Foodie Membership Agreement & Waiver of Liability

1. Acknowledgment of Risks

By signing up as a member of Nom Nom Club (the “Club”), an offering of Sun Creative Services, LLC, I acknowledge and understand that participating in any events, meal services, tastings, or food experiences (“offerings”) organized, facilitated, or promoted by the Club may carry inherent risks, including but not limited to food allergies, illness, personal injury, or adverse reactions to food or drink.

2. Waiver of Liability

I voluntarily and knowingly assume all risks associated with my participation as a Club member and agree to release, discharge, indemnify, and hold harmless Sun Creative Services, LLC, Nom Nom Club, their owners, officers, employees, representatives, contractors, and affiliates (collectively, the “Released Parties”) from any and all claims, liabilities, damages, or causes of action arising from or in any way related to my participation in Club activities or consumption of food or beverages provided, prepared, or recommended by the Club or its members.

3. Health and Allergies

I understand and acknowledge that:

• I am responsible for being aware of and managing any food allergies, dietary restrictions, or health conditions that may affect me or anyone consuming the culinary creations I order through Nom Nom Club, and for taking necessary precautions to protect against these risks.
• I understand that although reasonable efforts may be made to accommodate dietary needs, cross-contamination may occur, and there is no guarantee that food provided will be allergen-free.

4. Assumption of Responsibility

I assume full responsibility for my actions, behavior, and any consequences arising from my involvement in any Club-related activities, including but not limited to the preparation, handling, or consumption of any food or drink. I agree to follow all guidelines, recommendations, and rules established by the Club to ensure the safety and well-being of all members.

5. Limitation of Liability

Under no circumstances will the Released Parties be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to my participation in the Club.

6. Authorization for Use of Image

I hereby grant Nom Nom Club permission to use any photographs, videos, or other media of me taken at Club events for promotional purposes, including but not limited to social media, website content, and marketing materials, unless I provide written notice (e.g. physical letter, email, etc.) to opt out.

7. Authorization for Use of Data

I hereby grant Nom Nom Club permission to collect, analyze, use, and share any data I provide, as well as data collected from my interactions with the Club’s platform and services in a secure, responsible, and anonymous manner where possible. This data may include, but is not limited to, demographics, location, transaction history, preferences, feedback, and engagement patterns.

Nom Nom Club may use this data for a variety of purposes, including but not limited to:

• Personalizing Member Experience: Tailoring recommendations, offers, and services to better match my preferences and enhance my overall experience.
• Improving Services: Optimizing product offerings, platform features, and customer service based on user behavior and preferences.
• Market Research and Analysis: Conducting data-driven analyses to understand trends, member demographics, and user engagement, with the goal of refining the Club’s services and maximizing platform experience.
• Targeted Marketing and Partnerships: Leveraging insights for targeted marketing and collaborating with partners to deliver relevant offers that align with members’ interests.

Nom Nom Club will ensure that all data used and shared will be handled in a secure, responsible, and anonymous manner where possible, in compliance with applicable data protection laws and regulations.

By agreeing to this authorization, I understand that my data will be instrumental in enhancing the Nom Nom Club experience and supporting the Club’s growth and profitability.

8. Fees and Cancellations

I acknowledge that membership in Nom Nom Club is free to join. I understand that all advertised prices for culinary creations or experiences from featured Local Artisans include any applicable service and payment processing fees. There are no additional charges beyond the listed price at checkout.

By placing an order, I acknowledge and agree that all sales are final. No cancellations, changes, or refunds will be permitted after an order is placed. I also understand that failure to pick up an order within the designated food pickup times may result in the order being considered abandoned.

9. Agreement to Abide by Terms

By joining the Nom Nom Club, I agree to the terms outlined in this waiver and any future guidelines or policies set by the Club. I understand that my membership may be revoked at any time for failure to comply with these terms.

10. Governing Law

This waiver and release of liability shall be governed by and construed in accordance with the laws of the state of Maryland in which Sun Creative Services, LLC, the parent company of Nom Nom Club, is headquartered, without regard to its conflict of law principles.

By signing up for membership in Nom Nom Club, I confirm that I am at least 18 years of age and have read, understood, and agree to the terms outlined in this agreement and waiver of liability effective upon the date of which this Agreement & Waiver is accepted.

I acknowledge that Sun Creative Services, LLC, the parent company of Nom Nom Club, may update these terms periodically and agree that any updates will be communicated to me at least 30 days before they take effect.
