SCOPE OF THIS PRIVACY POLICY

This Privacy Policy describes how 30 Minutes to President’s Club and its affiliates (“30MPC,” “we,” “our” or “us”) collect, use, and disclose the information we collect from and about you. This Privacy Policy applies to the Website http://30mpc.com (the “Website”), operated by or on behalf of 30MPC; the services and information available via the Website, including 30MPC’s email newsletter, guides, and podcasts; and any online location or digital assets controlled by us (collectively, the “Services”) (the Services, together with our Website, are referred to as the “Platform”).

INFORMATION WE COLLECT

The information we collect may vary depending on how you interact with the Platform, us, and other parties such as our sponsors. This information consists of the following:

2.1 Information You Provide. In connection with your visits and interactions with us through the Services, we may collect information from you. The following describes common types of information you may provide us.

We collect certain information that you provide directly to us, such as when you sign up for a newsletter or event on the Platform, participate in a survey, communicate with us, or interact with us at an online or offline event. This information may include, without limitation:

Your first and last name;
Your email address;
Your phone number;
Your physical address;
Your transaction information, if you make a purchase from us, such as a record of what you purchased (please note that we do not collect your payment card information; our third party payment processor does this on our behalf);
Your industry/sector of employment;
Your employer;
Your position/job title;
Your social media handle (e.g., if you engage with us on social media); and
Any other information about yourself that you provide to us when, for example, you fill out a form on the Website, post any information (e.g., comments or content) to the Platform, sign up for a promotion or contest, or interact with us via email or otherwise.

In some circumstances, such as to register for a paid event, you may also provide your billing and/or shipping address and payment card information, which is collected and processed by a third-party payment processor. This payment processor’s privacy policy and terms will therefore apply to how they collect and process your payment information. We never have access to your full payment card information.

If you provide us with any information relating to people other than yourself, you represent that you have the authority to provide this information for us to use and disclose in accordance with this Privacy Policy.

Please be aware that if you post information about yourself on a publicly visible area of the Platform, other individuals will be able to view that information. Please exercise discretion in deciding what to make public about yourself.

We also collect information from our contacts at sponsors, suppliers, vendors, business partners, and similar businesses, such as when you contact us to learn more about sponsorship opportunities or partner with us to provide services or offerings. This information may include, without limitation:

Your first and last name;
Your email address;
Your phone number;
Your postal address or location;
Your job position/title;
Your employer and industry;
Government identifiers;
Financial account information and related transactional information (if we need to make payments to you or receive payments from you);
Contents of communications with us;
Written, visual, and audio content if you submit such content for publication or participate in an event.

2.2 Automatically Collected Technical and Device-Related Information. When you use the Platform, we and our vendors may also collect certain information about you automatically using cookies and similar technologies (“Automatically Collected Information”). Cookies and similar technologies may collect technical information about your device and your use of the Platform, such as your IP address, device and similar identifiers, information about your device’s hardware and software settings, device type, device model, operating system, the type and version of your web browser, activity on our Platform (such as the pages you visit, the date and time of access, and features used), and referrer addresses. We may also collect this kind of information when you interact with email messages or other communications we send you.

Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use our Platform. Tracking pixels (sometimes referred to as web beacons or clear GIFs) are tiny electronic tags with a unique identifier embedded in websites, online ads, and/or email; they are designed to collect usage information like ad impressions or clicks and email open rates, measure the popularity of our Services and associated advertising, and access cookies. We and our vendors (including Hubspot and Google Analytics) also use these technologies and the information collected by them for data analytics purposes. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-Out Browser Add-on. To generally update your cookies settings to notify you when a cookie is being set or updated or to disable cookies altogether, please consult your web browser settings. Please note that if you delete or choose not to accept cookies from us, you may miss out on certain features of our Services.

2.3 Information From Other Sources. We may collect information about you from other sources, such as publicly accessible content, including social media networks (for example, when you interact with us by following us on LinkedIn or liking our posts there), other publicly available sources and databases, data aggregators, analytics providers, marketing companies, organizers of events we sponsor, sponsors of events we organize, partners who help distribute our content, and other parties to help us supplement our records. We may collect information about you from other individuals, such as if we offer the ability to refer a friend to the Platform or any of our Services. We may combine the information collected from other sources with other information we collect about you.

HOW WE USE INFORMATION

We use the information we collect for the following purposes:

To provide you with the Platform, including Services you request;
To facilitate transactions (note that our third-party payment processor, not us, processes your payment information);
To conduct security and fraud monitoring, prevention, and detection activities;
To allow you to participate in contests, special offers, and surveys;
To respond to your inquiries and manage relationships;
To customize your experience and use of the Platform;
To market and advertise our Platform and Services, and third parties’ products and services, to you, including to send you offers, newsletters, publications, updates, and mailings related to our products or services or those of our affiliates and sponsors that we think may be of interest to you (subject to applicable law and any preferences you communicate to us);
To understand and analyze use of our Platform;
To perform internal administration, auditing, operation, and troubleshooting for our Platform;
To engage in personalized advertising;
To improve our Platform and develop and test new services and content;
To protect the safety and property of us, the Platform, our personnel, and other parties;
To comply with legal and regulatory obligations and obtain legal counsel; and
For any other purpose, with your consent or at your direction.

