Terms & Conditions for BitList Plus

These Terms and Conditions apply to the BitList Plus app for mobile devices and web browsers, together with any related services operated by Houcem Ben Amor Chlegou (collectively, the "Application"). Houcem Ben Amor Chlegou is hereinafter referred to as the "Service Provider."
By downloading, accessing, or using the Application, you agree to be bound by these Terms. You should read them carefully before using the Application.

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device or computer for personal or internal business purposes.
Prohibited Activities: You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except as expressly permitted by applicable law. Any attempt to extract the source code or translate the Application into other languages is strictly prohibited.
3. INTELLECTUAL PROPERTY
The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding (the "IP").
- Nothing in these Terms grants you any license or right to use the Service Provider's trademarks or branding for any purpose.
- You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in the Application.
4. USER ELIGIBILITY
By accessing this Application, you represent that you are legally permitted to use it in your jurisdiction.
- Age Requirement: You must be at least 18 years of age to use the Application.
- If you are below 18, a parent or legal guardian must review and accept these Terms on your behalf.
5. THIRD-PARTY PROMOTIONS AND EXTERNAL LINKS (AFFILIATE DISCLOSURE)
BitList Plus functions as a promotional platform for third-party websites, often involving affiliate marketing or cryptocurrency claim opportunities.
- Independent Entities: Promoted websites are independent third parties. The Service Provider has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites.
- User Responsibility: Any interaction, account creation, or financial transaction on a promoted website is strictly between the user and that third party.
- Liability: The Service Provider accepts no liability for any loss, direct or indirect, experienced as a result of relying on third-party information or services accessed via the Application.
6. USER-GENERATED CONTENT AND ACCEPTABLE USE
If the Application allows users to post, share, or upload content, you agree not to post content that:
- Is illegal, abusive, threatening, harassing, or contains hate speech.
- Violates third-party intellectual property or privacy rights.
- Contains spam, phishing links, or malware.
- Contains explicit violence or sexual content.
Moderation: The Service Provider reserves the right to remove content, suspend accounts, or cooperate with law enforcement for users who repeatedly violate these guidelines.
7. THIRD-PARTY SERVICES
The Application utilizes third-party services that maintain their own Terms and Conditions. By using BitList Plus, you agree to comply with the terms of:
8. INFRASTRUCTURE AND DATA CHARGES
- Internet Connection: Certain functions require an active internet connection (Wi-Fi or mobile data). The Service Provider is not responsible for the Application not functioning at full capacity due to a lack of data access.
- Mobile Charges: You accept responsibility for any charges incurred from your mobile network provider, including data roaming charges if used outside your home territory.
- Device Security: The Service Provider advises against jailbreaking or rooting your phone, as it may expose your device to malware and cause the Application to malfunction.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or data loss.
- Maximum Liability: The total liability of the Service Provider for any claim shall not exceed the amount paid by you for the Application in the 12 months preceding the claim. If the app is free, liability is limited to the minimum amount permitted by law.
- Third-Party Content: The Service Provider is not responsible for inaccuracies in content provided by third parties or losses from relying on external information.
10. ARTIFICIAL INTELLIGENCE (AI) TECHNOLOGIES
The Application incorporates AI technologies to enhance user experience, such as delivering personalized content or automated features. By using the Application, you acknowledge and agree that AI may be used to process data to provide these functionalities.
11. TERMINATION AND UPDATES
- Updates: The Service Provider may update the Application at any time. You should accept updates when offered; failure to do so may result in the Application not functioning properly.
- Termination: The Service Provider may terminate the use of the Application at any time without notice. Upon termination, (a) all licenses end; (b) you must cease use and delete the Application.
12. DIGITAL SERVICES ACT (DSA) COMPLIANCE
For users within the European Union:

- Content Moderation: If access to content is restricted or an account is suspended, a clear statement of reasons will be provided to the affected user.
- Notice and Action: Users may submit notices of allegedly illegal content through the contact details provided above.
13. LIMITATION OF LIABILITY AND DISPUTE RESOLUTION
- No Class Actions: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
- Binding Arbitration: By using the Application, you agree that any dispute, claim, or controversy arising out of or relating to these Terms shall be settled by binding arbitration in Tunisia, rather than in a general court of law, to the maximum extent permitted by applicable consumer law.
- Limitation of Damages: To the maximum extent permitted by law, the Service Provider shall not be liable for any damages exceeding the amount you paid to use the Application (if any) or a maximum of $10.00 USD, whichever is greater.
- Governing Law: These Terms are governed by the laws of Tunisia. You agree to submit to the exclusive jurisdiction of the courts located in Tunisia to resolve any legal matter arising from these Terms.
