Data Policy

At ValueChecker we value your privacy and do everything in our power to protect your data and enable you to control the data you have shared with us.

As trust is the cornerstone of our business mission, ValueChecker is committed to retaining your trust by properly protecting the personal data collected and used by our organization/entrusted to us. We have temporary guardianship of your personal data and have the duty of care for them.

Our goal is to inform you as well as your customers in respect to the way we assure your and their privacy. We are a Software as a Service (SaaS) provider and process data in order to deliver the services our clients need to provide fair and transparent insurance. This policy describes the information we process to support ValueChecker.ai, ValueChecker.net and other products (the ValueChecker products) and features offered by International Consumer Services Sweden AB, 556680-3572 (ICSS AB).

Below is a short overview of the different roles and responsibilities that influence the data processing.

A Controller is the company that an individual (or data subject) provides their personal data to. The Controller determines the purpose for the personal data (e.g. to receive important information or for sending invoices) and is responsible for the correct handling of the subject’s data.

A Processor is the company that provides part of the service of the Controller and needs specific personal data in control of the Controller in order to do so. To give an example: when one of our customers sends an insurance claim to ValueChecker, we might need personal data such as a name and product information to fulfill the service. The Processor, in this case ValueChecker, only processes personal data according to the instructions of the Controller. We don’t use this data for anything else than requested so by the Insurance Company (the Controller).

  1. What kinds of information do we collect?

To provide the ValueChecker products, we must process information about you. The types of information we collect depend on how you use our Products.

  1. Things you and others do and provide.
  1. Information and content you provide: We collect the content, communications and other information you provide when you use our Products, including when you sign up for an account, create or share content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created. It can also include what you see through features we provide, such as our image upload and analysis. Our systems automatically process content and data you provide to analyze context and what's in them for the purposes described below.
  2. Your usage: We collect information about how you use our Products, such as the types of content you view; the features you use; the actions you take; and the time, frequency and duration of your activities. For example, we log when you're using and have last used our Products. We also collect information about how you use features like our image uploader.

Device Information: As described below, we collect information from and about the computers, phones, tablets and other web-connected devices you use that integrate with our Products, and we combine this information across different devices you use, information we obtain from these devices includes:
  1. Device attributes: information such as the operating system, hardware and software versions, browser type, app and file names, and types..
  2. Device operations: information about operations and behaviors performed on the device when interacting with ValueChecker products.
  3. Identifiers: unique identifiers, device IDs, and other identifiers, such as from apps or accounts you use.
  4. Data from device settings: information you allow us to receive through device settings you turn on, such as access to your GPS location, files, camera or photos.
  5. Network and connections: information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, IP address, connection speed and, in some cases, information about other devices that are nearby or on your network.

  1. How do we use this information?

We use the information we have (subject to choices you make) as described below to provide and support the ValueChecker products and related services. Here's how:

  1. Provide, personalize and improve our Products.

We use the information we have to deliver our Products, including to deliver data, features and content.

  1. Location-related information: We use location-related information, such as current location to provide, and improve our Products. Location-related information can be based on things like precise device location (if you've allowed us to collect it), IP addresses, and information from your use of ValueChecker products (such as settings).
  2. Product research and development: We use the information we have to develop, test and improve our Products, including by conducting surveys and research, and testing and troubleshooting new products and features.
  1. Provide measurement, analytics, and other business services.

We use the information we have (including your activity off our Products) to help us and partners develop and improve services, and understand how users interact with their websites, apps, and services.

  1. Promote safety, integrity and security.

We use the information we have to verify accounts and activity, detect and prevent spam and other bad experiences, and maintain the integrity of our Products. For example, we use data we have to investigate suspicious activity or violations of our terms or policies.

  1. Communicate with you.

We use the information we have to communicate with you about our Products, and let you know about our policies and terms. We also use your information to respond to you when you contact us.

Your information is shared with others in the following ways:

When you share data and communicate content using our Products

When you choose to use third-party apps, websites, or other services that use, or are integrated with, our Products, they can receive information about what you share.

  1. New owner.

If the ownership or control of all or part of our Products or their assets changes, we may transfer your information to the new owner.

  1. Sharing with Third-Party Partners

We work with third-party partners who help us provide and improve our Products, which makes it possible to operate our company and provide services to people around the world. We don't sell any of your information to anyone, and we never will. We also impose strict restrictions on how our partners can use and disclose the data we provide. Here are the types of third parties we share information with:

  1. Contractual and settlement partners

We provide information and content to our contractual partners who retain our insurance claims services, such as collecting claims data, product information and other data to facilitate valuation, settlement, payments or related services.