We may de-identify your information or aggregate your information with that of others so that it cannot reasonably identify you. We may use and disclose this de-identified or aggregated information to any party for any lawful purpose.

For the purposes above, we may also combine the information that we collect through the Platform with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Privacy Policy.

The laws in some jurisdictions require companies to tell you about the legal grounds they rely on to process your information. Our legal bases for processing your information as described in this Privacy Policy are as follows:

Where use of your information is necessary to perform our obligations under a contract or commitment to you. For example, to provide the services you’ve requested from us, or to comply with our legal terms and policies.
Where use of your information furthers our legitimate interests or the legitimate interests of others. For example, to operate and provide security for the 30MPC Services, facilitate our programs, receive payments for your purchases, defend our legal rights, and prevent fraud.
Where we use your information to comply with applicable legal obligations. For example, keeping track of your donations for tax and auditing purposes.
Where you have consented to our processing of your information for a particular purpose.

HOW WE DISCLOSE INFORMATION

We may disclose your information as follows:

4.1 Our Vendors We may disclose your information to vendors that perform services to help us run our business and provide the Platform, such as Platform maintenance, order fulfillment, customer service, email distribution, promotion or contest management, analytics, security, and legal services.

4.2 First Party and Third Party Advertising. We may disclose your information to third-party advertising technologies (e.g., ad networks and ad servers, or other advertising partners) that help us advertise the Platform and our Services. We may allow these third parties to place cookies or other tracking technologies on your browser or device to collect information about you to assist in the delivery of relevant advertising on other websites you visit and other online services you use. We may also use audience matching services from these third parties to reach people (or people similar to people) who have visited our Platform or are identified in our databases (“Matched Ads”) by providing certain information, such as your email address or hashed email address, to these third parties or using a cookie or similar technology on the Platform. These third parties use this information to deliver Matched Ads.

We may also disclose certain information to third parties (such as joint marketing partners and sponsors of our events) for their own marketing purposes and activities. These marketing activities may take place on our Platform or elsewhere and may involve a third party placing cookies and similar technology on our Platform that collect your information.

4.3 Legal Purposes, Preventing Fraud, and Ensuring Safety. We may disclose your information if required to do so by law or where we have a good faith belief that it is necessary:

To comply with the law or legal process, including to cooperate with government authorities such as regulators and law enforcement;
To protect and defend our rights, property, and safety and those of our employees, sponsors, and others; and
To protect against fraud, misuse, or unauthorized use of our Platform.

4.4 Business Transfers. We may disclose your information in connection with a reorganization, merger, sale, joint venture, assignment, transfer, business transaction, or other disposition, including a disposition in connection with a bankruptcy or similar proceedings (including in contemplation of such transactions or events) of all or substantially all assets or stock of the 30MPC business unit or division responsible for the information under this Privacy Policy. If such transfer is subject to any mandatory restrictions under applicable laws, we will comply with those restrictions.

4.5 With Consent. We may disclose your information for any other lawful purpose with your consent or at your direction.

HOW WE SAFEGUARD INFORMATION WE COLLECT

We have put in place security measures designed to protect your information from loss, accidental destruction, misuse, or unauthorized access or disclosure, including physical, technical, and administrative measures. Nevertheless, please keep in mind that no information transmitted via the internet is completely secure, and any information disclosed online can potentially be collected and used by parties other than the intended recipient.

OUR RETENTION OF INFORMATION

We retain information for as long as needed or permitted in light of the purpose(s) for which it is collected and used, and consistent with applicable law. The criteria used to determine our retention periods include, without limitation, the length of time we have an ongoing relationship with you and provide our Services to you; whether we are legally obligated to retain information for a certain period of time; and whether we have other business or legal reasons for retaining information, such as to protect against legal claims or defend ourselves in litigation.

YOUR RIGHTS AND CHOICES

7.1 Your Rights. The laws of your jurisdiction may provide you with certain legal rights regarding your information, which (depending on your jurisdiction) may include the following:

Access to, or a copy of, your information;
Confirmation that we are processing your information;
Correction or amendment of your information;
Deletion of your information;
Transfer of your information to a third party; or
Restriction or objection to certain uses of your information

If you have provided consent for us to use your information for a specific purpose, you may also request to withdraw that consent.

