BILLOWBEAST’S TERMS OF SERVICE

By purchasing a commission, you acknowledge and agree to the following terms. My commission prices can be found at the end of my terms of service!

General Terms

• Clients must provide a clear, SFW visual reference of the character (unshaded and unrendered is strongly preferred) - descriptions are only accepted for custom designs + ref sheets.
• Clients understand that their piece may be streamed and WIPs will be posted in my discord server or on social media
• Private commissions are accepted but include a 50% fee of the original piece
• I don’t adhere to strict deadlines
• Any edits to the finished piece or on previous phases (lineart edits during the coloring phase) will incur an additional fee. In case of my mistake or oversight, fixes are free.
• I reserve the right to reject any commission inquiry for any reason.
• The client understands that I may or may not post their commission to my social media accounts
• Work in progress screenshots/updates will be provided at multiple stages
• Please do not send me NSFW references/artwork in the form of fetish content unless explicitly approved.
• Nude references with genitals/NSFW content visible may be sent in case of NSFW commissions. If the commission is SFW, please ask/warn me before sending it and wait for my approval, or censor it in some way (place it under a spoiler) with a clear content warning.

My Art Process

• Please consider filling out the appropriate form to streamline the process!
• Turnaround time usually takes 4-6 weeks at this time, but may take me up to 3 months after payment date.
• I do not always colorpick - I may alter the colors slightly to better fit the mood and energy of the piece. I do not work with pure black/whites either.
• I maintain consistent communication and generally ask the same of my clients - please notify me if you need time to reply so I can put your commission on hold.
• Once I begin, I will send work-in-progress updates at multiple stages: basic sketch, refined sketch, final sketch, lineart, color, rendering, shading, and then the final piece
• I will not move onto the next phase until reviewed and approved by the client - please take the time to look at the WIPs thoroughly and give me as much feedback as you’d like <3
• I will allow major changes up until the refined sketch point - once the final sketch is finished, I will not make any major changes. Minor changes can be made during each respective phase (lineart edits during the lineart phase, color edits during the coloring phase, etc)
• Any alterations requested to previous phases after the shading or rendering phase is completed will incur an additional fee, regardless of complexity
• I will allow slightly more flexibility in edits with custom designs when it comes to features and patterning/designs, but please be mindful of the phase in which you are requesting edits. If you suspect there will be a lot of edits, please inform me before payment as the custom fee will increase.

Artwork and Design Usage

• Any purchased adopts/designs created by me may be changed to your heart’s desire - this includes gender, species, patterns, pallet, etc but you must credit me for the original design
• I reserve the right to use the commissioned artwork for advertising/portfolio content (private commissions are exceptions)
• Clients may use the artwork for personal use only - you may have merchandise made for yourself (and friends) as long as you are not selling them
• Clients cannot sell the work in any form unless commercial rights are agreed upon - this includes merchandise of any kind.
• Clients are expected to credit me when reposting to other sites and only share the watermarked version

• None of my artwork or designs can be used for or associated with hate speech or bigoted content in any way.
• Under no circumstances will my work be used for or associated with NFTs, AI, or anything of the like.
• I do not keep original files for more than 6 months after the piece is completed - since I keep most of my files backed up, I clean things out every few months for space and my own sanity. If this is a problem, you are welcome to request the file for your safekeeping.

My Trello/Queue

• My queue is updated during my work days, and may not be updated during my days off (including weekends and sick days).
• My work status and commission status are all updated there consistently and archived as needed
• I make frequent and itemized updates to my public queue on my work days - please refer to that first if you have any questions about my status or your position in my queue (otherwise please don’t hesitate to reach out!)
• I work on a few projects at once (in batches) and complete them in batches. I do not typically move onto other batches until the first batch is done.
• Clients who send payment first get priority in my queue, and certain tiers on ko-fi get top priority.

Payment Policies

• Payment will be via paypal invoices or ko-fi!
• I take payment up front before I begin a piece (partial or full) and will not provide a guaranteed spot in my queue until then.
• New clients are able to request partial payment up front, and a sketch be provided before full payment is sent (granted the piece itself isn’t a sketch).
• Clients will only be added to my official queue once payment is sent, partial or full
• Payment plans will be available for commissions over $200 and may coincide with the phases of my process (half payment will entail half the work be completed before the rest is required)
• Those who send payment first (partial or full) get priority in my queue

Refund Policies

• Full refunds will be available up until the final sketch is completed.
• Partial refunds will be available based on how much of the piece is completed (up to 80%).
• If a full refund is issued, the sketched piece may be repurposed into a ‘Your Character Here’ opportunity for others.
• Refunds on designs are NOT available - please resell if required
• I will issue any refund manually - please do not initiate a chargeback through paypal.
• Chargebacks on designs will result in your rights to the design being revoked, the design resold, and you being blacklisted

Actions that will result in blacklisting:

• Sending me unsolicited fetish artwork without my consent
• Refusing to correct errors/violations upon my request
• Requesting I draw things that are blatantly against my terms/views
• Promoting/participating in or using my work to assist in promoting hate speech or bigoted content
• Reselling my artwork without prior agreement
• Intentionally forcing a chargeback at any point, regardless of reason.

If you are blacklisted or I cancel in the middle of a commission, I will refund you based on the amount of work completed - sketches will be repurposed as YCHs.
