The entertainment and information services of Onionfist Studio (“we”, “us”, “our”, “Onionfist”) are subject to the agreement to these Terms of Service, including the data processing agreements as available in our Privacy Policy (http://onionfist.com/privacy_policy/).

Definitions

Service: Service refers to any content provided on www.onionfist.com and any item published by Onionfist Studio on the Chrome Web Store, including but not limited to Ice Dodo, as available on the website (https://onionfist.com/icedodo/) and chrome web store (https://chrome.google.com/webstore/detail/ice-dodo/jhidcpailhmpjpbdbhceiaeeggkalgmd)
User: Any living individual who is using our Service and is the subject of Personal Data.

What Are the Terms of Service?

The Terms of Service constitutes a contract between Onionfist and Users. The Terms include the provisions set forth in this document, the Onionfist Privacy Policy as available on our website (http://onionfist.com/privacy_policy/), and any other terms or conditions that may be presented by us and accepted by you from time to time in connection with specific Service offerings. If you do not agree to these Terms, you do not have the right to access or use our Service. If you do use our Service you shall be deemed to confirm your acceptance of the Terms and your agreement to be a party to this binding contract.

By using the Service, you acknowledge, accept and agree with all provisions of the Privacy Policy, including, without limitation, the use and treatment of the usage data and personal information in accordance with such Privacy Policy. The details of these Terms of Service and Privacy Policy may be updated from time to time and are subject to such changes without notice.

Onionfist reserves the right to the following in relation to the Service.

Users acknowledge and agree that Onionfist (and our licensors) own(s) all legal rights, title and interest in and to the Service, including, without limitation, all software that is part of the Service. Also, we own any contents that you submit to Onionfist Services, and reserve the right to publicly display and modify data.

INTELLECTUAL PROPERTY RIGHTS.

In agreeing to these Terms, you also agree that the rights in the Service and Onionfist Software, including all intellectual property rights, such as trademarks, patents, designs and copyrights, are protected by one or more of copyright, trademark, patent, trade secret and other laws, regulations and treaties, in addition to these Terms and any separate agreement. In particular, you agree to not modify, create derivative works of, decompile or otherwise attempt to extract source code from any Onionfist Software, unless you are expressly permitted to do so under an open source license, we give you express written permission or you are otherwise legally permitted to do so notwithstanding this prohibition.

RIGHT TO MODIFY THE SERVICE.

We retain the right, in our sole discretion, to implement new elements as part of and/or ancillary to the Service, including changes that may affect the previous mode of operation of the Service or Onionfist Software. We expect that any such modifications will enhance the overall Service, but it is possible that you may not agree with us. We also reserve the right to establish limits to the nature or size of storage available to you, the number of transmissions, the ability to send or receive email messages, the nature of, or your continued ability to access or distribute, your Content and other data, and impose other limitations at any time, with or without notice.
You also acknowledge that a variety of Onionfist actions may impair or prevent you from accessing your Content or using the Service at certain times and/or in the same way, for limited periods or permanently, and agree that Onionfist has no responsibility or liability as a result of any such actions or results, including, without limitation, for the deletion of, or failure to make available to you, any Content. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of any part of the Service.
We are not liable for any data loss, such as erasure of level completion records, deletion from the video game leaderboard, or any other form of data. In the case that any data loss occurs, we are not responsible for restoring the data or compensating for the data loss.

RIGHT TO ENGAGE THIRD PARTIES.

Onionfist engages certain affiliates or other third parties (“Service Providers”) to provide technical or other services relating to all or part of the Service, and you hereby agree that such involvement by these Service Providers is acceptable. In addition, Onionfist may contract with third party advertisers to monetize our Service. Please see our Privacy Policy to understand the extent to which any affiliate or third party may have access to your account information or Content and our Commercial Terms to understand our relationship with any third-party group.

RIGHT TO USE THIRD-PARTY SOFTWARE.

Onionfist may from time to time include as part of the Service and Onionfist Software computer software supplied by third parties which is utilized by permission of the respective licensors and/or copyright holders on the terms provided by such parties. We provide information about some of this third party software here and within the particular Onionfist Software. Onionfist expressly disclaims any warranty or other assurance to you regarding such third party software.

RIGHT TO UPDATE OR DELETE OUR SOFTWARE.

In connection with any modification of the Service, Onionfist may automatically download software updates on your computers and devices from time to time with the intention of improving, enhancing, repairing and/or further developing the Service. Onionfist will endeavor to provide you with the option of whether or not to install the update; however, in certain circumstances (e.g., security risks), Onionfist may require you to install the update to continue accessing the Service. In all cases, you agree to permit Onionfist to deliver these updates to you (and you to receive them) as part of your use of the Service.
In some cases, Onionfist may discontinue certain Services. You hereby agree that you agree to permit Onionfist to discontinue its Services without notice.

