We agree to provide you with the Megalist Services. The Services include all of the Megalist products, features, applications, services, technologies, and software that we provide to advance Megalist’s mission: to enable you to make better decisions about where you spend your money. The Services are made up of the following aspects:
We want to create a friendly environment for all users. In order to do that, we need to implement certain restrictions and rules. Please make sure you understand what you can and can’t do, and also what we are allowed to do.
We promise to provide our Services using a commercially reasonable level of skill and care. However, there are certain things that we do not guarantee.
Other than expressly set out in these Terms and additional policies, neither Megalist nor any of its suppliers, distributors or contractors make any specific promises about the Services. For example, we do not make any commitments about the content available within the Services, the specific functions of the Services, or their reliability, availability, or ability to meet your needs. Our Services are provided “as is”. To the extent permitted by law, we exclude all warranties.
Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. We do not claim ownership of your content, but you grant us a license to use it.
When you share, post, or upload content that is covered by intellectual property rights (like photos or videos) on or in connection with our Services, you hereby grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, store, reproduce, distribute, modify, run, copy, communicate, publish, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new ones. This license continues even if you stop using our Services (for example, an ad with your picture may continue to be promoted). It is your responsibility to make sure you have the necessary rights to grant us this license for any content that you submit to our Services.
When permitted by law, Megalist, and Megalist’s suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.
To the extent permitted by law, the total liability of Megalist, and its suppliers and distributors, for any claims under these Terms, including for any implied warranties, is limited to the amount you paid us to use the Services.
In all cases, Megalist, and its suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.
If you are using the Services for a personal purpose, then nothing in these Terms or any additional terms limits any consumer legal rights which may not be waived by contract.
In the event of any dispute arising out of or in connection with these Terms, we agree to attempt to resolve the issue amicably.
These Terms and any dispute arising out of or in connection with these Terms shall be governed by, and construed in accordance with the law of England and Wales, without regard to its choice of law or conflicts of law principles that would require application of law of a different jurisdiction. Megalist will still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction.
You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
Unless otherwise required by law, any action or proceeding brought by you must commence within one year after the cause of action accrues.

“Megalist account” is your personal account on the Megalist platform that you created in order to use our Services.
“Working days” refer to Monday - Friday, excluding UK Bank Holidays.
Headings and subheadings contained in these Terms are for reference purposes only and shall not affect the meaning or interpretation of these Terms.
These Terms should be interpreted as a whole in conjunction with any additional policies and our Community Guidelines. The order of the Terms does not signify precedence.

We use the information we have to deliver our Services, including to personalize features and content (including your Megalist Feed) and make suggestions for you (such as places you may be interested in) on and off our Services. Promote safety, integrity and security.
We use the information we have to verify accounts and activity, combat harmful conduct, detect and prevent spam and other bad experiences, maintain the integrity of our Services, and promote safety and security on and off of the Megalist platform. For example, we use data we have to investigate suspicious activity or violations of our Terms or policies.
Communicate with you.
We use the information we have to send you marketing communications, communicate with you about our Services, and let you know about our policies and Terms. We also use your information to respond to you when you contact us.
Research and innovate for social good.
We may use the information we have (including from research partners we collaborate with) to conduct and support research and innovation on topics of general social welfare, technological advancement, public interest, health and well-being.

Sharing on Megalist
People and accounts you share and communicate with
When you share reviews or comment on reviews, this content becomes public information and can be accessed by all users and businesses using the Megalist platform. When you use messages to communicate with businesses, those businesses can see the content you send. Your network can also see actions you have taken on our Services, such as liking a review.
Content others share or reshare about you
People who can see your activity on our Services can choose to share it with others on and off our Services. For example, when you share a post or send a message to specific friends or accounts, they can download, screenshot, or reshare that content to others across or off our Services, in person or online. Also, when you comment on someone else's review or react to their content, your comment or reaction is visible to anyone who can see the other person's content
People can also use our Services to create and share content about you. For example, people can share a photo of you in a review, mention you in a review, or share information about you in their messages. If you are uncomfortable with what others have shared about you on our Services, you can report the content.
If the ownership or control of all or part of our Services or their assets changes, we may transfer your information to the new owner.
Sharing with Businesses
We share information with businesses on the Megalist platform. This includes aggregated statistics and insights that help businesses understand how people are engaging with their reviews, price lists and other content.
We share information about you with companies that aggregate it to provide analytics and measurement reports to businesses.
Law enforcement or legal requests
We share information with law enforcement or in response to legal requests in the circumstances outlined below.
We collect, use and share the data that we have in the ways described above:
Under the General Data Protection Regulation, you have the right to access, rectify, port and erase your data. You also have the right to object to and restrict certain processing of your data. In case of any concern, please contact us at email@example.com.
We store data until it is no longer necessary to provide our Services, or until your account is deleted - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs.
When you delete your account, we delete things you have posted, such as your reviews, and you won't be able to recover that information later. Information that others have shared about you isn't part of your account and won't be deleted.

