Welcome to KINTEVO LLC (“Company,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of our website located at https://www.notionapps.com and all related services, applications, tools, features, content, APIs, dashboards, and functionality provided by NotionApps (collectively, the “Service”).

Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, available at:

Together, these documents constitute the entire agreement between you and KINTEVO LLC (“Agreements”).

If you do not agree with these Terms or cannot comply with them, you may not use the Service.

These Terms apply to all visitors, users, customers, subscribers, affiliates, and others who access or use the Service.

2. DESCRIPTION OF SERVICE

NotionApps is a no-code application builder designed to allow users to create applications, portals, dashboards, internal tools, and other digital experiences powered by data stored within Notion.

The Service includes:

        •        A browser-based application builder

        •        Hosting infrastructure

        •        User authentication and data synchronization tools

        •        Integration with Notion APIs

        •        Subscription billing infrastructure

        •        Documentation, support, analytics, and related services

The Service relies on third-party services including but not limited to Notion, Stripe, AWS, Vercel, and other infrastructure providers.

We reserve the right to modify, improve, suspend, or discontinue any part of the Service at any time.

3. ELIGIBILITY

You must be at least 18 years old to use the Service.

By using the Service, you represent and warrant that:

        •        You are legally capable of entering into binding contracts.

        •        You are not prohibited from using the Service under applicable law.

        •        All information you provide is accurate and complete.

4. ACCOUNT REGISTRATION

To access certain features, you must create an account.

You agree to:

        •        Provide accurate and current information.

        •        Maintain the confidentiality of your login credentials.

        •        Notify us immediately of unauthorized access.

You are solely responsible for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. SUBSCRIPTIONS & BILLING

5.1 Subscription Plans

Certain features are available only through paid subscriptions (“Subscriptions”).

Subscriptions may be billed:

        •        Monthly, or

        •        Annually

Billing cycles are set at the time of purchase.

5.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing cycle unless canceled prior to renewal.

You may cancel your subscription via:

        •        Your account dashboard

        •        Or by contacting help@notionapps.com

5.3 Payment Processing

We use third-party payment processors including Stripe.

By providing payment information, you authorize us to charge your selected payment method for applicable fees.

You represent that you have the legal right to use the payment method provided.

5.4 Failed Payments

If payment fails:

        •        Access to paid features may be suspended

        •        You may be required to manually update payment details

        •        We may retry billing attempts

We are not responsible for payment failures caused by third-party processors.

5.5 Pricing Changes

We may change subscription fees at any time.

Any price changes will take effect at the next billing cycle.

Continued use of the Service after a price change constitutes acceptance of the updated pricing.

5.6 Refund Policy

Except where required by law, all payments are non-refundable.

We reserve the right to issue refunds at our sole discretion.

6. FREE TRIALS

We may offer free trials at our discretion.

If billing details are entered during trial signup:

        •        You will automatically be charged when the trial expires unless canceled.

We reserve the right to modify or discontinue free trials at any time.

7. USER CONTENT

You may create, upload, or connect data (“User Content”) to the Service.

You retain ownership of your User Content.

You grant us a limited, non-exclusive license to:

        •        Host

        •        Process

        •        Transmit

        •        Display

User Content solely to provide the Service.

You represent and warrant that:

        •        You have the right to use the content.

        •        The content does not violate any laws or third-party rights.

We do not claim ownership of your Notion data.

8. NOTION API DEPENDENCY

The Service integrates with Notion’s API.

You acknowledge that:

        •        We do not control Notion’s platform.

        •        Changes to Notion’s API may impact functionality.

        •        Service interruptions caused by Notion are outside our control.

We are not liable for third-party service disruptions.

9. ACCEPTABLE USE

You agree not to:

        •        Use the Service for illegal activities

        •        Reverse engineer or decompile the software

        •        Attempt unauthorized access

        •        Interfere with Service stability

        •        Introduce malware

        •        Overload infrastructure

        •        Resell or sublicense without authorization

Violation may result in suspension or termination.

10. AFFILIATE PROGRAM

The NotionApps affiliate program is currently active.

Eligible affiliates may earn commissions on qualifying referred subscriptions in accordance with the terms of the program and the rates shown in the affiliate dashboard.

We reserve the right to modify, suspend, or terminate the affiliate program, including commission rates, eligibility requirements, and payout terms, at any time.

Affiliates may not:

• Bid on branded keywords
  
• Impersonate NotionApps
  
• Misrepresent the Service or its features
  
• Use deceptive, misleading, or unauthorized promotional methods
  

Affiliate payouts are processed monthly via PayPal or another designated payout method.

Previously earned and approved commissions remain payable in accordance with the applicable payout schedule.

11. INTELLECTUAL PROPERTY

All software, branding, content, trademarks, and design elements of the Service are the exclusive property of KINTEVO LLC.

You may not:

        •        Copy

        •        Modify

        •        Redistribute

        •        Create derivative works

without written consent.

12. THIRD-PARTY SERVICES

The Service integrates with:

        •        Stripe

        •        AWS

        •        Vercel

        •        Notion

        •        Google Analytics

        •        Firebase

        •        Bugsnag

        •        Hotjar

        •        HubSpot

        •        Rewardful

        •        GitBook

        •        And other infrastructure tools

We are not responsible for third-party service outages, policy changes, or performance failures.

13. ANALYTICS & TRACKING

We may use analytics tools including:

        •        Google Analytics

        •        Firebase

        •        Hotjar

to improve performance and user experience.

14. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES INCLUDING:

        •        MERCHANTABILITY

        •        FITNESS FOR A PARTICULAR PURPOSE

        •        NON-INFRINGEMENT

        •        UNINTERRUPTED OPERATION

We do not guarantee:

        •        Error-free operation

        •        Continuous uptime

        •        Compatibility with third-party changes

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

KINTEVO LLC SHALL NOT BE LIABLE FOR:

        •        INDIRECT DAMAGES

        •        CONSEQUENTIAL DAMAGES

        •        LOST PROFITS

        •        LOST DATA

        •        BUSINESS INTERRUPTION

OUR TOTAL LIABILITY SHALL NOT EXCEED:

THE GREATER OF:

        •        THE AMOUNT PAID BY YOU IN THE PRIOR 6 MONTHS

        •        OR $1,000 USD

Some jurisdictions may not allow certain exclusions.

16. INDEMNIFICATION

You agree to indemnify and hold harmless KINTEVO LLC from any claims arising from:

        •        Your use of the Service

        •        Your violation of these Terms

        •        Your User Content

17. TERMINATION

We may suspend or terminate your access:

        •        For breach of these Terms

        •        For legal compliance

        •        For abuse or misuse

You may terminate your account at any time.

Provisions regarding liability, IP, arbitration, and indemnification survive termination.

18. GOVERNING LAW

These Terms are governed by the laws of the State of Georgia, United States.

19. DISPUTE RESOLUTION & ARBITRATION

Any dispute arising from these Terms shall be resolved through:

        •        Binding arbitration

        •        Administered under the Federal Arbitration Act

        •        Conducted in Atlanta, Georgia

You waive:

        •        Jury trial rights

        •        Class action participation

Each party shall bear its own costs unless otherwise determined by the arbitrator.

20. CHANGES TO SERVICE

We reserve the right to:

        •        Modify

        •        Suspend

        •        Discontinue

any part of the Service at any time without notice.

21. AMENDMENTS TO TERMS

We may update these Terms at any time.

Continued use of the Service constitutes acceptance of revised Terms.

22. SEVERABILITY

If any provision is held unenforceable, the remaining provisions remain in full effect.
