Emergency Vehicle Authorization Guidance
Overview
Effective July 1, 2024, Colorado Department of Public Health and Environment (CDPHE) rules mandate that ground ambulance services must provide documented proof that their ambulances are authorized by the Colorado Department of Motor Vehicles (DMV) as emergency vehicles. This requirement is outlined in Section 42-4-108(5), C.R.S., and 6 CCR 1015-3, Chapter 4, Section 3.7.2.E.
Key Points
Necessity of Emergency Vehicle Authorization
- While Section 42-4-108, C.R.S., does not explicitly require ground ambulance services to obtain emergency vehicle authorizations, failure to do so prevents the ambulance from legally exercising the privileges granted to authorized emergency vehicles.
Privileges of Authorized Emergency Vehicles
- Authorized emergency vehicles are permitted to:
- Park or stand regardless of general traffic provisions.
- Proceed past red lights or stop signs after ensuring it is safe.
- Exceed lawful speed limits without endangering life or property.
- Disregard regulations on movement or turning directions.
Compliance and Enforcement
- Without emergency vehicle authorization, any exercise of these privileges is a violation of state motor vehicle laws and CDPHE licensing rules.
- Violations can result in legal and regulatory consequences and affect the ambulance service's compliance with CDPHE rules.
- Emergency vehicle stickers require dual registration: the vehicle must be titled in Colorado (unless there is an out-of-state lienholder) and have an active Colorado registration through the county DMV office. The state office approves the emergency vehicle sticker, which is free of charge.
Legal Framework
- Section 42-4-108, C.R.S.: Outlines the traffic privileges and exemptions for authorized emergency vehicles.
- 2 CCR 601-20: Defines authorized emergency vehicles and the use of emergency signals.
- Only vehicles with emergency authorization can use red lights, and violations are classified as class B traffic infractions.
Application Process
- Complete the Application for Emergency Vehicle Equipment Authorization.
- Obtain certification from a relevant official (e.g., Sheriff, Chief of Police, Fire Chief, Colorado State Patrol, Ambulance Service Director) verifying the necessity of the vehicle for preserving life, property, or executing emergency governmental functions.
- Submit the application to the State Registration Section at:
PO Box 173350
Denver, CO 80217-3350
- Once approved, the certifying official will receive the emergency vehicle stickers. These must be displayed visibly on the vehicle and are valid for two years.
Display of Decals
- Emergency vehicle decals must be displayed in a visible area on the vehicle.
- Decals have staggered expiration dates and must be renewed every two years.
