Our Products are not intended for children under 13 years of age. No individual under age 13 may provide any information to or on the Products. We do not knowingly collect Personal Information from any individual under the age of 13. If You are under the age of 13, do not provide any of Your information on the Products or through any of its features, do not register an account on the Products, do not make purchases through the Products, do not use any of the interactive or public comment features of the Products, and do not provide any information about Yourself to Us, including Your name, address, telephone number, email address, or any screen name or user name You may use. If We learn that We have collected or received Personal Information from an individual under the age of 13 without verification of each such individual’s parental or legal guardian’s consent, We will delete that information. If You believe We might have any information from or about an individual under the age of 13, please contact us at privacy@efuse.io.
If You are considered a minor child in the jurisdiction in which you reside, but You are above the age of 13, You must provide to Us written consent to use Our Products from Your parent(s) or legal guardian(s). Please have Your parent or legal guardian read these terms with You.
Parental control protections are commercially available that may assist You in limiting access to material that is harmful to minors. If You are concerned about Your children seeing inappropriate materials online, You may want to consider a filtering program or an Internet Service Provider that offers tools to help screen out or restrict access to such material. For all countries NOT listed below, 13 is the minimum age to manage and use Our Products. If You are domiciled in one of the below-listed countries and are the age listed next to your country or younger, please note that a parent or legal guardian will be required to provide written consent to Us in order to manage or use Our Products, which consent must allow Our processing of Your Personal Information. Additionally, a parent or legal guardian of such minor-user has certain rights related to the information and data of the minor-user, including, but not limited to, the right to review the information collected, the right to revoke consent, and the right to delete their minor-user’s data.

We collect activity across Our Products and several types of information from and about users of Our Products, including:
● Information by which You may be personally identified, such as name, postal address, e-mail address, telephone number, any other identifier by which You may be contacted online or offline.
● Information relating to transactions or purchases (name, email address, and credit card information), although We use verified third party payment processors to collect and process this data.

● Still or video images posted on Our Products.
● Content of emails and call recordings if You email or call one of Our representatives.
● Information from cookies and similar technologies. In general, We use cookies for authentication; security, site and Product integrity; potential advertisement, recommendations and measurement; analytics and research; performance; and Product features and services.
We may collect this information:

● Automatically as You navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
● From third parties, for example, Our business partners, content providers, and affiliates.

You may provide User Contributions to Us or post them on our Products, but You do so at Your own risk. Although You may set certain privacy settings for such information by logging into Your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, We cannot control the actions of other users of the Products with whom You may choose to share Your User Contributions. Therefore, We cannot and do not guarantee that Your User Contributions will not be viewed by unauthorized persons.
As You navigate through and interact with Our Products, We may use automatic data collection technologies to collect certain information about Your equipment, browsing actions, and patterns, including:
● Details of Your visits to Our Products, including traffic data, location data, logs, and other communication data and the resources that You access and use on the Products.

Some content or applications, including advertisements, on the Products are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about You when You use Our Products. The information they collect may be associated with Your Personal Information or they may collect information, including Personal Information, about Your online activities over time and across different websites and other online services. Some of Our Products are affiliated with Publisher First, Inc. dba Freestar ("Freestar") for the purposes of placing advertising on the Website(s), and Freestar will collect and use certain data for advertising purposes. To learn more about Freestar’s data usage, click here.
In addition, Google Analytics is a web analytics service offered by Google that tracks and reports website traffic on Our Products.
● Google uses the data collected to track and monitor use of Our Products. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.
● You can opt-out of having Your activity on the Products made available to Google Analytics by installing the Google Analytics opt-out browser add-on, which can be downloaded from the Chrome web store at: Chrome Web Store. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

We do not control these third parties’ tracking technologies or how they may be used. If You have any questions about an advertisement or other targeted content, You should contact the responsible provider directly. We use information that We collect about You or that You provide to us, including any Personal Information:
● To present Our Products and its contents to You.
● To provide You with information, products, or services that You request from us or based on Your interactions from Our Products.
● To fulfill any other purpose for which You provide it.
● To provide You with notices about Your account, including expiration and renewal notices.
● To carry out Our obligations and enforce Our rights arising from any contracts entered into between You and us, including for billing and collection.
● To notify You about changes to Our Products or any products or services We offer or provide through it.
● To better update Our Products based on Your and other consumers’ activity and interaction with it.
● To allow You to participate in interactive features on Our Products.
● In any other way We may describe when You provide the information.