  1. Measurement partners.

We share information about you or your usage with companies that aggregate it to provide analytics and measurement reports for our continued development of the service.

  1. Vendors and service providers.

We provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, analyzing how our Products are used, providing customer service, facilitating payments or conducting surveys.

  1. Law enforcement or legal requests.

We share information with law enforcement or in response to legal requests in the circumstances outlined below.

  1. What is our legal basis for processing data?

We collect, use and share the data that we have in the ways described above:

  1. as necessary to fulfill our ValueChecker Terms of Use;
  2. consistent with your consent, which you may revoke at any time via privacy@ValueChecker.ai;
  3. as necessary to comply with our legal obligations
  4. as necessary in the public interest; and
  5. as necessary for our (or others') legitimate interests, including our interests in providing an innovative, personalized, safe, and profitable service to our users and partners, unless those interests are overridden by your interests or fundamental rights and freedoms that require protection of personal data.

  1. How can you exercise your rights provided under the GDPR?

Under the General Data Protection Regulation, you have the right to access, rectify, port and erase your data. You also have the right to object to and restrict certain processing of your data. This includes:

  1. The right to access Art. 15: You have the right to request ValueChecker for copies of your personal data, under certain conditions.
  2. The right to rectification Art. 16: You have the right to request that ValueChecker correct any information you believe is inaccurate. You also have the right to request ValueChecker to complete information you believe is incomplete.
  3. The right to erasure (‘right to be forgotten’) Art. 17: You have the right to request that ValueChecker erase your personal data, under certain conditions.
  4. The right to restrict processing Art. 18: You have the right to request that ValueChecker restrict the processing of your personal data, under certain conditions.
  5. The right to data portability Art. 20: You have the right to request that ValueChecker transfer the data that we have collected to another organization, or directly to you, under certain conditions.
  6. The right to object to processing Art. 21: You have the right to object to ValueChecker’s processing of your personal data, under certain conditions.
  7. The right not to be subject to a decision based solely on automated processing (Art.22): you have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her, under certain conditions. You can view your data that is processed by ValueChecker at any time and free of charge and, if you so wish, modify this data or have it deleted. You can also object to receiving information about products, services or content of ValueChecker. If you wish to make use of one of these options, you can send an e-mail to the Data Protection Officer of ValueChecker via privacy@ValueChecker.ai

  1. Data retention, account deactivation and deletion

Our Company securely stores your data in the EU with a ISO/IEC 27001/27017/27018/27701, SOC 1/2/3, PCI DSS, and FedRAMP certified, and HIPAA, GDPR, and CCPA compliant provider.

If you’ve used our contact form, we will keep your Name, Email and contact information for 30 days. Once this time period has expired, we will delete your data.

If you are a user of ValueChecker products, we store other data until it is no longer necessary to provide our services and ValueChecker Products, or until you request data deletion - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs.

When you delete your account, we may keep data and items you have uploaded, such as your data and images for functionality purposes or in order to fulfill our contractual obligations.

  1. How do we respond to legal requests or prevent harm?

We access, preserve and share your information with regulators, law enforcement or others:

  1. In response to a legal request, if we have a good-faith belief that the law requires us to do so. We can also respond to legal requests when we have a good-faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.
  2. When we have a good-faith belief it is necessary to: detect, prevent and address fraud, unauthorized use of the Products, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, property or Products), you or others, including as part of investigations or regulatory inquiries; or to prevent death or imminent bodily harm.

Information we receive about you (including financial transaction data related to purchases and transactions made on our Products) can be accessed and preserved for an extended period when it is the subject of a legal request or obligation, governmental investigation, or investigations of possible violations of our terms or policies, or otherwise to prevent harm. We also retain information from accounts disabled for terms violations for at least a year to prevent repeat abuse or other term violations.

  1. How do we operate and transfer data as part of our global services?

We share information globally, both internally within the ValueChecker Companies and externally with our partners around the world in accordance with this policy. Information controlled by ICSS AB may be transferred or transmitted to, or stored and processed in, the United States or other countries outside of where you live for the purposes as described in this policy. These data transfers are necessary to provide our services set forth in the Terms and Conditions and to globally operate and provide our Products to you. We utilize standard contractual clauses approved by the European Commission and rely on the European Commission's adequacy decisions about certain countries, as applicable, for data transfers from the EEA to the United States and other countries.

We'll notify you before we make changes to this policy and give you the opportunity to review the revised policy before you choose to continue using our Products.
