A 19-year-old Milwaukee man has been charged with killing a Germantown man who was caught in crossfire between an armed security guard and a group who was turned away from an after-hours party last month on the south side.
Gabriel Lugo faces a charge of first-degree reckless homicide, party to a crime, in the death of 20-year-old Jake Gerard, according to a criminal complaint filed Monday in Milwaukee County Circuit Court. If convicted, Lugo could be imprisoned for up to 60 years.
Lugo is charged with firing into the crowd outside the party. But he is not the only person to face charges after a chaotic scene on the morning of April 19.
The complaint says:
About 1:30 a.m., Gerard and a friend had been kicked out of a party in a commercial building at 2828 S. 16th St. The friend was arguing with men acting as security guards when Gerard stepped in between his friend and the guards, who then began to beat Gerard.
One of the guards, Ramon Trinidad, 25, pulled out a knife and began to stab Gerard in the right side of his back. It was about that time, a witness told police, that she heard gunshots coming from the west side of S. 16th St.
Another complaint against Trinidad, Natanael Delgado-Crispin, 17, and Juan R. Salas, 32, – all of whom were working the door at the club – says they got in a scuffle outside with two men.
Delgado-Crispin is charged with obstructing an officer, false information, and possession of a dangerous weapon by a person under 18. Salas is charged with endangering safety by use of a dangerous weapon and being a felon in possession of a firearm.
That’s about the time police say Lugo and Luis Correa, 21, were shooting into the crowd outside the club. Correa has been charged with being a felon in possession of a firearm.
According to records, Correa and two other men said Trinidad denied them entrance and showed them a gun. That’s when Correa said he called Lugo, who arrived a short time. Correa then fired shots toward the club, the complaint says. Correa told police he, too, had fired a shot.
Gerard was shot in the back and two women drove him to St. Francis Hospital, where he died about 3:20 a.m.

Jake Gerard worked two jobs to pay his way through school and had already completed one year of training toward becoming an auto mechanic, his mother said.
He developed his passion for cars about two years ago, when he began tinkering with a 1963 Buick Riviera, said Stephanie Gerard. The Riviera was in good shape and only had about 20,000 miles on it when Jake Gerard bought it, but he was always looking to make improvements.
Lately, he had talked about replacing the 1999 Oldsmobile Intrigue he usually drove with a new car, possibly a Ford Mustang.
But Gerard, 20, was shot to death early Saturday outside a recording studio in the 2800 block of S. 16th St.

A Germantown resident who grew up in Milwaukee, Gerard was shot in the back just after 3 a.m. while trying to help a friend who was involved in an altercation stemming from a party inside the building, Stephanie Gerard said.
Milwaukee police, who have not officially identified Gerard, said Sunday that he apparently was involved in a conflict at the party and was asked to leave. He left with friends but was then involved in a dispute with a group of men outside, police said.
Gunfire erupted during the confrontation. Gerard was taken to St. Francis Hospital, where he was pronounced dead.

Police said the party occurred in space rented from Atlas Bus Sales.
Stephanie Gerard said Sunday night that she was struggling with both her son’s death and the way in which it had been portrayed in local media reports.
“He didn’t deserve to lose his life,” she said. “He’s the victim here, and that’s not how they’re making it sound on TV. We’re trying to get some support and make some sense of this. But this doesn’t make any sense.”
Gerard had never attended a party at the building before, his mother said.
“He’s made out like he’s the one who started the altercation,” Stephanie Gerard said. “My son didn’t have any weapons on him. He was shot in the back. Does anybody care that (the shooter) had a gun? Does anybody care? … What is this world coming to? Nobody cares! Nobody cares that (some) guy held a party where people had weapons?”
Stephanie Gerard went to the scene of the shooting Sunday afternoon while friends and family created a small memorial to her son. She said she wants to know more about the party that led to her son’s death.
“I want to know who was running the party,” she said. “Who rented the building? How long has he rented it for? Does he just move on to other buildings after a while?”
The questions only made mourning her son more difficult, Gerard said.
“I’m not doing well at all,” she said. “I lost my son because somebody goes to a party with a gun, and people don’t care. All they care about is that a Germantown man was shot.”
In addition to his mother, Gerard is survived by his father, Richard; a brother, 24; and a sister, 21.

Both officers were shot more than once and were taken to Froedtert Hospital in Wauwatosa. One was in critical condition and one was in satisfactory condition, Police Chief Edward Flynn said.

A suspect whom Flynn identified as Julius C. Burton, 18, was arrested in a home in the 900 block of S. 3rd St. less than an hour later, and police recovered a gun. Police spokeswoman Anne E. Schwartz said he had broken into the house.
“This is a moment that tests our discipline as well as our resolve,” Flynn said at the scene.
“This neighborhood came through today. At every key moment of this investigation, someone from the community stepped forward.
“A taxicab driver came to the assistance of the officers as they were bleeding in the street. A UPS driver tried to follow the footsteps of the suspect as he fled (from) the scene. Finally, an individual homeowner identified for us where he thought the suspect might be hiding. And on top of that, our officers, despite all the stress and emotion . . . extracted that suspect without incident and without injury.”
Asked what prompted the officers to stop the bicyclist, Flynn would say only that “it started from a ‘suspicion stop’ that was actively resisted.”
Traffic in the area was diverted, and Bradley Tech High School, with about 1,200 students, was locked down for the students’ safety, said Philip Harris, a Milwaukee Public Schools spokesman. They were released around 5 p.m.
