1. These terms and conditions tell you about the legal terms and conditions which apply to your purchase and use of Smiddy Farm Shop gift cards.
2. These gift card terms apply to gift cards purchased in-store at the Smiddy Farm Shop or online through the Smiddy Farm Shop website.
3. The Smiddy Farm Shop reserves the right to update and change the terms and conditions of our gift cards at any time. This does not affect your legal rights. Use of your Smiddy Farm Shop gift card constitutes acceptance of our Terms and Conditions and we therefore recommend you read them carefully. These gift card terms may be updated from time to time. It is your responsibility to ensure you are aware of any changes which may have been made. These gift cards remain the property of the Smiddy Farm Shop who maintains the right to cancel the card at its sole discretion in situations where it is deemed necessary to do so (such as to comply with applicable laws or as a result of circumstances beyond its control).
4. The balance on your gift card can be redeemed in-store at the Smiddy Farm Shop in Blair Drummond provided the gift card is redeemed within the redemption period. Gift cards shall have a redemption period of 12 months from the date of issue.
5. The gift card balance cannot be exchanged for cash or redeemed against the purchase of another card. Purchases of gift cards are non-refundable.
6. No change will be given but any unused balance will remain on the Gift Card and may be applied to future purchases.
7. You can top-up your gift card or enquire about the remaining balance and validity at the Smiddy Farm Shop by taking your card to the tills.
Validity
8. Your Smiddy Farm Shop gift card is valid for a period of 12 months from the date of issue, following which it expires automatically. A gift card cannot be used once it has expired, and any remaining balance will be removed and the card will become invalid and no longer available for use. We have no means of reminding you of a gift card’s expiry, and it is therefore your sole responsibility to ensure that any balance is used in full prior to expiry.
9. A Gift Card expires automatically once its balance has been exhausted. A Gift Card may be topped up with additional funds provided the gift card is still valid and has not yet expired.
10. Gift Cards may be used to pay for the whole or any part of an in-store purchase.
Lost/ Stolen/ Damaged
11. You should treat Gift Cards like cash. Once a Gift Card is purchased, the risk of loss and title for Gift Cards pass to the purchaser. You are solely responsible for the safekeeping and security of your gift card. In cases where your Smiddy Farm Shop gift card is lost, stolen, or damaged, Smiddy Farm Shop is unable to replace or reimburse the remaining balance on a card. Smiddy Farm Shop cannot be held responsible for any balance lost on a Smiddy Farm Shop gift card as a result of theft or fraud.
Crediting a Smiddy Farm Shop gift card
12. Please retain an expired gift card should you wish to return your purchase. Any goods paid for using a gift card that are subsequently returned for a refund will be credited to the original gift card, or in the event that you have discarded or misplaced your original card, issued on a new Smiddy Farm Shop gift card. For returns where part payment was taken from a gift card, the refund will be credited to your gift card in the first instance.
13. If a partial refund is made for any purchase using a Smiddy Farm Shop gift card and another method of payment, then any refund amount owing will be credited to the Smiddy Farm Shop gift card in the first instance. Any remaining refund balance will be refunded to a method of payment nominated by you.
Data Protection
14. No personal data is collected pertaining to the purchase or redemption of Smiddy Farm Shop gift cards beyond what is needed for any other type of purchase. All personal data is treated in accordance with current applicable data protection and privacy legislation and our privacy policy, which can be found at www.blairdrummondsmiddy.co.uk/pages/privacy-policy.
Governing Law and jurisdiction
15. These conditions are governed by and construed in accordance with the laws of Scotland. You agree, as we do, to submit to the non-exclusive jurisdiction of the Scottish courts.