First-party cookies are cookies that belong to Megalist, third-party cookies are cookies that another party places on your device through our Service. Third-party cookies may be placed on your device by someone providing a service for Megalist, for example to help us understand how our service is being used.
How to control cookies or other collection mechanisms
Follow the instructions provided by your website or mobile browser (usually located within the "Help", "Tools" or "Edit" facility) to modify your cookie settings. Please note that if you set your browser to disable cookies or other technologies, you may not be able to access certain parts of our Services and other parts of our Service may not work properly.
We want Megalist to continue to be an authentic and safe place for inspiration, expression and sharing. Help us foster this community. Post only your own photos and videos and always follow the law. Respect everyone on Megalist, don’t spam people or post offensive content.
As always, you own the content you post on Megalist. Remember to post authentic content, and don’t post anything you’ve copied or collected from the Internet that you don’t have the right to post.
Post photos that are appropriate for a diverse audience
Only post photos that are relevant to your review and that accurately represent your experience. Irrelevant content, spam, content containing hate speech, pornographic material or violence will not be tolerated.
Reporting and blocking content. If you encounter content you don’t like, you can unfollow or block the user or business that posted it, making sure you will not see that content again. You can block directly from the review, comment, profile or message you don’t like. If you see content that you think is objectionable or violates our Community Guidelines, you can also report that to us in the app. One of our team will get back to you within 24 hours. If we find the content objectionable or in breach our Community Guidelines, we will remove the content and eject the user who provided the offending content.
Avoid taking photos of others without their consent.
People like to share photos of their children. For safety reasons, there are times when we may remove images that show nude or partially-nude children. Even when this content is shared with good intentions, it could be used by others in unanticipated ways.
Help us stay spam-free by not artificially collecting likes, followers, posting repetitive comments or content, or repeatedly contacting people for commercial purposes without their consent.
Megalist is not a place to support or praise terrorism, organized crime, or hate groups. Offering sexual services, buying or selling firearms and illegal or prescription drugs (even if it’s legal in your region) is also not allowed. No one may coordinate poaching or selling of endangered species or their parts.
Remember to always follow the law when offering to sell or buy other regulated goods. Accounts promoting online gambling, online real money games of skill or online lotteries must get our prior written permission before using any of our products.
We have zero tolerance when it comes to sharing sexual content involving minors or threatening to post intimate images of others.
We want to foster a positive, diverse community. We remove content that contains credible threats or hate speech, content that targets private individuals to degrade or shame them, personal information meant to blackmail or harass someone, and repeated unwanted messages.
It's never OK to encourage violence or attack anyone based on their race, ethnicity, national origin, sex, gender, gender identity, sexual orientation, religious affiliation, disabilities, or diseases.
Serious threats of harm to public and personal safety aren't allowed. This includes specific threats of physical harm as well as threats of theft, vandalism, and other financial harm. We carefully review reports of threats and consider many things when determining whether a threat is credible.
Each of us is an important part of the Megalist community. If you see something that you think may violate our guidelines, please help us by using our built-in reporting option. We have a team that reviews these reports and works as quickly as possible to remove content that doesn’t meet our guidelines. Even if you or someone you know doesn’t have an Megalist account, you can still report to us at email@example.com. When you complete the report, try to provide as much information as possible, such as links, usernames, and descriptions of the content, so we can find and review it quickly. We may remove entire posts if either the imagery or associated captions violate our guidelines.
You may find content you don’t like, but doesn’t violate the Community Guidelines. If that happens, you can unfollow or block the person who posted it. If there's something you don't like in a comment on one of your posts, you can delete that comment.
Many disputes and misunderstandings can be resolved directly between members of the community. If one of your photos or videos was posted by someone else, you could try commenting on the post and asking the person to take it down. If that doesn’t work, you can submit a copyright report at firstname.lastname@example.org.
We may work with law enforcement, including when we believe that there’s risk of physical harm or threat to public safety.
