Data protection and consent to receive general communications
The controller of the personal data provided by you during registration is the company Uneeqly s.r.o., Korunní 2569/108, Vinohrady (Prague 10), 101 00 Prague, registered with the Municipal Court in Prague under file number C 335763, doing business under ID 09414495, hereinafter referred to as "Uneeqly". Uneeqly is herein in the position of a personal data controller. It therefore determines the purposes and means of processing.
Terms not defined in this Policy are defined in the General Terms and Conditions, which are listed here: https://www.uneeqly.com/VOP, and their meanings apply to this Policy.
By registering, the Partner and the Customer agree that the personal data provided by them in the scope of name and surname, e-mail address, records of transactions in the Uneeqly application system, location, or other data provided by the Partner or the Customer in the Uneeqly application will be processed, stored and protected by the Provider, hereinafter referred to as "Personal Data".
The purpose of the processing of personal data is to set up and maintain the Partner's Customer Account and the Customer's Customer Account, to ensure the proper functioning of the Customer Accounts and the Uneeqly application and the statistics of the Uneeqly application service, to create customer databases and to send commercial communications and personalized targeted offers from Partners to Customers.
The Personal Data Controller shall provide and make available to Partners the following Customer data:
Pseudonymised ID, number of points earned in the loyalty system, a summary of rewards redeemed in the Offer, when and at which outlet the points were credited,
whether the Customer wishes to receive marketing communications or not.
The Customer can provide consent to receive marketing communications from Partners and personalized targeted offers from Partners directly in the Uneeqly Push Notification application. This consent can be revoked at any time during the use of the Uneeqly app in the settings of the mobile app. The duration of the processing of personal data for the purpose of sending marketing communications and personalized targeted offers from Partners will be primarily defined by the duration of the Customer's membership.
Obligations arise from the law, the fulfilment of which involves the processing of personal data. This is also the case when using the Uneeqly application. The legal basis for processing here is "compliance with a legal obligation". The processing of personal data may take place in the context of the following activities: prevention of offences, management of the accounting agenda, compliance with tax obligations, compliance with data protection regulations. The personal data processed for this purpose is stored for a maximum of 10 years after the operation has been carried out (generally for the period prescribed by law).
Also in the context of the use of the Uneeqly application, selected personal data is processed in order to pursue Uneeqly's own interests. This is done on the basis of the legal title of "legitimate interest". This includes, in particular, the following processing: the enforcement of legal claims out of court (and the protection of own rights in general), the prevention of fraud or activities against the misuse of own services, ensuring the technical operation and IT security of the Uneeqly application (protection against misuse; ensuring the integrity and security of Uneeqly's networks and operations), the production of general statistics and reports.
The processing of personal data for the purpose of "Providing personalised offers and benefits" will involve profiling. This consists of evaluating selected personal aspects, such as personal preferences, interests or purchasing behaviour.
Both manual and automated procedures using modern technologies will be applied. Processing may thus be carried out exclusively by automated means. As a result of the processing in question, decisions may be expected to be taken which may have legal effects on the participant or affect him in a similarly significant way. Processing using automated tools may affect the resulting offer and/or benefits for a particular Uneeqly Customer. As a result, individual Participants may receive different benefits and offers or these may only be available to selected Participants.
The Regulation generally gives you the right not to be subject to any decision based solely on profiling and automated processing. It is possible to object to this.
The personal data of Customers or Partners of the Uneeqly application may be transferred to other controllers, joint controllers and processors directly involved in its implementation under the terms of generally binding legal regulations.
Separate administrators are payment gateway providers, public authorities, contract restaurant operators and social network operators who act as a Partner and have established a Partner Customer Account. Personal data is made available to Partners in pseudonymised form for simple inspection within the client section of the Uneeqly application. Payment gateway providers are in the position of controller by virtue of the fact that they are the only ones in the entire chain handling the personal data of the Uneeqly user's payment card. In this case, we do not have full data either. In the case of social networks, the processing is derived from the existence and use of the Facebook and LinkedIn fan page tools by Customers and Patners themselves.
Google is one of the processors of personal data. It claims this role in the terms and conditions of the Google Analytics (analytics tools) and AdWords (advertising system) services that it provides to companies. Both of these services are used by Uneeqly as standard in the operation of the application. IT solution providers and providers of selected services for Uneeqly, in particular legal and consulting firms, may also fall under the category of processor under specified conditions.
Finally, Uneeqly Customer's personal data may be shared between Partners on the basis of the provision of explicit consent to transfer by the individual user.
We do not envisage the transfer of personal data to third countries (outside the EEA) in the context of the Offer.
Uneeqly eliminates the sharing of its users' personal data with other entities. Thus, within the platform, it is looking for process procedures and technical solutions that will allow it to meet its own interests and those of its business partners with minimal processing. In addition, your personal data is not transferred in relation to offers and commercial communications from Partners.
Partners and Customers may exercise a number of rights guaranteed by the Regulation in relation to the processing of personal data. Uneeqly is also obliged to inform participants of these rights. The information below thus also fulfils Uneeqly's information obligation as a data controller. Platform participants therefore have:
Right to withdraw consent: you have the right to withdraw consent at any time and Uneeqly is obliged to cease any processing carried out under this legal title. However, the use of the Uneeqly application may be terminated by Uneeqly by taking this step.
Right to information and access to personal data processed: you have the right to obtain information about and access to the personal data processed by Uneeqly within the Uneeqly application. Including the provision of copies of the personal data processed.
Right to rectification of inaccurate personal data: if you/we find that we are processing data that is inaccurate in content or time (or you inform us of this), we will proceed to rectification. We will also provide the Customer or Partner with the right to have the data completed, directly via the Uneeqly app.
Right to erasure ("right to be forgotten"): you have the right to have your personal data erased if the personal data is no longer necessary for the stated purpose for which it was collected or otherwise processed, or if consent is withdrawn or if it is processed unlawfully.
Right to restriction of processing: under certain conditions you have the possibility to request restriction of the processing of your personal data. This applies in the following cases: the participant denies the accuracy of the personal data; the processing is unlawful, however, the participant refuses erasure and only asks for a restriction on its use; Uneeqly no longer needs the personal data, however, the participant requests its retention for the exercise of their own legal claims; or the participant has exercised the right to object to the processing of personal data.
Right to be informed of rectification, erasure or restriction of processing: Uneeqly is obliged to notify you of rectification, erasure and restriction. Exceptions are where this proves impossible or would require disproportionate effort.
Right to data portability: you have the right to the portability of the personal data you provide in a structured, commonly used and machine-readable format. At the same time, you can request that Uneeqly transmit this data directly to another controller. If technically feasible, Uneeqly will do so.
Right to object: you have the right to object to the processing of personal data. This also applies to profiling and processing for direct marketing purposes.
The right not to be subject to processing based solely on automated processing, including profiling, which would have legal effects on Customers or Partners or would affect them significantly in a similar way.
Right to file a complaint with a supervisory authority: the right to file a complaint against Uneeqly with the Office for Personal Data Protection (ÚOOÚ), located at Pplk. Sochora 27, 170 00 Prague 7.
Interested parties (in the registration process) are under no obligation to provide their personal data to Uneeqly. However, in these circumstances, Uneeqly will not be able to register these Applicants.

You can use all available information channels to exercise your rights, including your Customer Account.
