PM US TECH PRIVACY POLICY

1) Introduction
This Privacy Policy explains how PM US Tech (QC Tech LLC), Polymarket US (QCX LLC), and Polymarket Clearing (QC Clearing LLC) (collectively, “Polymarket” “Company,” “we,” “us,” or “our”) collects, uses, shares, and safeguards personal information of users of the Polymarket US trading application (the “App”). We encourage you to carefully and regularly review this Privacy Policy.
Your use of the App is subject to the Terms & Conditions, the Polymarket US Rulebook, the Polymarket Clearing Rulebook, the Participant Agreement, and the Risk Disclosure (collectively, “Terms”). If you do not agree with the Terms, or the collection and use of your personal information as described in this Privacy Policy, please do not access or use the App.

This Privacy Policy applies to all information we collect from you in connection with your use and our provision of the App. This Privacy Policy does not apply to information collected on any other application or website made available by us that does not display this Privacy Policy or on any other websites offered by any third party (including our affiliates and subsidiaries).
Throughout this Privacy Policy, we use the term “personal information” to describe information that we collect, process, use, and disclose. “Personal information” includes any information that, alone or in combination with other information, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual. It generally means the same as the terms “personally identifiable information,” or “personal data,” as defined under applicable data protection laws.

We and our partners may use various technologies—including your device’s mobile advertising ID and embedded software development kits (“SDKs”)—to gather personal information about your use of and engagement with the content on the App. This information may be combined with other data we collect and store about you and/or transmitted to third parties, such as our advertising partners. We and our partners may collect your personal information about your online activities over time and across different websites when you use the App. The use of these technologies helps us serve you better by understanding what you are interested in, tracking trends, measuring the effectiveness of ads, saving your preferences, and storing information you may want to retrieve on a regular basis. In addition, our advertising partners may use this information to deliver advertisements to you when you visit third-party websites within their networks.
Your device may permit you to control these technologies. For instance, you may be able to opt-out of having your mobile advertising identifiers used for certain types of targeted or personalized advertising by accessing the settings in your mobile device.

Some personal information is public information (this may include your web3-enabled wallet’s public address, username, profile photo, profile first and last name, month, and year of account creation, and public transactions in which you have been involved) and may be seen by anyone on the Internet due to the nature of the blockchain and Internet, whether or not they have an account with us. Public information may also be seen, accessed, reshared or downloaded through APIs, SDKs, or third-party services that integrate with our App.

Additionally, we may also use third-party advertising companies to serve ads when you visit the App, and those advertising companies may use information about your visits to the App and other websites that are contained in tracking technologies in order to provide advertisements about goods and services of interest to you. You may be entitled to prevent us from sharing and/or licensing your personal information to other companies under applicable law. We will keep your personal information for as long as necessary for the purposes identified in this Privacy Policy or to fulfill the purpose(s) for which it was collected, or as permitted or required by applicable law or our legal obligations.

We implement administrative, technical, and physical safeguards that are designed to help protect your personal information. Please be aware that despite our efforts, no data security measures can guarantee security, and no method of transmission over the Internet or electronic storage is 100% secure. Therefore, we urge you to take adequate precautions to protect your personal information as well, including by not re-using or sharing your password. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the App.
10) Transfer of Data
Your personal information may be transferred to—and maintained on—servers located outside of your state, province, country or other governmental jurisdiction where data protection laws may differ from those of your jurisdiction. By using the App, you consent to the transfer of your information outside of your country of residence, which may have data protection rules that are different from those of your country. For example, we may store, process, use, and disclose personal information in the United States. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities may be entitled to access your personal information.

Subject to certain exemptions under applicable law, you may have certain rights related to your personal information.
You will not be discriminated against for exercising any of these rights. To exercise your choices and rights, please contact us using the contact information provided in this Privacy Policy. We may request or require additional information to verify your identity to fulfill your request.
However, we may deny certain requests: (a) when denial of access is required or authorized by law; (b) when granting access would have a negative impact on another's privacy; (c) to protect our rights and property; or (d) where the request is frivolous or vexatious, or for other reasons permitted by law.
You may designate an authorized agent to make a request on your behalf. Authorized agents will be required to provide proof of their authority to act on your behalf by providing relevant documentation. We may contact you to confirm an authorized agent’s representation and to verify your identity.

The App is not intended for individuals under the age of 18, and we do not knowingly collect, sell, share, or disclose the personal information of minors under the age of 18. If you are aware of an instance in which we have collected a minor’s personal information, please report it to legal@polymarket.com; we will delete the personal information where required, subject to regulatory retention obligations.

The App may contain links to (or allow you to link to) unaffiliated third-party services, applications, or websites. We do not control information collection of any third-party services, applications, or websites that can be reached through such links. We encourage our users to be aware when they are linking to a third-party service or website and to read the privacy statements of any third-party service or website that collects personal information. Any information you provide to any third party is not covered by this Privacy Policy and we cannot guarantee the safety and privacy of any information you provide to such third parties.
14) Personal Communication Preferences
If required by law, we will request your consent to send you marketing text messages and phone calls. You may manage your receipt of marketing and non-transactional communications from us by clicking on the “Unsubscribe” link located on the bottom of any marketing communication, replying STOP to a marketing text message, changing your settings on the App, or by sending us an email at support@polymarket.us with the subject line, “Unsubscribe from Marketing.” Registered users cannot opt out of receiving transactional or administrative emails related to their account. We will use commercially reasonable efforts to process such requests in a timely manner, in compliance with applicable laws.
15) Automated decision-making and profiling
We may use automated tools for fraud detection, sanctions/KYC/AML/CTF screening, surveillance, and risk controls. These automated tools may include artificial intelligence tools.

We may update this Privacy Policy from time to time. When we do, we will revise the updated date at the top of this page. We encourage users to frequently check this page for any changes to stay informed about our information practices. You acknowledge that it is your responsibility to review this Privacy Policy periodically and become aware of modifications. Your continued use of the App following the posting of changes to this Privacy Policy will be deemed your acceptance of those changes.

18) CFTC/DCM-specific disclosures
We and connected DCMs/FCMs/ISVs/market-surveillance providers collect and retain order, trade, and other audit-trail data to meet CFTC and exchange obligations. Certain personal information cannot be deleted until legal retention periods expire. We may monitor activity for abusive trading patterns and disclose data to regulators as required.

U.S. state laws, including the California Consumer Privacy Act, require us to disclose the following additional information with respect to our privacy practices. If you are a California resident or a resident of a state that requires use to provide certain privacy-related disclosures, this section applies to you in addition to the rest of the privacy policy.
California Shine the Light Disclosure
We will provide information about the types of personal information as defined by California Civil Code § 1798.83 (the “Shine the Light Law”) that we may share with or disclose to third parties, other than our affiliates, for their direct marketing purposes. If you are a California resident, you may request information about our compliance with the Shine the Light Law by contacting us. Any such request must include “Request for California Privacy Information” in the subject line and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the email address or mailing address referenced above.

Notice of Financial Incentives
From time to time, we may offer financial incentives in connection with the collection or use of personal information. For example, we may provide financial incentives to you if you refer other individuals to the App using a unique website URL provided to you. To the extent that you provide this URL to other individuals, you agree and understand that you must have the consent of the individual to provide this referral, and you must provide the individual with a link to this privacy policy along with the URL. We may also provide credits for services on the App in exchange for you registering for an account on the App. The material terms of the financial incentive will generally be presented to you at the time you sign up. You may withdraw from any financial incentive at any time by contacting us. However, if you ask us to withdraw any financial incentive, we may be unable to return previously provided incentives at a later time.
