FOG Technologies - Terms & Conditions

Welcome to FOG Technologies Pvt. Ltd. (“FOG”, “we”, “our”, or “us”). These Terms and Conditions govern your use of our products, services, and any content we provide (collectively, the “Services”).

By purchasing, accessing, or using our games or services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

SECTION 1 - ACCEPTANCE OF TERMS

By using our games or services, you confirm that you:

• Are of legal age to form a binding contract in your jurisdiction.
• Agree to comply with all applicable laws and regulations while using our services.

SECTION 2 - USAGE AND PLAYER CONDUCT

Users are expected to:

• Use the services for entertainment purposes only.
• Refrain from any malicious activities, including hacking, reverse engineering, or tampering with game systems or hardware.
• Follow proper in-game conduct when playing multiplayer or team-based games, respecting the experience of others.

Prohibited Activities:

• Use of cheats, bots, or unauthorized software to manipulate gameplay.
• Engaging in fraudulent transactions or using false information.
• Uploading or sharing offensive or illegal content during gameplay or via game forums.

We reserve the right to suspend or terminate your access to our games for violating these terms.

SECTION 3 - PAYMENT AND FEES

For games sold or distributed to operators, any payment and transaction terms will be governed by individual contracts between FOG and the operator. FOG is not responsible for payment disputes between operators and users at game centers.

Future features, including subscription-based services or in-game purchases, will be governed by updated payment terms at the time of release.

SECTION 4 - REFUNDS AND CANCELLATIONS

We do not offer refunds or cancellations for products or services once sold, unless otherwise specified in a separate contractual agreement. Users are advised to check with the operator for policies related to refunds on pay-per-play games.

SECTION 5 - LIMITATIONS OF LIABILITY

FOG Technologies is not liable for:

• Any malfunctions, game performance issues, or downtime after the product has been sold to an operator.
• Any data loss, breaches, or performance disruptions that occur due to actions of operators or third-party service providers.

While we aim to provide the best possible service, FOG is not responsible for any issues that arise due to operator misuse or failure to follow our recommended protocols.

SECTION 6 - USER-GENERATED CONTENT

By playing our games, users may provide in-game content such as usernames, high scores, or recorded gameplay. FOG reserves the right to use this content for marketing, research, and game improvement purposes, in compliance with local regulations.

Operators or third-party services that collect user-generated content are responsible for ensuring that the collection and use of this data comply with applicable laws, including obtaining consent where required.

SECTION 7 - INTELLECTUAL PROPERTY

All intellectual property rights related to the games, content, and technology we provide, including but not limited to trademarks, logos, game mechanics, and software, are owned by FOG Technologies. Users and operators are granted a non-exclusive license to use our services, subject to these Terms.

You may not reproduce, distribute, or create derivative works from our games or content without prior written consent from FOG.

SECTION 8 - THIRD-PARTY SERVICES

Our games and services may involve third-party platforms (e.g., cloud services, payment gateways). FOG does not control these third-party platforms and is not responsible for any issues, breaches, or misuse of personal data by these platforms.

Operators and users are encouraged to review the privacy policies and terms of any third-party services involved in processing payments or managing user data.

SECTION 9 - TERMINATION

FOG reserves the right to terminate your access to our games and services for any violations of these Terms or unlawful use of our products. Termination may occur without prior notice in cases of severe misconduct.

SECTION 10 - GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes related to these Terms will be resolved in the courts located in Gujarat, India.

SECTION 11 - CHANGES TO TERMS

FOG may update or modify these Terms at any time. Changes will be effective immediately upon posting on our website or in-game notifications. Continued use of our services following any changes constitutes acceptance of the new Terms.
