Liability Waiver (v. 20210423)

Upon purchase and/or continued participation with or at Dragon & Phoenix Healing Arts, you hereby agree to the following:

1. That I am participating in a Class, Workshop, or Preregistered session and/or event offered by Dragon & Phoenix Healing Arts LLC during which I will receive information / instruction about and related to the activity I voluntarily chose which may include but is not limited to yoga, trapeze, reiki, martial arts, boxing, kickboxing, or other fitness and/or wellness activity. I recognize this may require some physical exertion, which may be strenuous and may cause physical injury. I am fully aware of the risks and/or hazards involved.
2. I understand that it is my responsibility to consult with a medical professional prior to and regarding my participation in any activities offered at or with Dragon & Phoenix Healing Arts LLC, its instructors, staff, owners or affiliated vendors. I certify that I am physically fit and I have no medical condition, which would prevent my full participation in the above.
3. I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in any program/event/activity at Dragon & Phoenix Healing Arts LLC.
4. I knowingly, voluntarily and expressly waive any claim that I may have against Dragon & Phoenix Healing Arts LLC, its instructors, staff, affiliated vendors, and its owners, for any injury, death or damages that I may sustain as a result of being in the Dragon & Phoenix Healing Arts LLC facility or as a result of participating in a program/event/activity hosted by Dragon & Phoenix Healing Arts LLC, its instructors, staff, affiliated vendors, or its owners; including loss that may be caused by the negligence of the released party.
5. I release and discharge Dragon & Phoenix Healing Arts LLC, its directors, owners, affiliated vendors, staff and its instructors from any and all liability, claim, demand or action that I may have related to the loss, theft or damage of any of my personal property while at the Dragon & Phoenix Healing Arts LLC facility, the location of the class, workshop, session, activity or event, my location of choice, or my own home.
6. I hereby grant Dragon & Phoenix Healing Arts LLC permission to use my likeness in a photograph, video, or other digital media ("photo") in any and all of its publications, including web-based publications, without payment or other consideration.

1. I understand and agree that all photos will become the property of the Dragon & Phoenix Healing Arts LLC and will not be returned.
2. I hereby irrevocably authorize the Dragon & Phoenix Healing Arts LLC to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.
3. I hereby hold harmless, release, and forever discharge the Dragon & Phoenix Healing Arts LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

7. I recognize, acknowledge and understand that the above waivers and acceptance of responsibility apply to activities in-person or online via virtual or remote mediums.
8. I, my heirs or legal representatives, forever release, waive, discharge and covenant negligence or other acts.
   

I have read the above release and waiver of liability and fully understand its contents.
I am 18 years of age or older and voluntarily agree to the terms and conditions stated above.
If the participant is under 18 years of age: As a legal guardian, I consent to the above conditions and terms.

Upon purchasing, you hereby understand and agree to the following refund policy:
By purchasing services, you will not be due, offered or entitled to any refund from failure to cancel or reschedule a booked appointment and any attempts to reschedule after a no-show is at our sole discretion on a case-by-case basis.
We do not offer any refunds for services, but will work with you to resolve any issues on a case-by-case basis. Failing to schedule, reschedule, or attend your appointed time will result in no refund. Depending on the service and availability, we may offer a reschedule time but this is at our discretion. Please alert us to any changes in your booked appointment time.

I HAVE READ AND UNDERSTAND THE ABOVE WAIVER OF LIABILITY AND PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY THEIR SIGNATURES.