RIGHT FOR DATA OWNERSHIP

Onionfist Studio shall provide information to the Users. The Users agree that the content(“Content”) in the Service belongs to Onionfist Studio, and shall not use the whole or part of the Content outside of the Service, if there is no written approval by Onionfist Studio. Onionfist Studio shall not retain the authority to censor the web page, but reserves the right to update or delete contents in accordance with its internal principles. Onionfist Studio may limit use of its contents, in part or in whole, by users without notice by Onionfist Studio’s decision. Onionfist Studio shall have rights to use any content, data, post or comment made by the Users.
By using our website, you agree that you consent to Onionfist revealing personal information including but not limited to your video game scores and records, as well as your name if you decide to provide it for the purpose of display on the leaderboard

RIGHT TO DELETE DATA

Users agree that the Onionfist may suspend or delete a User's Page if inactive for a certain period of time or for any or no reason.
Users agree that the Onionfist may restrict the storage capacity, effective period of contents storage, and so forth in Onionfist’s Page.

Can Kids Use Onionfist?

The Onionfist Service is designed for adults; we do not intend to collect personal information from children under the age of 16. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us at flyingdodo9000@gmail.com with the keywords “REQUEST: CHILDREN CONCERN” and details such as name or username to help us identify the User.

How is My Account Closed?

You may deactivate your account with our Service at any time, for any reason (or no reason). However, if you want to deactivate your account you need to take certain specific steps. You must inform flyingdodo9000@gmail.com with the keywords “REQUEST: CLOSE ACCOUNT” and your username, such that we can remove the appropriate data from our storage.

Community Map Submissions
Users may participate in the creation of levels or maps ("Community Maps") for our Service. By submitting a map through our system, you acknowledge and agree to the following terms:

Ownership: Any Community Map submitted to our platform becomes the sole property of Onionfist. As the creator, you grant Onionfist an irrevocable, worldwide, royalty-free license to use, modify, distribute, and display your submitted map for any purpose, including but not limited to marketing, monetization, and inclusion in our services.
Ad Revenue: Users will not receive any form of compensation, including ad revenue, from the use or distribution of their submitted maps. All proceeds generated from Community Maps will remain with Onionfist.
Deletion or Modification: Once submitted, maps cannot be deleted or removed by the user. Due to the highly complex nature of our data systems and the integration of Community Maps into our platform, removing maps from the Service is not feasible. Onionfist reserves the right to modify or remove maps at its sole discretion.

By submitting a map, you confirm that you have read, understood, and agreed to these terms. If you do not agree, please refrain from using our map submission system.

Liability & Disclaimer

Onionfist is not responsible for any content of any third-party websites to which the Onionfist’s Services links.
The accuracy of any information presented by the Service is not guaranteed by Onionfist.
Your use of the service and the purchase and use of any services are all at your sole risk. We are not responsible for any form of addiction or harm of the user arising from the use of the website. Onionfist is not responsible for any malware contracted by using the Service.
Users shall assume full responsibility for maintaining the confidentiality of their IDs and passwords by themselves. Users shall not cause any third party to use their IDs or passwords. Users shall immediately notify Onionfist of any leakage or unauthorized use of their IDs and passwords, and fully comply with the security policies of Onionfist. Onionfist is not responsible for any leak of personal information. Onionfist is not responsible for the leak of personal information.
Onionfist does not warrant that (i) the service will meet all of your requirements; (ii) the service will be uninterrupted, timely, secure or error-free; or (iii) all errors in the software or service will be corrected.
Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and you are solely responsible for any damage to your computer or other device or loss of data resulting from the download or use of any such material.
No advice or information, whether oral or written, obtained by you from onionfist or through or from the service shall create any warranty not expressly stated in these terms of service.
You expressly understand and agree that onionfist, its subsidiaries, affiliates, service providers, and licensors, and our and their respective officers, employees, agents and successors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, cover or other intangible losses (even if onionfist has been advised of the possibility of such damages) resulting from: (i) the use or the inability to use the service or to use promotional codes or onionfist points; (ii) the cost of procurement of substitute services resulting from any data, information or service purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or the loss, corruption or alteration of your transmissions, content or data; (iv) statements or conduct of any third party on or using the service, or providing any services related to the operation of the service; (v) onionfist’s actions or omissions in reliance upon your basic subscriber information and any changes thereto or notices received therefrom; (vi) your failure to protect the confidentiality of any passwords or access rights to your account; (vii) the acts or omissions of any third party using or integrating with the service; (viii) any advertising content or your purchase or use of any advertised or other third-party product or service; (ix) the termination of your account in accordance with the terms of these terms of service; or (x) any other matter relating to the service.

Revision of the Terms and Conditions

Onionfist reserves the right to revise the Terms and Conditions from time to time, without any prior notice. The Users shall be able to review the Terms of Condition in the Service’s website.
