Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Ketik via https://www.ketik.my and its subdomains (including the Ketik web application) and the Ketik mobile applications (collectively, the “Services”).
By creating an account, subscribing, accessing, or using the Services, you agree to be bound by these Terms.
DEFINITIONS
- “Ketik”, “we”, “us”, “our”: IFCON TECHNOLOGY SDN. BHD. (200901036809 (879936-M)) and/or its related entities operating the Services.
- “Customer”: the organization (company/sole proprietor/partnership) that registers and controls a Ketik account.
- “User”: an individual authorized by Customer to use the Services (e.g., admin, supervisor, staff).
- “Content / Customer Data”: data submitted to the Services by Customer/Users, including employee/attendance and related information.
ABOUT THE SERVICES
Ketik is an employee attendance and productivity management system accessible via web and mobile, supporting attendance methods such as biometric/fingerprint, face recognition, and QR code (depending on configuration).
ELIGIBILITY AND AUTHORITY
You represent that:
- You are at least the age of majority and can form a binding contract; and
- If you use the Services on behalf of a Customer, you have authority to bind that Customer to these Terms.
ACCOUNT REGISTRATION AND SECURITY
- Account creation. You must provide accurate and complete information during onboarding/registration and keep it updated.
- Credentials. You are responsible for maintaining the confidentiality of login credentials and for all activity under your account.
- Unauthorized use. You must notify us promptly if you suspect unauthorized access or security breaches.
TRIAL, PLANS, SUBSCRIPTION TERM, AND CHANGES
- Trial. New accounts may start on a free 7-day trial (where offered).
- Plans and minimum term. Ketik offers subscription packages; the minimum subscription period is 1 year (where stated on the website).
- Activation timeline. After successful payment and confirmation, an account may be activated within 2 working days (where stated).
- Upgrades. You may upgrade only to plans above your current plan. Upgrades may include prorated adjustments/discounts as shown at checkout.
- Downgrades. Where stated, you may not downgrade to a lower plan until the current subscription term ends.
- Renewal. Unless otherwise specified in the Services or your order form, subscriptions renew per the plan shown in your account. You are responsible for ensuring renewal and billing settings are correct.
FEES, BILLING, TAXES, AND PAYMENTS
- Fees. Subscription fees are shown in the Services/checkout and may be offered monthly and/or yearly depending on plan. 
- Taxes. Fees may be exclusive of applicable taxes unless stated otherwise.
- Payment processing. Payments may be processed via third-party payment gateways; you authorize us and/or our payment partners to charge your chosen payment method for fees and applicable taxes.
- Transaction records. You can view transaction history within the Services (where available).
- Non-payment. If payment is overdue, we may suspend or restrict access to the Services until payment is received.
ACCEPTABLE USE
You must not (and must not allow Users to):
- Use the Services in violation of any applicable law or regulation;
- Interfere with, disrupt, or attempt to gain unauthorized access to systems or networks;
- Upload or transmit malware, exploit code, or harmful content;
- Circumvent plan limitations, security, or access controls;
- Misrepresent attendance, identity, or authorization in a fraudulent manner.
We may suspend or terminate access for violations.
CUSTOMER RESPONSIBILITIES (WORKPLACE, EMPLOYEES, AND COMPLIANCE)
- Workplace compliance. Customer is responsible for ensuring the Services are used in compliance with employment laws, workplace policies, and any required employee notices/consents (including for biometric/face recognition/QR attendance methods, if used).
- Accuracy. Customer is responsible for the accuracy of Customer Data entered or uploaded.
- Admin controls. Customer must manage roles/permissions and remove access for departing personnel promptly.
PRIVACY AND DATA PROTECTION
- Privacy Policy. Our Privacy Policy explains how we collect, use, and protect personal data; it forms part of these Terms by reference.
- PDPA. We state commitment to protecting personal data in accordance with Malaysia’s Personal Data Protection Act 2010 (“PDPA”).
- Customer Data. You grant us the right to host, process, transmit, and display Customer Data to provide and support the Services.
- Third-party links. The Services may link to other websites; those sites are governed by their own policies.
INTELLECTUAL PROPERTY
- Our IP. The Services, software, interfaces, designs, and trademarks are owned by us or our licensors.
- License to you. We grant Customer a limited, non-exclusive, non-transferable license to access and use the Services during the subscription term, subject to these Terms.
- Restrictions. You must not reverse engineer, decompile, copy, or create derivative works of the Services except as permitted by law.
SERVICE AVAILABILITY, SUPPORT, AND CHANGES
- Availability. The website states service availability/assurance and support response targets (where applicable).
- Changes. We may modify, update, or discontinue parts of the Services. If changes materially reduce core functionality during an active paid term, we will use reasonable efforts to provide notice via the Services or email.
SUSPENSION AND TERMINATION
- By you. You may stop using the Services at any time. Ending use does not automatically cancel a subscription unless cancellation is completed in the Services or agreed in writing.
- By us. We may suspend or terminate access immediately if:
- You breach these Terms;
- Your use poses a security risk, legal risk, or harms the Services/others; or
- Required by law or a regulator.
- Effect of termination. Upon termination, your license ends. We may retain and/or delete Customer Data according to our Privacy Policy and internal retention practices, subject to law and reasonable operational needs.
DISCLAIMERS
- As-is. The Services are provided on an “as is” and “as available” basis.
- No legal/HR advice. We do not provide legal, HR, payroll, or tax advice. Output reports and attendance summaries should be reviewed by Customer for compliance and correctness.
- Third-party services. We are not responsible for third-party services (e.g., payment gateways, app stores, or external websites).
LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- We will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill.
- Our aggregate liability for claims relating to the Services will be limited to the amount paid by Customer for the Services in the 3 months preceding the event giving rise to the claim (or another limit required by applicable law).
INDEMNITY
Customer agrees to indemnify and hold us harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:
- Customer Data,
- Customer/Users’ misuse of the Services,
- Customer’s violation of laws or third-party rights (including employment and data protection obligations).
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of Malaysia. Unless prohibited by law, disputes will be subject to the exclusive jurisdiction of the courts located in Malaysia.
CHANGES TO THESE TERMS
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on the website or within the Services. Continued use after the effective date means you accept the updated Terms.
