the right to modify or amend its policies and procedures at any point. It is the responsibility of the consignor to review updates posted on our website.
A conversation may be had between Sturdy Used Gear and The Consignor, but ultimately, Sturdy Used Gear may set all prices at its discretion.
It is the Consignor’s responsibility to monitor the sales status of merchandise through the Consignor Portal.
Sturdy Used Gear holds the authority to place items on sale at their discretion.
Under this agreement, Sturdy Used Gear has no responsibility or liability in the case of loss, theft, damage, or destruction of the consigned merchandise.
The Consignor agrees to indemnify and hold harmless Sturdy Used Gear, its owners, agents, and employees from any and all liability, claims, lawsuits, including attorney’s fees and costs, arising out of the acceptance, storage, handling, or sale of any consigned merchandise.
