Terms of Service Agreement

This agreement is between I, the Artist, and you, the Client, for work services performed on a project known as the Artwork. The Artwork encompasses all pieces made under the following listings unless specified otherwise by the Artist:

  1. Custom Icon Illustration
  2. Custom Half Body Illustration
  3. Custom Thigh-up Illustration
  4. Custom Fullbody illustration,
  5. Skeb Illustration, and
  6. Other types of custom illustrations

By commissioning me, you agree to abide by the rules of this TOS.

To read the summary, please proceed to the TL;DR below.


  1. CONTENT

I, the Artist, have the right to refuse projects and requests according to my discernment and capabilities. Some content that I will not be comfortable with representing include:

I, the Artist, warrant that the Artwork will be my original work performed to the best of my ability.

The Artist offers mainly two types of commissions: Custom and Skeb.

Custom Commissions

If a Client wants a Custom Commission, they can expect full communication throughout the entire process to ensure that the piece is exactly what they need. There will be updates and feedback exchanges between the Client and the Artist.

Skeb Commissions

On the other hand, Skeb Commissions are the opposite. They are a “Surprise Me” kind of commission where Client will provide the Artist with reference and a description of what they want and the Artist will have full freedom with the piece. There will be no back and forth, no communication at all.

For Orders Requiring Different Rendering Styles:

There are times when the Client only needs a sketch, or lineart of a character and not the whole, fully-rendered piece.

With that, the Artist put together this table for reference.

Rough Sketch

20%

The client will only pay 20% of the total price (e.g., a rough sketch for a Head - Feet drawing would cost $14). This is for Clients who wish to have a rough idea drawn out for them.

Colored Rough Sketch (basic shading)

40%

The client will only pay 40% of the total price. This is for Clients who want a quick concept art of a character. It should be understood that the Artwork will not be the cleanest or most detailed.

Lineart

50%

The client will only pay 50% of the total price. This is for when the Client only wants the outline or lineart of the character, no colors.

Flat Colored Lineart (base colors only)

80%

The client will only pay 80% of the total price. This is for Clients who need a character reference drawing, as lineart and base colors are usually the standard when making character reference sheets.

Cel Shaded Lineart (base colors only)

100%

The client will pay in full. This is for clients who want a colored piece with basic shading and clean lineart.

Colored Lineart (fully rendered)

150%

The client will pay 150% of the total price the reason being the Artist’s usual style does not incorporate lineart in the art process. Therefore, lineart is an extra process and would have additional charges.

The Artist may use the table above as reference for the Client’s other needs, such as making a character reference sheet that requires views from different angles.

It is important that the Client understands the rates above. If unsure, the Client is encouraged to contact the Artist for any clarifications.

Discounts

Repeat Client Discount

For returning clients on X and/or Discord. They are as follows:

Because VGen takes more or less 5% from every commission, these are the discounts available for VGen clients:

The Artist keeps a record of past commissions and clients. It doesn’t matter if a Client’s 3rd commission was on Twitter when they used to commission on VGen, it is still their 3rd commission and will receive the corresponding discount based on the platform.

Multiple Figures Discount

If a Client commissions a piece with more than 1 figure, they will receive a 10% off discount if and only if they agree that they would not be able to receive the separate Artworks of each figure.

Artist’s Discount

Sometimes in appropriate scenarios, the Artist might deem it fair to lower the price of the commission a little more (e.g. when a character’s body is significantly obstructed by an object, element, or another character). Hence, the Artist may decide to offer a discount upon her discretion. This discount is a specific amount to be decided by the Artist.

Computing Discounts and Fees

Discounts are calculated multiplicatively and follow a certain hierarchy elaborated below:

The prices of the listing are first computed. This is the Base Price and only covers how many characters are in the drawing.

Example: x2 Skeb Icon drawings = $30

Multiple Figures Discount

When computing discounts, Multiple Figures Discount, if applicable, takes precedence among the other two types.

Continued example: 30 x 0.1 = 3 → $27

Then, all the add-ons, if there are any, are added to the base price. This means that additional charges for backgrounds, and complex character details are added here.
Continued example: Simple Background ($5)

$27 + $5 = $32

Repeat Client Discount

If the Client is a repeating customer, they can have the price lowered more by using the Repeat Client Discount.

Artist’s Discount

Finally, the Artist can decide if she wants to further reduce the price by deducting a certain amount. This is up to the Artist’s discretion and should not be expected.

After the discounts, the price for the listing and add-ons are done. This is now referred to as the Total Price (not to be confused by the Final Price).

  • Base Price - Price of the listing and add-ons
  • Total Price - Price after the all discounts
  • Final Price - Price after all the fees

Discounts are not applicable to any of the fees.

After computing the Total Price of the artwork, fees will be added.

Rush Fee

This is half of the Total Price.

Revision Fee

A fixed amount of $10.

Commercial Fee

A fixed amount of $100 for small and independent individuals.
An amount of $100 plus additional fees arranged through a contract for larger businesses.

It will be up to the Artist to decide on the final price, but the Artist will commit to be 100% transparent with the Client for the breakdown of costs. The final price is negotiable but only up to a certain extent.

  1. TIMELINE & PROCESS

Process

For every commission, there will be a draft phase where the Client can freely communicate with the Artist over the details.

