Huishoudelijk Reglement

BABYTHEEK NEKKERSDAL

1. Geïnteresseerden moeten meerderjarig zijn (18 jaar of ouder) om lid te kunnen worden van de Babytheek.
2. Lidgeld voor de Babytheek bedraagt voor een individu 30 euro per jaar. Dit wordt geïnd via cash of overschrijving. Het lidmaatschap gaat in vanaf het geld wordt ontvangen door de Babytheek. Het bestuur kan lidgeld kwijtschelden, bijvoorbeeld bij donaties.
3. Leden die babymateriaal ontlenen gaan automatisch akkoord met het volledige huisreglement, dat op de website van de Babytheek is te raadplegen. Voorafgaand aan de eerste uitlening worden zij van het reglement op de hoogte gebracht.
4. Vooraleer een lid voor de eerste keer een voorwerp uitleent bij de Babytheek wordt de identiteit van het lid geverifieerd. Verificatie gebeurt door het tonen een identiteitskaart.
5. Uitgeleende spullen mogen enkel gebruikt worden voor persoonlijk gebruik en niet voor handelspraktijken, verhuur, commerciële en professionele activiteiten.
6. Enkel leden worden toegelaten om de spullen van de Babytheek te gebruiken, tenzij per uitzondering met expliciete toestemming van de Babytheek. Hoe dan ook, in geval van schade veroorzaakt door niet-leden wordt het lid dat het item geleend heeft verantwoordelijk gesteld voor deze schade, en zal dit lid instaan voor de herstelkosten of vervanging.
7. Elk voorwerp inclusief alle toebehoren zullen voor en na elke ontlening gezamenlijk nagekeken worden door de ontlener en een Babytheek medewerker. Alle spullen/voorwerpen moeten in dezelfde staat terug gebracht worden als waarin ze werden uitgeleend, op normale slijtage en onopzettelijke schade na. Het ontlenende lid staat in voor eventueel verlies, diefstal of schade door nalatigheid van de spullen. De ontlener dient het item zorgvuldig schoon te maken alvorens het terug te brengen. Alle textiel (ook onderdelen) moet gewassen teruggebracht worden. Indien hieraan niet voldaan wordt, zal de Babytheek hiervoor 3€ per item dat niet proper is aanrekenen.
8. Als uitgeleende spullen beschadigd worden of niet teruggebracht worden zal de Babytheek het volledige bedrag voor herstelling of vervanging terugeisen van de ontlener.
9. Als een voorwerp ernstig beschadigd wordt teruggebracht kan de Babytheek kiezen om het item te vervangen (binnen de 30 dagen). Het lid dat dit item laatst leende staat in voor de vervangingskosten.
10. Er zijn twee categorieën die de uitleentermijn bepalen: lange termijn en korte termijn. Lange termijn spullen kunnen tot 6 maanden uitgeleend worden. Korte termijn spullen kunnen tot 3 weken uitgeleend worden.
11. Items kunnen enkel tot 4 maand voor uitlening gereserveerd worden.
12. Reservatie vervalt indien items niet opgehaald worden binnen de twee openingsdagen Babytheek volgend op startdatum reservatie.
13. Spullen dienen teruggebracht te worden tegen deze vervaldatum op een moment dat de Babytheek geopend is. De openingsuren staan steeds vermeld op onze website en in de online inventaris. De Babytheek behoudt het recht om hernieuwingen te weigeren en zal dit doen op basis van de vraag.
14. Na een uitleenperiode van 6 maanden kunnen items verlengd worden per maand op voorwaarde dat het item NIET gereserveerd werd door andere leden.
15. Indien een voorwerp te laat terug gebracht wordt, kan een boete opgelegd worden van 1€/dag. De Babytheek behoudt het recht om boetes kwijt te schelden of aan te passen in geval van speciale omstandigheden.
16. De Babytheek behoudt het recht de nodige stappen te ondernemen om niet terug gebrachte items of niet betaalde boetes op te eisen, inclusief het gebruik van rechtbanken, deurwaarders, …, en de kosten hiervan te verhalen op het betreffende lid.
17. Leden gaan ermee akkoord dat de Babytheek niet verantwoordelijk is voor productie-, materiaal-, of kwaliteitsdefecten van het uitgeleende materiaal.
18. De beheerders van de Babytheek zijn tijdens de openingsuren steeds beschikbaar voor uitleg over de spullen. Echter, van zodra een voorwerp uitgeleend wordt, verklaart het lid in kwestie automatisch dat hij/zij in staat is is om het toestel/voorwerp op een veilige en juiste manier te gebruiken. Het lid verklaart daarbij ook dat alle mogelijke schade, inclusief lichamelijke letsels, berokkend door het voorwerp, niet kan verhaald worden op de Babytheek en volledig ten laste van het lid valt.
19. Bij elk teken van onveiligheid of breuk van een uitgeleend toestel/voorwerp, verbindt de ontlener er zich toe het gebruik van het toestel/voorwerp dadelijk stop te zetten. In dat geval dient hij of zij het item zo spoedig mogelijk terug te brengen en de toestand van het voorwerp te melden aan de Babytheek.
20. De Babytheek behoudt zich ten allen tijde het recht voor om elke uitlening van babyspullen te weigeren voor grondige redenen.
21. De Babytheek behoudt zich het recht om het huisreglement te allen tijde te wijzigen.

