TANKVIEW® WARRANTY - New Zealand

Your TankView® device is warranted to be free from defects in materials or workmanship for 18 months from the date the TankView® device was purchased by you, provided that the device is used in accordance with any documentation or other instructions provided by IOT Water. This warranty does not cover device failure due to abuse, misuse, accident, improper installation, unauthorised alterations or repairs, shipping damage, wear and tear or corrosion. This warranty will also not apply if the device’s  external housing has been opened without authorisation by IOT Water, the serial number or other labels have been removed or altered, or the specified input voltage has been exceeded.  Visible signs that component damage has occurred due to excessive voltage means that the device will not be covered by this warranty. This warranty is not transferable, and only applies to TankView® devices purchased directly by you from TankView®.

Where the device does not conform with the warranty set out above, TankView® retains the exclusive right to repair or replace the device at its sole discretion. SUCH REMEDY SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY. In the event that TankView® chooses to replace the device, it may be replaced with a factory reconditioned unit or a new unit at TankView®’s sole discretion. Where a replacement device is provided, the original device becomes the property of TankView® and the warranty will continue from the purchase date of the original device. Repairs or replacement will be made at no charge for parts or labour, provided that you will be responsible for any transportation costs of returning the device to TankView®.

THE WARRANTIES AND REMEDIES CONTAINED HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY LIABILITY ARISING UNDER ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, STATUTORY OR OTHERWISE. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, WHICH APPLY IN THE COUNTRY, TERRITORY OR STATE IN WHICH YOU MAKE THE PURCHASE OF YOUR TankView® DEVICE. You agree to contract out of sections 9, 12A and 13 of the New Zealand Fair Trading Act 1986, and that it is fair and reasonable that you are bound by this warranty. You agree that you are acquiring and distributing the device for business purposes and that the New Zealand Consumer Guarantees Act 1993 does not apply to the supply of the devices to you.

IN NO EVENT SHALL IoT WATER BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE, MISUSE OR INABILITY TO USE THE PRODUCT OR FROM DEFECTS IN THE PRODUCT. SOME REGIONS OR STATES DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