Delivery

VGen deliveries will take place on the platform itself.

For deliveries outside of VGen, the Client will receive access to a Google Drive Folder which contains the Artwork. The Artwork will remain in the folder indefinitely, so please immediately download everything as soon as possible. The Client will not be notified when the uploaded Artwork will cease to be available.

Expected Delivery Date

The completion of the Artwork requires 14 days at minimum, and may typically take 3 to 5 weeks or more, depending on commission type, complexity, and workload of commissions. Deadlines and timelines will be adhered to in good faith but may not be possible sometimes.

Estimated Time of Completion:

The deadlines are arranged according to the Artist’s schedule as a full-time student.

IMPORTANT: Requesting for deadlines earlier than the minimum set deadline will be considered as a rush commission, and will therefore be subject to a rush fee.

  1. COMMUNICATION

Communication will take place throughout the entire project timeline with updates and bouncing ideas. The Artist will ask for feedback when there is something to show. The Artist will let the Client know if anything is causing delays or priority shifts in the project.

  1. RIGHTS, USAGE & CREDITS

Rights and Usage

Unless otherwise specified in a contract between the Client and the Artist, the Artist retains original copyright and ownership of the Artwork, which includes but may not be limited to redistributing, reproducing, advertising, displaying the Artwork in the Artist’s websites, social media and portfolios according to my discretion. The Artist has rights to repurpose unused process work for future projects, personal or otherwise.

For Clients who wish to use the Artwork for commercial purposes, licenses and reselling rights must be purchased. Commercial means:

Credits

The process will likely be posted i.e. on X and/or Youtube. The Client can request to be tagged/mentioned or not.

Non-Disclosure Agreement

        The Artist highly discourages requests of permanent non-disclosure of the Artwork. All the works done for the Client can be used by the Artist on social media posts and portfolios. However, the Artist can delay the exposure or usage of the said Artwork for a given period of time, specified by the Client.

If the Client does not give an exact date, with or without the Client’s consent, the artist can and will:

        However, should an NDA be absolutely necessary, the Client will be charged a fee of $20 per commissioned Artwork. This means that should a returning Client commission the Artist again but request for non-disclosure, they will have to pay another $20.

        This non-disclosure fee is applicable to the following listings: Icon Illustration, Half Body Illustration, Thigh-up Illustration, Fullbody illustration, and Skeb Custom Illustration.

  1. PAYMENTS, CANCELLATION, REFUNDS

Payments

For X/Discord Orders:

Before starting the project, the Client must pay in full or at least a 50% down payment. Full payment must be made before the Client can receive the final Artwork.

For VGen Orders:

The Artist only accepts full payment before doing any work.

Cancellation And Refunds

For X/Discord/VGen Orders:

If the Client requests cancellation, it will be refunded if, and only if, the Artist is notified before the Artwork starts. Once the Artwork begins, refunds are not possible unless initiated by the Artist.

Other notes:


  1. AGREEMENT

I reserve the right to refuse to accept projects if it does not align with my services and capabilities.

By commissioning, you confirm you are at least 18 and above or have a legal parent/guardian to agree to all of the terms of service as listed above.

The date for this agreement is upon the first inquiry/communication for the commission or upon the first transaction made.



TL;DR

GENERAL

The Client is not allowed to ask me to draw anything that I’m uncomfortable with. That includes:

  1. Furry/furries
  2. Fully mech/robotic
  3. NSFW
  4. Excessively muscular form
  5. Older adults
  6. Gore or excessive violence
  7. Copying other artists’s art styles

PAYMENTS

Only full payments are available on VGen.

On other platforms, I accept either full payment or a down payment of 50% before starting any work.

REVISIONS

There will be one free minor revision after delivery for custom illustrations.

There will be no revisions for YCH and Skeb-like illustrations.

DEADLINES AND DELIVERY

The completion of the Artwork requires 14 days at minimum, and may typically take 3 to 5 weeks or more, depending on commission type, complexity, and workload of commissions.

The Client can pay a rush fee if they wish to have the ETA shortened.

USE

The Artist retains original copyright and ownership of the Artwork.

All delivered works are for personal use only unless the Client paid for Commercial License.

Clients may not at any time modify, edit, change the Artwork without permission from the Artist.

Clients are granted exclusive rights for personal use of the Artwork produced as agreed upon, which must not be transferred to any other parties.

INTELLECTUAL PROPERTY RIGHTS

The Artist retains original copyright and ownership of the Artwork, which includes but may not be limited to redistributing, reproducing, advertising, displaying the Artwork in the Artist’s websites, social media and portfolios according to my discretion. The Artist has rights to repurpose unused process work for future projects, personal or otherwise.

REFUNDS

If the Client requests cancellation, it will be fully refunded if, and only if, the Artist is notified before the Artwork starts. Once the Artwork begins, refunds are still possible but only partially depending on how much work is done.

COMMUNICATION

Communication will take place throughout the entire project timeline with updates and bouncing ideas. The Artist will ask for feedback when there is something to show. The Artist will let the Client know if anything is causing delays or priority shifts in the project.

Communication between the Artist and Client will mainly take place using VGen's Direct Messaging function. However, if the Artist remains unresponsive after 3 days, the client may reach out through X (@runeskies) or send an email at runeskies.art@gmail.com