Règlement Intérieur 

1. Il faut être majeur (18 ans min.) afin de pouvoir devenir membre de la Babytheek.
2. La cotisation annuelle à la Babytheek est de 30 euros. Ce montant sera payé en cash ou par virement bancaire. L'affiliation commence à partir du moment où la Babytheek reçoit la cotisation. Celle-ci peut renoncer à des frais d'affiliation, par exemple en cas de dons.
3. Les membres qui empruntent du matériel pour la première fois acceptent automatiquement le règlement intérieur qui est disponible sur le site de la Babytheek. Ces règles seront communiquées également avant le premier emprunt.
4. Avant le premier emprunt, l'identité du membre est vérifiée. La vérification se fait en montrant une carte d'identité.
5. Le matériel emprunté doit être réservé à un usage personnel et non pour le commerce, la location ou des activités commerciales et professionnelles.
6. Seuls les membres de la Babytheek sont autorisés à utiliser le matériel, à l’exception de l’accord explicite de la Babytheek. Quoi qu'il en soit, en cas de dommages causés par des non-membres, le membre qui a emprunté le matériel sera responsable de ces dommages et remboursera ou remplacera le matériel en question.
7. Chaque article, y compris tous les accessoires, sera contrôlé conjointement par l'emprunteur et un bénévole de la Babytheek avant et après chaque emprunt. Le matériel doit être rendu dans le même état dans lequel il a été prêté, sauf usure normale et dommages accidentels. Le membre est responsable pour toute perte, vol, ou dommage engendré par une importante négligence. Le membre doit nettoyer soigneusement le matériel avant de le rendre. Les articles textiles doivent impérativement avoir été lessivés avant d’être retournés à la Babytheek. Dans le cas contraire, la Babytheek se réserve le droit de réclamer 3€ par article non lessivé.
8. Si du matériel prêté est endommagé ou n’est pas rendu à la Babytheek, celle-ci réclamera la totalité du montant requis pour le réparer ou le remplacer.
9. Si le matériel est gravement endommagé, la Babytheek peut prendre la décision de le remplacer (dans les 30 jours). Le membre qui a récemment emprunté ce matériel est responsable pour les coûts de remplacement.
10. Il existe 2 catégories d’emprunt: longue durée et courte durée. L’emprunt de longue durée peut courir jusqu’à 6 mois tandis que l’emprunt de courte durée est limité à 3 semaines.
11. La réservation expire si les articles ne sont pas enlevés endéans les deux jours d’ouverture suivant la date du début de la réservation. Horaires d'ouverture
12. Les articles peuvent seulement être réservés pour un prêt jusqu'à 4 mois à l'avance.
13. Le matériel doit être rendu avant la date d'expiration pendant les heures d’ouverture de la Babytheek. Les heures d’ouverture sont toujours affichées sur notre site et dans l'inventaire en ligne. La Babytheek se réserve le droit de refuser une demande de prolongation sur base de la demande d’autres utilisateurs. Cette règle est d’application sauf indication contraire sur notre site.
14. Après une période de prêt de 6 mois, les articles peuvent être prolongés par mois à condition que l'article n'ait PAS été réservé par d'autres membres.
15. Si le matériel est rendu en retard, une amende peut être imposée de 1€/jour. Les amendes doivent toujours être payées avant que d'autres emprunts puissent être effectués. La Babytheek se réserve le droit de renoncer à des amendes ou de les ajuster en cas de circonstances particulières.
16. La Babytheek se réserve le droit de prendre les mesures nécessaires pour récupérer du matériel non rendu ou des amendes impayées, y compris le recours aux tribunaux ou aux huissiers etc, et de se faire rembourser ces coûts par le membre concerné. Les membres acceptent que la Babytheek ne soit pas responsable des défauts de fabrication ou de qualité du matériel prêté.
17. Pendant les heures d'ouverture, les bénévoles de la Babytheek sont disponibles pour des explications concernant l’emploi du matériel. Cependant, une fois qu’un article est emprunté par un membre, celui-ci est censé être capable de l’utiliser de façon sûre et appropriée. Le membre est également d'accord que tous les dommages, y compris les éventuelles blessures corporelles, ne seront jamais dédommagés par la Babytheek et sont de sa seule responsabilité. La notice d’utilisation de chaque article, pour autant qu’elle soit disponible, est à consulter dans l'inventaire en ligne de la Babytheek. L'emprunteur est censé la lire attentivement et en respecter les recommandations lors de son utilisation.
18. Au moindre signe d'insécurité ou de défaut d'un article emprunté, le membre s’engage à en cesser immédiatement l’usage. Dans ce cas, il rend l’article le plus tôt possible et signale le défaut à la Babytheek.
19. La Babytheek se réserve  le droit de refuser à tout moment le prêt de matériel pour des raisons fondées.
20. La Babytheek se réserve le droit de modifier à tout moment le règlement intérieur.

