Liability Waiver & Terms of Participation

In consideration of being permitted to participate in Seattle Frontrunners’ (hereinafter “the club”) runs, walks, races, and events, by signing below, I hereby release, waive, and covenant not to sue and discharge the club and its individual event hosts from liability from any and all claims resulting in personal injury, accidents or illnesses (including death), and property loss arising from participation in the club’s events.

• I certify that I am medically able to perform all activities associated with the club. I know that participating in and volunteering for organized group runs/walks, events, and races associated with the club are potentially hazardous activities, which could cause injury or death. I will not participate in any club organized events, group training runs/walks or social events, unless I am medically able and properly trained.

• I hereby assert that my participation is voluntary, and that I knowingly assume all such risks associated with running, walking, racing, and other club activities. I assume all risks including the effects of the weather: high heat and/or humidity, freezing cold temperatures, heavy precipitation and/or winds, and poor and/or dangerous air quality, some of which may lead to injuries such as heat stroke and heat exhaustion, dehydration and overhydration conditions such as hyponatremia, and catastrophic injuries such as heart attacks and other conditions that could be fatal. I assume all risks associated with traffic and the conditions of the road, track, trail and/or path (e.g. potholes, uneven sidewalks, unlit roads, sidewalks, and paths) and surrounding terrain, which could lead to minor injuries such as scrapes, bruises, sprains, and strains, or more serious injuries such as joint muscle and bone injuries, concussions and other head injuries. I understand that event hosts are not medical personnel and are not meant to diagnose or treat injuries, illnesses, or other conditions. I assume all other risks associated with being a member of the club and participating in all club activities, which may include but are not limited to: falls and physical contact with other participants/members, volunteers, race personnel, contract service providers, and spectators.

• I acknowledge the contagious nature of COVID-19 and other communicable diseases and knowingly assume the risk that I may be exposed to or infected by COVID-19 and/or other communicable diseases by participating in club activities. I acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and/or death.

• I attest that I have read all rules and expectations of the club and agree to follow them and abide by any penalties resulting from my violation of such rules and expectations, including the right of the Board of Directors to deny or suspend my participation for any reason whatsoever without notice. I understand that bicycles, skateboards, roller skates or inline skates, other personal mobility devices unrelated to a disability or health condition, and personal music players that inhibit my ability to hear traffic and other pedestrians, are not allowed in club organized runs or events. I understand that the club does not provide refunds in the event of cancellations of services and that I am not entitled to a refund if any club activities are canceled.

• I acknowledge that I understand that the club strongly discourages bringing dogs, children, strollers to all runs/walks and events, and that I assume all liability if I decide to bring a dog, child, or stroller. This includes injuries to myself and other club participants and spectators resulting from dog bites or scratches, allergic reactions to dogs, and any other injuries that result from physical contact with the dog. This also includes injuries to myself and other club participants and spectators resulting from physical contact with the child or a stroller. Should the club be accused or held liable for injuries resulting from my bringing a dog, child, or stroller, I will personally assume all costs related to such claims or injuries, including medical bills, all legal fees incurred by the club, and any monetary compensation paid by the club (e.g. settlements, lawsuits, etc).

• I grant permission to the club to use my photographs, motion pictures, recordings, or any other images of me for the club’s purposes.

• I agree to indemnify and hold harmless the club and its event hosts from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney fees brought as a result of my involvement in the club.

• I understand and agree that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by Washington State law, and that if any portion thereof is held invalid, I understand and agree that the balance shall, notwithstanding, continue in full legal force and effect.

I have read this waiver of liability, assumption of risk,  and indemnity agreement, and fully understand and agree to its terms. I attest that I am giving up substantial rights, including my right to sue. I, for myself and anyone entitled to act on my behalf, hereby waive and release the club, the Road Runners Club of America, all club sponsors, and their representatives and successors, completely and unconditionally to the greatest extent allowed by the law, from all claims or liabilities of any kind - even if that liability arises out of negligence or carelessness on the part of event hosts or the club.
