  1. INTRODUCTION

Welcome to Window Garden – Lofi Idle Game (the "Service”), developed and operated by CLOVER-FI Games ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of the Game, including any related services, features, and content.

By downloading, installing, and using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

  1. MINORS

If you are a minor in your country or region where you reside, you acknowledge that your parent or guardian has reviewed and consented to your use of Window Garden subject to the Terms and the Privacy Policy.

  1. SCOPE OF TERMS

All methods of use, rules, and any other regulations regarding the Service stipulated by the Company, regardless of naming, will form a portion of the Terms.

  1. LICENSE TO USE

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not:

  1. USER ACCOUNTS AND DATA

Some features may require account registration. You are responsible for maintaining the confidentiality of your login credentials. You may not share, sell, or transfer your account as well as any of your rights or obligations under these Terms to anyone else or share your account information with others without our prior consent. We reserve the right to suspend or terminate accounts that violate these Terms.

  1. IN-GAME CONTENT

The Game may offer virtual items or currency for purchase. The content within Window Garden does not have monetary value and may not be redeemed for legal currency or items of value outside of Window Garden. The content within the Game is provided to you under a limited, personal, revocable, non-transferable, non-sublicensable license to use within Window Garden.

You, the User, have no property interest, no right or title in or to any content appearing or originating from the Service, and such content may not be transferred or resold in any manner not explicitly permitted by the Company. We may terminate your license to use the content within the Service at any time and at our sole discretion.

  1. IN-GAME PURCHASES

No purchase is necessary to play the Service. However, we may permit you to use legal tender to purchase in-game content or remove advertisements. Certain features of the Game, including certain in-game content, may be unavailable if not purchased. We may, from time to time, and at our sole discretion, provide opportunities for you to acquire certain in-game content at no cost, at reduced rates, or as bonus content when you acquire other in-game content. For avoidance of doubt, receiving free content, including bonus gold, will not be considered “purchased” for legal purposes.

You may only purchase in-game content in the amount and at times permitted by us at our sole discretion, and only for your personal use. We may change the price and availability of in-game content at any time. We further reserve the right to modify, update, or discontinue in-game content without prior notice.

You will pay for in-game content in accordance with the payment terms and method stipulated separately by your chosen payment service provider.

You agree that you will not cancel or reverse any charges for any purchase in an attempt to defraud us. In the event that your payment service provider (e.g., credit card company) refuses payment for an amount credited to your account, we reserve the right to delete previously acquired in-game content and cease all access to all other in-game content.

If a dispute should arise between you and your payment service provider, you shall be solely responsible for resolving such dispute and hold the CLOVER-Fi Games free and harmless from any and all liability. In the event that the Company incurs any expense on account of or in relation to any such dispute, you agree to reimburse the Company for all expenses incurred, including attorney’s fees and other legal expenses.

  1. RETURN/REFUND POLICY 

All purchases are final and non-refundable, except as required by applicable law. Fees that have been paid by you for in-game content cannot be exchanged for cash or credit unless required by law.

You also acknowledge that the Company shall not refund money or other give any compensation when an account is closed, deactivated, or deleted, whether voluntary or involuntary, unless required by law.

If a return/refund is granted, we reserve the right to delete in-game content acquired with the returned/refunded amount.

  1. LOGIN AND ACCOUNT LINKING

Users cannot log in and use the same account linked with the Service from multiple devices at the same time. You, however, can transfer their data from device to another device through the procedure provided by the Company.

You can link their account with one or more accounts for services provided by third parties that we specify. When using the account linking function, you shall comply with the terms of use, privacy notice, and other conditions stipulated by the issuer of such account, in addition to these Terms, Privacy Notice, and other conditions as may be set forth by the Company.

  1. INTELLECTUAL PROPERTY

Unless otherwise indicated, all content in the Game, including graphics, music, and trademarks, are owned by CLOVER-FI Games. Subject to any limitations under applicable law, you acknowledge and accept that you have no property or other rights in any content on the Game, including but not limited to content that you may have created or developed such as screenshots, screen names, games scores, and other content pertaining to the Game (“User-Generated Content”). By submitting any content within the Game, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute such User-Generated Content in promotions or for other similar purpose. You may not use our intellectual property without our permission.

  1. PRIVACY POLICY

Your access and use of the Game is subject to the Privacy Policy (https://cloverfigames.com/privacy-policy.html), incorporated herein by reference. We may store, process, and transmit your data on servers outside of the region where you are located.

By downloading, installing, and using the Service, you agree to be bound by the Privacy Policy. If you do not agree, please do not use the Service.

  1. DISCLAIMER OF WARRANTIES

The Game is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that there are no defects or bugs in the Service, and we will bear no responsibility for repairing defects or bugs. We also do not guarantee whatsoever regarding the use of the Service or in-game content therein on all devices.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. If damage is caused to the Company or other Users by using the Service, the User shall be personally responsible for the cost/expenses for any damage.

  1. DISPUTE RESOLUTION

CLOVER-FI Games is committed to customer satisfaction and we aim to resolve all your concerns amicably and efficiently. As a first step, we always encourage you to contact customer support as this is usually the most efficient way to resolve potential problems.

If any dispute cannot be resolved amicably, you or we may start arbitration or file the appropriate case before the proper administrative or judicial body pursuant to the laws of the Philippines. If arbitration is pursued, the same shall likewise be pursuant to the laws of the Philippines.

  1. TERMINATION

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including violations of these Terms. We will provide you with a notice of termination where reasonable, unless termination is due to a material breach of these Terms.

  1. CHANGES TO THE TERMS

We may, at any time and at our sole discretion, modify the contents of the Service (including in-game content) without notifying you. Installation of the updated version of the application may be required in order for you to continue using the Service and we are under no obligation to continue to provide either support or updates for versions that are not up-to-date.

Changes to these Terms shall be published with Window Garden or on the Official Website and other official sources. Such changes shall take effect upon publication through the Service, the Official Website, or other official sources. We will consider your continued use of the Service as acceptance of the updated Terms.