House rules

1. Interested parties must be of age (18 years or older) in order to become a member of the Babytheek.
2. Membership fees for the Babytheek amount to 30 euros per year for an individual. This is collected by cash. Membership starts as soon as the money is received by the Babytheek. The board can remit membership fees, for example in the case of donations.
3. Members who borrow baby material automatically agree to the complete house rules, which can be consulted on the website of the Babytek. They will be informed of the regulations prior to the first loan.
4. Before a member borrow an object from the Babytek for the first time, the identity of the member is verified. Verification is done by showing an identity card.
5. Borrowed items may only be used for personal use and not for commercial practices, rental, commercial and professional activities.
6. Only members are allowed to use the equipment of the Babytek, unless by exception with the explicit permission of the Babytek. In any event, in the event of damage caused by non-members, the Member who borrowed the item shall be responsible for such damage, and this Member shall be responsible for the cost of repair or replacement.
7. Each item, including all accessories, will be checked jointly by the borrower and a Babytek employee before and after each loan. All equipment/objects must be returned in the same condition in which they were lent, except for normal wear and tear and accidental damage. The borrowing member shall be responsible for any loss, theft or damage caused by negligence on the part of the goods. The borrower must clean the item carefully before returning it. All textiles (including parts) must be washed back. If this is not met, the Babytek will charge 3€ per item that is not clean.
8. If lent items are damaged or not returned, the Babytek will reclaim the full amount for repair or replacement from the borrower.
9. If an object is severely damaged and returned, the Babytek can choose to replace the item (within 30 days). The member who last borrowed this item is responsible for the replacement costs.
10. There are two categories that determine the lending period: long term and short term. Long-term items can be borrowed for up to 6 months. Short-term items can be borrowed for up to 3 weeks.
11. Reservation expires if items are not collected within two opening days following the start date reservation. Opening moments

13. Items must be returned by this expiration date at a time when the Babytek is open. The opening hours are always mentioned on our website and in the online inventory. The Babytek reserves the right to refuse renewals and will do so on the basis of demand.
14. After a loan period of 6 months, items can be extended per month provided that the item has NOT been reserved by other members.
15. If an object is returned too late, a fine may be imposed of 1€/day. Fines must always be paid before other things can be borrowed. The Babytek reserves the right to cancel or adjust fines in case of special circumstances.
16. The Babytheek reserves the right to take the necessary steps to claim non-returned items or unpaid fines, including the use of courts, bailiffs, etc., and to recover the costs thereof from the member concerned.
17. Members agree that the Babytek is not responsible for production, material or quality defects of the loaned material.
18. The administrators of the Babytek are always available during opening hours for explanations about the stuff. However, as soon as an object is borrowed, the member automatically declares that he/she is capable of using the device/object in a safe and proper manner. The member also declares that all possible damage, including physical injuries, caused by the object, cannot be recovered from the Babytek and is entirely at the member's expense.
19. In the event of any sign of insecurity or breakage of a loaned appliance/object, the borrower undertakes to immediately stop using the appliance/object. In that case, he or she must return the item as soon as possible and report the condition of the item to the Babytek.
20. The Babytek reserves the right at all times to refuse any loan of baby equipment for thorough reasons.
21. The Babytek reserves the right to change the house rules at any time.
