Food Vendor Contract and Application
Dear Food Vendor:
Earth Day 2021 is the 50th anniversary of Earth Day redo. We are planning for a great event in Reading’s City Park. The Berks County Earth Day Committee (BCEDC) is approaching you as a potential food vendor at our event. We are inviting food vendors who provide delicious, nutritious, and properly prepared food, and who also appreciate and honor our efforts to reduce, reuse, recycle, and compost during the event.
DETAILS:
Date: Sunday, June 13, 2021 RAIN or SHINE! Time: 11am to 5pm
Location: City Park, Reading, PA 19602
CONTRACT:
All Food Vendors must sign a contract (enclosed) with the Berks County Earth Day Committee (BCEDC) to serve throughout the day on Sunday, June 13, 2021. The City of Reading and the BCEDC reserve the right to approve all vendors and selection of goods/services offered. Applications accepted on a first come, first serve basis.
PRODUCTS AND CONTAINERS:
Food Vendors must submit prices and menus for approval, as well as the type of napkins, cups, and utensils to be used. We encourage you to find ways to reduce the trash you generate during this event. This includes using items made of recycled materials, like napkins and paper plates, or organic materials like bamboo. The Restaurant Store in Wyomissing is one local vendor with a selection of low-impact materials. The use of Styrofoam and plastic straws is strictly prohibited.
FEES:
A non-refundable fee of $200 per Food Vendor will be charged upon application. Payments received by March 15, 2021 will be entitled to a $50 early bird discount. Vendors will not be required to share a portion of their proceeds and there are no additional fees due to the Berks County Earth Day Committee. There are licenses and associated fees for the City.
LICENSE/PERMITS/TAXES:
The City of Reading requires food vendors to have both a Business Privilege License and a Health Permit to sell food at an event. Vendors must submit copies of licenses and permits with their application.
BUSINESS PRIVILEGE LICENSE:
A license is needed to sell items in Reading. If you are already a business in the City, you should have this already. To obtain or renew your Business Privilege License, visit or call the Citizens Service Center at 877-727-3234 and ask for Tax Administration (Myriam Cedeno). Fees may apply. HEALTH PERMIT
As a food vendor, you may already have an annual health permit from your home municipality or from the state. You will also need a one-day itinerant health permit (Event Vendor Health Permit/Application). Apply by submitting the application along with a copy of your health permit and $10 fee to the Code Services office at City Hall (815 Washington St., Reading PA 19601). For more information, contact Tammy Baker or Charles Reed at 610-655-2438. If you do not already have a health permit, there is a $175 fee.
TAXES:
For Reading based food vendors: The Tax Administration office has a business privilege tax form. The tax is $1.50 on each $1,000.00. If tax is less than $1.00, no tax is collected but the form must be completed. If you are from outside the City of Reading and you are only participating in this one-time event, you will NOT need to pay the tax; but you need to file the business privilege tax form. On the form please indicate that you only conducted business within the City of Reading for less than 15 days. If you have a Reading license, this office needs to know your license number. You can call the office with your six-digit number.
NON-PROFIT GROUPS:
Non-Profit groups wishing to sell non-incidental food items will be required to apply as a Food Vendor in addition to any registration they complete as a “non-profit vendor.” Non-profit groups selling produce, eggs, or unprepared fresh products need a business privilege license (no fee), but do not need a vendor health permit.
TABLES/CHAIRS:
BCEDC will provide tables and chairs for a cost of $10 per table and $5 per chair by prearrangement. .
ELECTRICITY:
Electricity will be available on-site. We encourage use of electricity, rather than generators, for a cleaner, quieter, and more pleasant event. List your electricity needs on the application form.
APPLICATION DEADLINE:
April 15, 2021. For all the work necessary on our end, the earlier the better! Please make checks payable to Berks County Earth Day Committee. We look forward to seeing you at Earth Day. Payments received by March 15th will be entitled to a $50 early bird discount.
NOTE: A City Inspector may attend the event to check all licenses and permits. Please make sure that you have all appropriate paperwork with you on the day of the event – otherwise your stand may be shut down. Also remember to forward copies of all licenses & permits along with your application, contract, and fee to BCEDC.

EARTH DAY 2021 FOOD VENDOR CONTRACT
Berks County Earth Day Committee (BCEDC) and ___________________________________________ (herein referred to as Vendor), intending to be legally bound, agree as follows:
1. Vendor agrees to provide food service for attendees at the Earth Day Celebration, an event sponsored by the Berks County Earth Day Committee as follows:

Time: 11am to 5pm
**Vendors must check in no later than 9:30am
We reserve the right to give away your space if you do not check in by 9:30 AM, unless prior arrangements have been made.
2. Vendor shall agree to use NO STYROFOAM or PLASTIC STRAWS and shall use recyclable, reusable or compostable materials whenever possible.
3. BCEDC responsibilities hereunder shall be:
a. BCEDC shall provide Vendor with space. Vendor will bring tables. BCEDC will supply tables upon prearrangement at $10 for each table and $5 for each chair. Any other equipment to be provided by Vendor.
b. BCEDC represents that it has the necessary authority to permit Vendor to occupy said booth and site, which Vendor has been advised of prior to the execution of this agreement.
c. BCEDC shall conduct such promotions of the Earth Day event and of Vendor’s food and location as it, in its sole discretion, deems fit. Vendor is encouraged to use the event logo, which will be supplied upon acceptance of application.
4. Vendor agrees to pay a $200.00 non-refundable registration fee. Deadline is April 15, 2021. We are offering a $50 early bird special for all food vendor contracts received by March 15, 2021.
5. Vendor agrees to hold harmless the City of Reading and the BCEDC, its officers, agents, servants, and employees, of and from all actions, cause of action, damages, suites or claims of any kind resulting from the service provided by Vendor under this agreement, its agents, servants, or employees in the performance of this agreement, personal injury or damage to personal property or real estate resulting from the acts, errors, or omissions of Vendor, its agents, servants or employees, whether negligent of or damage to Vendor’s personal property.
6. This agreement shall be mutually binding to the parties hereto and shall not be assignable. Where the term “it” is used, it shall, when referring to Vendor, include he, she, they or them, as applicable. This agreement contains the entire understanding between the parties hereto and any amendment hereof shall be in writing, signed by both parties.

Remember that BCEDC has negotiated a discount for environmental packaging at The Restaurant Store for your purchase.
Electricity is limited. Describe your electricity needs. No changes can be made after March 15th. List all permits and licenses you have obtained for this event. Attach copies of each.
Please remember that in keeping with the spirit of Earth Day, we ask you to use easily recyclable or compostable plates, beverage containers; napkins, and other materials and to refill reusable drink bottles. Recycling service will be provided. We prohibit use of Styrofoam and plastic straws.