We may also use Your information to contact You about Our own and third-parties’ goods and services that may be of interest to You. In regard to Google user data, we may read and/or share messages in live YouTube streams when utilizing Our Sidekick product's stream overlays. We also store viewership numbers for YouTube live streams at the time of overlay to provide historical metrics. We attest that our use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
We may use the information We have collected from You to enable us to display advertisements to Our advertisers’ target audiences. Even though We do not disclose Your Personal Information for these purposes without Your consent, if You click on or otherwise interact with an advertisement, the advertiser may assume that You meet its target criteria.
We strive to provide You with choices regarding the Personal Information You provide to us. We have created mechanisms to provide You with the following control over Your information:
● Tracking Technologies and Advertising. You can set Your browser to refuse all or some browser cookies, or to alert You when cookies are being sent. To learn how You can manage Your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If You disable or refuse cookies, please note that some parts of the Products may then be inaccessible or not function properly.
● Disclosure of Your Information for Third-Party Advertising. If You do not want Us to share Your Personal Information with unaffiliated or non-agent third parties for promotional purposes, You can opt-out by checking the relevant box by logging into the Products and adjusting Your user preferences in Your account profile, or by sending us an email with Your request to opt-out@efuse.io.
● Promotional Offers from the Company. If You do not wish to have Your contact information used by Us to promote Our own Products or third parties’ products, You can opt-out by logging into the Products and adjusting Your user preferences in Your account profile by checking or unchecking the relevant boxes or by sending us an email stating Your request to opt-out@efuse.io. If We have sent You a promotional email, You may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to Us as a result of a product purchase, product service experience, or other transactions.
● Targeted Advertising. If You do not want Us to use information that We collect or that You provide to Us to deliver advertisements according to Our advertisers’ target-audience preferences, You can opt-out by emailing opt-out@efuse.io.
We do not control third parties’ collection or use of Your information to serve interest-based advertising. However these third parties may provide You with ways to choose not to have Your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative on its website by clicking here.

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A, as amended or renumbered, may submit a request to opt-out@efuse.io.
We are headquartered in the United States. Information You provide to Us or We collect from You will be processed in the United States. The United States is not currently considered by the EU to provide an adequate level of data protection. We therefore rely on exceptions listed in the GDPR. In particular, We collect and transfer Your Personal Information to the United States only with Your consent to perform services under the contracts We have in place with You or to fulfill a compelling legitimate interest of Ours that does not outweigh Your rights or freedoms.
We strive to apply suitable safeguards to protect the privacy and security of Your Personal Information and to use it only as described in this Privacy Policy. We also enter into data processing agreements and standing contractual clauses with Our customers and vendors, whenever feasible and appropriate. We use a number of third party analytics and service providers to help Us evaluate Your use of the Products; compile statistical reports on activity and improve the content on the Products, as well as the Products’ performance. We only use these third-party analytics providers on certain areas of the Products. We currently do not respond to Your browser’s Do Not Track signal, and We do not permit third parties other than Our analytics partners and service providers to track Our users’ activities over time on the Products. We do not track Your online browsing activity on other online services over time.
We may disclose aggregated information about Our users, and information that does not identify any individual, without restriction. We may disclose Personal Information to:
● Our subsidiaries and affiliates.
● Contractors, service providers, and other third parties We use to support Our business.
● A buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Us about Our Products’ users is among the assets transferred.

● For any other purpose disclosed by us when You provide the information.
We may also disclose Your Personal Information:
● To comply with any court order, law, or legal process, including to respond to any government or regulatory request where We have a good faith belief that We are required by law to do so. ● To enforce or apply Our Terms of Use and other agreements, including for billing and collection purposes.
● If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Us, Our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Depending on the location from where You access the Products, You may have the right to access, be informed, rectify/correct, object, delete, or restrict use of certain Personal Information covered by this Privacy Policy and exercise all other rights set forth in the GDPR. You may also have the right to request that We refrain from processing Your Personal Information. You may also have the right to revoke Our access to Google data via the Google security settings page. Please keep in mind that if You exercise such rights, this may affect Our ability to provide Our services. For inquiries about Your
Personal Information, please contact Us. Although We will make reasonable efforts to accommodate Your request, We reserve the right to impose certain restrictions and requirements on such requests, if allowed or required by applicable laws. Please note that it may take some time to process Your request.
We may access, preserve and share Your information in response to a legal request (like a search warrant, court order, or subpoena) if We have good faith belief that applicable law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where We have a good faith belief that the response is required by law in that applicable jurisdiction, affects users in that applicable jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when We have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, You and others, including as part of investigations; or to prevent death or imminent bodily harm. For example, We may provide information to third-party partners about the reliability of Your account to prevent fraud and abuse on and off of Our Products. Information We receive about You, including financial transaction data related to purchases made through Our Products, may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of Our terms or policies, or otherwise to prevent harm. We also may retain information from accounts disabled for violations of Our terms for at least a year to prevent repeat abuse or other violations of Our terms.
In general, federal law does not allow private parties to obtain the content of communications and certain information (e.g., messages, posts, videos, pictures, streams) using subpoenas. See the Stored Communications Act, 18 U.S.C. § 2701 et seq. Stored messages, emails, and other content of communications are generally prohibited from disclosure, subject to certain exceptions under 18 U.S.C. § 2702. However, We may provide any available basic subscriber information (not content) where the requested information is indispensable to the case, and not within a party’s possession upon personal service of a valid subpoena or court order and after notice to affected account holders. Basic subscriber information does not include content (e.g. messages, posts, videos, pictures, streams) but may include, and is not limited to, a user’s name, address, telephone number, email address, date of birth, account information, and any other information identifying a subscriber of Us or Our Products.
Unless an exception is applicable in which We are obligated to disclose user information and content of communications, requesting parties must also demonstrate that they have exhausted all other avenues of obtaining the information it seeks, such as requesting a voluntary release from the individual user or obtaining a valid court order authorizing the release of records. Upon Our receipt of a subpoena or court order arising from a legal proceeding, We will provide notice to the individual user of the request, and give the individual user an opportunity to challenge the subpoena or court order themselves. Any such subpoena or court order should be limited in scope to seek basic subscriber information only, and set Our specific accounts of eFuse or its Products at issue by identifying them by their URL or Our user ID. Names, birthdays, locations and other information are insufficient.
You can review and change Your Personal Information by logging into the Products and visiting Your account profile page. You may also send us an email to request access to, correct or delete any Personal Information that You have provided to Us. We cannot delete Your Personal Information without also deleting Your user account. We may not accommodate a request to change information if We believe the change would violate any law or legal requirement or cause the information to be incorrect.
If You delete Your User Contributions from the Products, copies of Your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users of the Products. Proper access and use of information provided on the Products, including User Contributions, is governed by Our Terms of Use.

