Fever – Business Contacts Privacy Notice

This notice explains how Fever handles your personal data if you are a representative of a business, organisation, venue, brand, agency, institution or other entity that Fever engages with — or that we are exploring a potential partnership, sponsorship, event opportunity or other commercial relationship with. It applies wherever you are in the world.

Who we are

We are Fever Labs, Inc. ("Fever", "we", "us"), a corporation organised under the laws of Delaware, USA, TIN 99-0368536, with registered office at 50 Greene St 3 Fl, New York, NY 10013. Fever is a data controller responsible for processing your Personal Data. Any local Fever entity that contacts you or your organisation (including any entity named in the underlying commercial agreement) will also be acting as a data controller to process your personal data (Fever and/or that Fever local entity is referred to as the "Controller").

What personal data we collect

As the case may be, we collect the following:

Identification and contact details: your name, professional email address, professional phone number, LinkedIn profile or other professional social media handles.
Professional information: your job title, role, function, seniority, the organisation you work for and, where relevant, the country/city where you are based and the language(s) you work in.
Interaction data: notes and records of our exchanges (emails, calls, meetings, messages exchanged over LinkedIn or similar channels, business cards you share with us, notes taken at conferences, trade fairs, mixers or industry events), your areas of interest, feedback you share with us and the status and history of our commercial discussions.
Contracting information (where a deal is being finalised): the details needed to prepare and sign a commercial agreement with your organisation, which may include your name, title, professional contact details and signature.

We collect this data:

Directly from you, for example when you share your business card at an event, exchange messages with us on LinkedIn, respond to an outreach email, meet with us at a conference, mixer or industry event, or provide your details in the course of our commercial discussions;
From publicly available sources, such as your organisation's website, your professional social media profiles (e.g. LinkedIn), press releases, industry directories, event attendee lists that are made public, or other public professional sources; and
From third parties, such as business intelligence, sales enablement or lead generation providers, mutual contacts or referrers, and event organisers where they are permitted to share attendee details.

Why we use it

Continue conversations under an existing relationship, including discussing new events, renewals, upsells or additional deals with your organisation. Analyse and improve our commercial activity, including measuring the performance of our outreach, understanding which types of contacts and organisations are most relevant, and improving our processes. Where we rely on our legitimate interest, we have carried out a balancing test and consider that our interest does not override your rights and interests as a business representative. You can always object to this processing — see "Your rights" below.

Who we share it with

We share your data only where needed: with other Fever group companies (for example to coordinate outreach across markets, or when the opportunity concerns an event or partner in another territory); with partners, venues, producers, sponsors, artists' representatives and other organisations we work with on specific opportunities that could be interested in partnering with your organization; with service providers acting on our instructions (such as CRM, sales enablement, email and communications, calendar and meeting, e-signature, hosting and analytics tools); with our professional advisers; and with authorities where the law requires or permits it. We do not sell your personal data.

When using third party tools and solutions in the course of our processing of your personal data, Fever obtains adequate contractual guarantees from its service providers, to keep your data secure, aligning with our legal requirements and best practices.

Notwithstanding the above, regarding Phone number and our SMS Program Terms and Conditions: No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

International transfers

Fever operates worldwide, so your data may be transferred outside your country, including outside the EEA or the UK. When transferring Personal Data outside the EEA or UK to other countries that do not offer a standard of data protection equivalent to the EEA or UK , we will make sure that your Personal Data is sufficiently protected and make sure that proper and adequate data protection safeguards are in place before we transfer your Personal Data.

How long we keep it

CRM / business contact database: for as long as you remain a relevant contact for Fever's commercial activities, and in any event no longer than 24 months from our last meaningful interaction with you, except with your consent. We review our database periodically and delete contacts that are no longer relevant — and promptly if you ask us to stop contacting you or to delete your data.
Records of our commercial discussions: for the duration of the discussions and, if no deal materialises, for a limited period afterwards to document the outcome, in line with the retention above.
Contracting information and records linked to a signed agreement: for the duration of the contract with your organisation, plus the retention and limitation periods required by applicable law (in particular for tax, accounting and audit purposes).
Data collected from public sources or third parties: kept together with the rest of your record and subject to the same retention rules.

Your rights

Depending on your country of residence and the applicable data protection law, you may have the following rights in respect of your Personal Data:

Right to be informed about how we use your Personal Data.
Right of access — to obtain a copy of the Personal Data we hold about you.
Right of rectification — to have inaccurate or incomplete Personal Data corrected (for example when you change role or employer).
Right of erasure ("right to be forgotten") — to have your Personal Data deleted in certain circumstances, including where you no longer wish to be contacted by us.
Right to restrict processing — to limit how we use your Personal Data in certain circumstances.
Right to object — to object to processing based on legitimate interests, including our outreach and prospecting activities, and to object at any time to direct marketing. If you tell us you no longer want to hear from us, we will stop contacting you.
Right to data portability — to receive certain Personal Data in a structured, commonly used and machine-readable format, and to have it transmitted to another controller where technically feasible.
Right to withdraw consent — where we rely on your consent, you can withdraw it at any time, without affecting the lawfulness of processing carried out before withdrawal.
Right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects (we do not currently carry out such automated decision-making in relation to B2B contacts).
Right to lodge a complaint with your data protection authority.

You can exercise your rights, or ask us to stop contacting you, by submitting a request to Fever's Data Protection Officer through this Privacy Form. Local laws may grant you additional rights or modify the rights above. You may use the aforementioned form to contact us for more details on your specific rights and competent data protection authority.

We may need to verify your identity before responding to your request. We will respond within the timeframes required by applicable law (typically one month under the GDPR and UK GDPR, with a possible extension for complex requests).
