We understand that our Lease or Rental Agreement requires the Tenant to provide a minimum of 30 days written notice before we move.  

This Tenant’s Notice of Intent to Vacate Rental Unit actually provides __________ days notice. We understand that we are responsible for paying rent through, the earlier of: 1) the end of the current lease term; 2) the end of the required notice period, per the Lease or Rental Agreement; or 3) until another Tenant approved by the Landlord has moved in or begun paying rent.

If this is a month to month Lease or Rental Agreement, I understand that the Tenant is financially responsible for rent for at least 30 days from today, or more if not vacated within 30 days. If on a Lease, the Tenants understand they are currently on a Lease that is in effect until ______________ (Lease End Date).  If breaking lease, the Tenants are obligated to the terms and conditions of the lease until the property is re-rented.  In certain circumstances you may have a Lease Break Fee in your contract.  If applicable, the Tenants agree to pay a Lease Break Fee as outlined in the rental agreement if leaving before the end of said lease.

The Tenants understand rent is due until the end of our Lease or Rental Agreement, unless the property is re-rented prior to the termination of the Lease. The undersigned Tenants understand the Landlord and/or Landlord’s agent will issue a security deposit transmittal within the terms of Landlord/Tenant Law.  Landlord issues one security deposit transmittal for the vacating tenancy, the Landlord does not issue separate deposit disbursals.

Tenants give permission to the Landlord to provide future verification of tenancy.  In accordance with the Lease or Rental Agreement, the Tenant agrees to provide the Landlord reasonable access with advance notice in order to show the rental unit to prospective Renters, Buyers, Agents, Owner Representatives, Inspectors, Appraisers, Workmen or Contractors.

The Tenant agrees to have all personal possessions removed from the property, leave the property completely vacant, clean, secured all doors and windows, and will leave the keys on the kitchen counter in the locked & secured property on  ___________________ (Scheduled Move Out Date). 


Personal Property Law: State law permits former Tenants to reclaim abandoned personal property left at the former address of the Tenant, subject to certain conditions. You may or may not be able to reclaim property without incurring additional costs, depending on the cost of storing the property and the length of time before it is reclaimed. In general, these costs will be lower the sooner you contact your former Landlord after being notified that property belonging to you was left behind after you moved out.  (Civil Code Section 1950.5(f)(1))

Personal Property Waiver: Tenant agrees to waive any further rights or claims to personal property left on premises after vacating the premises.  Tenant understands and agrees that possessions of any value that are abandoned on the premises will be disposed of at the discretion of Landlord or Rentor (Owner’s Agent).

Move Out Instructions

The following information lists the instructions to assist you in the move out process.  We know you will have a lot to keep track of during this transition. We hope this will make it clear and organized for you.

We consider you as still in possession of the unit until you have vacated the unit and the property is secure with windows, garage, and doors are locked. Rent will be charged until you surrender possession of the keys and the property is secure. You can surrender possession by leaving the keys on the kitchen counter, vacating the secured property, and notifying us that you have moved out.  YOU WILL NOT BE ABLE TO RE-ENTER THE PROPERTY AFTER YOU HAVE RELEASED POSSESSION.

If you vacate the property prior to the end of the lease term, you will still be responsible for the rent during the remaining term of the lease or until a new tenant rents the unit. However, we will do our best to try and lease the property.  You are expected to return the property in the same condition as received excepting normal wear and tear, or improvements.

Notice of Right to Initial Inspection

I understand that I have the right to request an initial inspection of my unit and to be present during that inspection, which shall occur no earlier than two weeks before the termination of the tenancy and during normal business hours. I also understand that at this initial inspection, the Landlord will provide an itemized statement specifying repairs or cleaning that are proposed to be the basis for the deductions from the security deposit. I understand, however, that this may not be a final accounting of deductions from my security deposit. I understand that no later than three weeks (21 days) after Landlord has regained possession of the premises, Landlord shall provide me with estimate or final itemized statement, indicating the basis for, and the amount of, any security received and the disposition of the security and shall return any remaining portion of such security deposit to Tenant.
