SANDWINA provides a platform that connects coaches (each a “Coach” or “Lifter”) with women who need lifting (each a “Client”). Whether you use SANDWINA as a Lifter or Client, this privacy policy (this “Policy”) applies to you. It details our privacy practices concerning the personal information you provide when you access and use SANDWINA. It describes the types of information we collect and our practices regarding their uses, protection, disclosure, retention, etc.

By accessing and using SANDWINA and providing us with personal information, you consent to our privacy practices as described in this Policy. Your consent to this Policy will be confirmed when you click the “I agree” button during account creation.

Your use of SANDWINA is also conditioned on you agreeing to our Terms of Use (for Clients) or Coaching Agreement (for Lifters). We strongly advise that you read and agree to these agreements along with this Policy before using SANDWINA.

BY USING SANDWINA, YOU AGREE TO HOW WE USE YOUR PERSONAL INFORMATION AS DESCRIBED IN THIS POLICY.

Company information

SANDWINA (comprising the website and associated services) is provided by SANDWINA, LLC (“we” or “us” or “our”), a company registered in Chicago, Illinois. The information we collect

We collect any information you provide when you use SANDWINA, including information submitted on the website and email. We will also automatically collect certain information – mostly non-personal information – when you access the website or take certain actions. We categorize our information collection practices as follows:

• Information provided by you: Depending on if you are a Lifter or Client, you may provide us with personal information through the website or our email address. This information may include your name, email address, payment or withdrawal method, work experience, status, education and career, qualification, picture, and other personal information. You may provide us with this information when you use the “Get A Lift” feature, create an account, subscribe to a plan, attach a withdrawal method, reach out to us, enter our Giveaway or other promotions, submit testimonials, or use any of our forms on the website or email.
• Information we collect automatically: We also collect certain information (mostly non-identifiable) from you upon your access to the website or interaction with our content. This information may include, without limitation, your device browser IP address, geolocation, operating system, time zone, and other general information about your device browser. We will also collect analytics and usage information, including your referring URL, the features you access on the website, your duration of use, etc. In addition, we will automatically collect the details of your transactions, including your subscription plan, the amount paid, duration, etc.

Why we collect information

We collect the information above generally to provide you with SANDWINA – to connect Lifters and Clients and improve our services over time. More specific uses of your information include:

• To grant you access to SANDWINA and its features.
• To process your payments or withdrawals (depending on your use).
• To gather information about Clients, which helps us to match them with the right Lifters.
• To communicate with you about administrative information and respond to your inquiries, claims, and complaints.
• To understand how users (both Lifters and Clients) use the website – for developmental purposes.
• To monitor violations of our Terms of Use, Coaching Agreement, and other applicable laws.
• To honor our legal obligations, such as our duty to keep records.
• To provide you access to our content and the website.
• To fulfill any other purposes, we communicate at the time of collection.

Disclosure of information

We do not share or disclose personal information, especially your contact information, to third parties for their direct marketing purposes. And we do not disclose personal information other than as described as follows:

• We may share personal information with third-party service providers who perform specific services on our behalf, including data storage, payment processing, website hosting, analytics gathering, and security (for example, our payment processing third party, Stripe Inc., requires Clients’ credit card details to process their subscription fees).
• We may disclose personal information about you in public areas of the website (for example, we may post testimonials submitted by Clients to the testimonials section of the website). Visitors and users of the website may access those testimonials and personal information attached to them.
• We may share information about you with a user to perform a contract (for example, we will disclose the details of Lifters to a Client if their request matches the Lifters’ specialty).
• We may share personal information with law enforcement in response to a request about an ongoing investigation or as a matter of national security. We may also share information with public officials if we believe – in good faith – that such disclosure will safeguard a life or property or will prevent us in a legal claim.
• We may share personal information with third-party entities in a business transfer agreement, such as a sale of an asset, merger, acquisition, consolidation, or bankruptcy.

Cookies and Tracking

• Cookies and similar tools

We use cookies, beacons, and other tracking technologies (collectively “Cookies”) on the website. Cookies are pieces of data that website owners embed on your browser and their content to obtain certain information and enable certain functionalities (Cookies do not harm your device, and they do not contain viruses). In relation to the website, we use Cookies to track user sessions and collect some of the information collected automatically, such as user device time zone. Likewise, our third-party service providers also embed Cookies on your browser to perform their services (for example, Google Inc. embeds Cookies in Google Analytics to enable it to gather usage and analytics information on our behalf).

Most of the Cookies used in relation to SANDWINA are “Session Cookies,” that is, Cookies that last for a browsing session. However, “Persistent Cookies,” which have expiry dates and last for longer periods, are also used.

If you do not want certain Cookies tracking your device and activities on SANDWINA, you can manage your preference. You can completely reject or block Cookies or manage them via the Settings/Help/Tools section of the applicable browser (for example, you can manage Cookies on Google Chrome via Security and Privacy under Settings). Please, note that if you block any Cookie from your browser, the function performed by that Cookie may become unavailable to you. You are responsible for any negative experience on the website due to your disabling of any Cookie.

• Third-party tracking tool; Google Analytics

We use Google Analytics, a third-party tool from Google Inc., to analyze how users come to the website and user activities, including user referring URL, visited pages, and other usage and analytics information. You can also prevent Google Analytics from tracking how you use the website. You simply need to download and install a “Google Analytics Opt-Out” extension or plugin on your browser.

The security of your information

We care about your privacy – we employ commercially reasonable security measures in ensuring your information is inaccessible to unauthorized parties. We do not only disclose information except as described above, but also store our data in a private encrypted database and force users to authenticate themselves before accessing their information. However, you are aware that no data protection practice over the internet is 100% secure. You understand that we cannot guarantee your information will not be exploited or accessed by unauthorized parties.

Correcting and deleting your information

You have certain rights in relation to the personal information we collect from you. You can request to access and correct your personal information. You can as well request that we delete your personal information and user account from our database. You can request to access and correct your information via your user profile. To request the deletion of your information, please get in touch with us at support@tangram.com. We may be unable to correct or delete your information if it overrides any law or our legitimate interests.

Children Policy

SANDWINA is not targeted at women below 18 years of age. It is targeted at people who are at least 18 years of age. If you submit personal information to us, you represent that you are at least 18 years of age. You may only use SANDWINA if you are below 18 years of age under the supervision of a legal guardian or at least a parent. If you are a parent or legal guardian whose child has submitted personal information to us without your supervision, you may reach out to us via support@tangram.com to have it deleted.

Do Not Track signals

A Do Not Track (“DNT”) is a browser setting that, when activated, prevents a website owner from tracking your use of their website. Under applicable law, we are required to notify you if we respond to DNT signals or not. Due to the inconsistency in DNT signals among industry participants, we do not currently respond. The website may contain links and content that leads to third-party websites and services. If you click on any of these links or contents via our website, it will take you to the website of the respective owner. Changes to Policy

We may amend and change portions of this Policy at any time for any reason, including changes to SANDWINA or any applicable law. Such changes may be communicated to you via your email address or any applicable area on the website. Notwithstanding, you are expected to frequently visit this page to watch of for new changes. The last changes to this Policy will be specified at the top of this Policy. Your continued use of SANDWINA after any changes to this Policy will constitute your consent to be bound by the changes made.
