Device Use and Loan Agreement

The purpose of this document is to delineate the terms and responsibilities for families taking possession of a North Hills School District-issued device. Families are strongly encouraged to purchase the district’s insurance policy through One2One Risk Solutions.

The cost is $35 per device per school year with specific deductibles detailed below. NHSD will waive the $35 insurance premium for families who qualify for free or reduced lunch. These families must still register the device and are responsible for any deductibles should a claim be submitted.

Responsibilities of the Student and Parent/Guardian

This information is provided to make the student and parent/guardian aware of the responsibilities associated with the use of the district’s technology resources.

• The student and parent/guardian will be responsible for taking the necessary precautions to safeguard the device. If the NHSD determines that loss and/or damage is the result of negligence or intentional and reckless damage, the parent/guardian(s) may be held financially responsible for the repair or replacement of the device. 
• The parent/guardian may not substitute homeowner or other personal insurance on NHSD devices.
• The student and parent/guardian will be responsible for proper use and care of the device.
• The student must adhere to the NHSD Code of Conduct and Network Acceptable Use policy in order to maintain the privilege of accessing technology. 
• The student will notify the school if the device is lost or damaged within three (3) days of the occurrence. 
• The student will not uninstall, disable and/or modify the operating system or installed applications.
• The student will not remove the device from the protective case. (iPads only)
• The student will not use the device for personal and/or private purposes. The device is to be used for the student’s educational use to access instructional resources and materials and for school responsibilities.
• The student shall not share login credentials and/or passcodes and will secure the device to protect his/her work and information. 
• The student will notify administration immediately if they receive an electronic communication that may be unlawful, inappropriate and/or a potential violation of the Code of Conduct and Network Acceptable Use policy. 
• The student will take temporary possession of the device. The device remains the property of NHSD. All equipment must be returned or made available to NHSD upon the student’s separation from NHSD either by withdrawal or at the district’s request.

NHSD reserves the right to review, monitor and restrict information stored on or transmitted via the NHSD-owned device and to investigate inappropriate use of resources. If a student violates the NHSD Code of Conduct or Network Acceptable Use policy, privileges may be denied, and appropriate disciplinary action shall be applied. Violations may result in disciplinary action up to and including suspension/expulsion for students. When applicable, law enforcement agencies may be involved. 

While connected to district Wi-Fi, NHSD will provide filtered internet access to students in compliance with the Children's Internet Protection Rule. Parents/Guardians should monitor their child’s use of the device when at home.

Explanation of the NHSD Insurance Policy

This policy covers accidental damage, theft and loss of the device. Loss is defined as irreparable damage due to fire, flood, lightning, vandalism or some other natural disaster. Misplacement is not considered loss or theft. 

In order for a claim of loss to be valid, the student and/or family must produce the remains of the device for the district to determine if the device or any of its parts are damaged beyond repair. In order for a claim of theft to be valid, the student and/or family must produce a police report within three (3) school days of the occurrence.

Product failure is fully covered and is not the responsibility of the student or family. North Hills School District and its affiliates are the only authorized parties who can classify a defect as product failure.

Repair and replacement costs associated with instances that are not covered by the insurance policy are the sole financial responsibility of the student and parent/guardian. This includes intentional and reckless damage, negligence and theft without a police report. 

The assessment and classification of damages (accidental vs. intentional and reckless) are at the determination of NHSD and the findings and determinations are final.

Repairs to the device are only to be made by authorized NHSD personnel. Repairs may be made at any time a school official deems them necessary for the proper operation of the device. Financial responsibility for device repairs will be determined in accordance with the provisions of this agreement.

Coverage Terms

This policy covers:

• Accidental damage to the device, as defined in this agreement, with a deductible to be paid by the student or parent/guardian.
• The full replacement cost for loss or theft with a police report, as defined in this agreement, with a deductible to be paid by the student or parent/guardian.
• Product failure, as defined in this agreement, is fully covered and is not the responsibility of the student or parent/guardian.

This policy DOES NOT cover:

• Negligence or intentional and reckless damage to the device (as determined solely by the North Hills School District).
• Damage as a result of reckless abuse or willful conduct.
• Misplacement of the device and any of its accessories (i.e. charger, charging block or cord). 
• Damage, theft or loss to the charger, charging block or cord with the exception of a manufacturer defect. Damage, theft or loss of these items are the sole financial responsibility of the student and their family