If You are a California resident, California law may provide You with additional rights regarding Our use of Your Personal Information. Among other rights, California residents have a right to opt out of the sale or sharing of their Personal Information by a business. California’s “Shine the Light” law (Civil Code Section § 1798.83, as amended or renumbered) permits users of Our Products that are California residents to request certain information regarding Our disclosure of Personal Information to third parties for their direct marketing purposes. As a
California resident, and subject to certain exceptions, You have the right to know about Personal Information We collect and how it is shared; the right to delete Personal Information collected by Us; the right to opt-out of the sale or sharing of Your Personal Information; the right to non-discrimination in exercising Your CCPA rights; the right to correct inaccurate Personal Information collected; and the right to limit the use and disclosure of Sensitive Personal Information collected. We have implemented measures designed to secure Your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information You provide to Us is stored on secure servers behind firewalls. Your personally identifiable information will be encrypted. We use a third-party payment provider to process all payments. We do not directly store any payment information.
The safety and security of Your information also depends on You. Where We have given You (or where You have chosen) a password for access to certain parts of Our Products, You are responsible for keeping this password confidential. We ask You not to share Your password with anyone. We urge You to be careful about giving out information in public areas of the Products, such as the message boards. The information You share in public areas may be viewed by any user of the Products.
Unfortunately, the transmission of information via the internet is not completely secure. Although We do Our best to protect Your Personal Information, We cannot guarantee the security of Your Personal Information transmitted to and on Our Products. Any transmission of Personal Information is at Your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on and in the Products.
It is Our policy to post the most up-to-date Privacy Policy on this webpage. If We make material changes to how We treat Our Your Personal Information and You have created an account with Us, We will notify You via email, which will contain a link to the updated Privacy Policy. The date the Privacy Policy was last revised is identified at the top of the Privacy Policy. ● eFuse. “eFuse” means eFuse, Inc., a Delaware corporation with a principal place of business located within the United States of America.
● GDPR. “GDPR” means the European Union’s General Data Protection Regulation.
● Our(s). “Our(s)” means the possessory interest of eFuse.
● Personal Information. “Personal Information” means information that identifies, relates to, or could reasonably be linked with You or Your household. For example, it could include your name, postal address, email address, phone number, records of products purchased, internet browsing history on our Products, geolocation data, and inferences from other Personal Information that could create a profile about Your preferences and characteristics.
● Privacy Policy. “Privacy Policy” means this Privacy Policy of Ours, as amended or restated.
● Product(s). “Product(s)” means any website owned and/or operated by Us; Our applications; Our services; Esports.gg; eRena; Sidekick; Mynt; and any other affiliated websites and applications of Ours.
● Sensitive Personal Information. “Sensitive Personal Information” is a specific subset of Personal Information that includes certain government identifiers (such as social security numbers); an account log-in, a financial account, a debit card, or a credit card number with any required security code, password, or credentials allowing access to an account; precise geolocation; contents of mail, email, and text messages; genetic data; biometric information processed to identify a consumer; information concerning a consumer’s health, sex life, or sexual orientation; or information about racial or ethnic origin, religious or philosophical beliefs, or union membership.
● Us. “Us” means eFuse.
● User Contributions. “User Contributions” means information You post on public areas of the Products, transmit to other users of the Products, or transmit to third parties affiliated with Us.
● We. “We” means eFuse.
● You. “You” means the user of our Products.
● Your. “Your(s)” means the possessory interest of You.