To exercise these rights, you may email us at compliance@30mpc.com, stating the right(s) you want to exercise and the information regarding which you want to exercise such right(s). We will consider all requests and provide our response within the time period required by applicable law. We may require additional information from you to help us verify your identity and process your request. Depending on the nature of the request and legal requirements, if we are unable to verify your identity, we may deny your request.

Please note that certain information may be exempt from such requests (e.g., where we are required to keep information for legal purposes, or where deletion of information would interfere with freedom of expression). In addition, we reserve the right not to respond to a request where we have no legal obligation to do so.

7.2 Marketing Communications. If you no longer wish to receive marketing emails from us, you can opt out by either (1) following the “unsubscribe” instructions located near the bottom of each email message or (2) emailing us at compliance@30mpc.com. Please note that if you opt out of marketing communications, we may still send you service-related communications such as an email informing you about an event that you signed up for, a transaction you completed though the Platform, changes to your account, or a notice of changes to our legal terms, including this Privacy Policy.

7.3 Cookies. As mentioned above, we and our vendors and other third parties may use cookies and similar technologies to collect certain information about you. You may be able to set your internet browser or device to stop accepting new cookies, notice when you receive a new cookie, or disable existing cookies. Please consult the “Help” section of your browser for more information. The setting will apply only to the browser or device you are using, so you will need to reset the setting on a different browser or device. If you disable some or all cookies, the Platform may not function as intended and some features may be unavailable.

7.4 Do Not Track (“DNT”). DNT is a privacy preference that users can set in certain web browsers. We do not currently recognize or respond to browser initiated DNT signals. You can learn more about Do Not Track here. At this time, like many other companies, we do not respond to DNT signals.

7.5 Online Analytics. We and our vendors may use third-party analytics services on the Platform to help us understand use of the Platform, including Google Analytics. These parties may use cookies and other technologies to help collect, analyze, and provide us with reports and/or data. 7.6 Online Advertising. As noted above, we may allow third-party advertising technologies (e.g., ad networks and ad servers, or other advertising partners) to place cookies or other tracking technologies on your browser or device to collect information about you to assist in the delivery of relevant advertising on other websites you visit and other online services you use. These ads may be based on your current activity or your activity over time and across other websites and online services and may be tailored to your interests. For example, if you visit the Platform, you may see ads for 30MPC on other websites you visit.

We neither have access to, nor does this Privacy Policy govern, the cookies or other tracking technologies that may be placed on the device you use to access the 30MPC Services by such non-affiliated third parties. If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Network Advertising Initiative’s Consumer Opt-Out link, the Digital Advertising Alliance’s Consumer Opt-Out link, or Your Online Choices to opt out of receiving tailored advertising from companies that participate in those programs. You also may opt-out from Google Analytics for Display Advertising or the Google Display Network by using Google’s Ads Settings.

These opt outs only apply to the specific browser or device from which you opt out, so you will need to express your preferences on each browser or device you use to access the Platform. Please note that these opt-outs only prevent the participating ad partners from showing you tailored advertising for our Platform. You may still see ads about us or our Platform after opting out – however, these ads will not be tailored to you.

We do not control these third-party opt-out mechanisms or whether our advertising partners participate in them. We cannot guarantee and are not responsible for, and make no representations about, the effectiveness, accuracy, or continued availability of these opt-out mechanisms.

7.7 California “Shine the Light” Disclosure. Under certain circumstances, if you are a resident of California, the “Shine the Light” law may allow you to opt out of our disclosure of certain “personal information” (as defined in the “Shine the Light” law) to third parties for those third parties’ own direct marketing purposes. To make such a request, you may email us at compliance@30mpc.com and specify that you are making a “California Shine the Light Request.”

CHILDREN’S PRIVACY

Our Platform and Services are not directed toward children under 13 years of age or 16 years of age for those who habitually reside in the European Economic Area or United Kingdom. No one under these ages may provide any personal data to the Platform. We do not knowingly collect information from children under an age where parental consent is required, including any “personal information” (as defined in the Children’s Online Privacy Protection Act), from children under the age of 13. If you are a parent or guardian and believe we have collected personal information from your child, please contact us at compliance@30mpc.com.

NOTICE OF INTERNATIONAL DATA TRANSFERS

30MPC is based in the United States. If you are located outside of the United States, please be aware that we may process and store your information in the United States and other jurisdictions where we or our vendors or third parties are located. Data protection laws in the United States and other jurisdictions may be different from those of your country of residence. By using the Platform or otherwise providing your information to us, you consent to the transfer of your information to such jurisdictions. If you do not want your information to be transferred in this way, do not use our Platform or otherwise interact with us.

THIRD PARTY SITES

The Platform may link to third party websites, social media platforms, or other online services, that we do not own or control. This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties. If you decide to access any of the third party links from the Platform, you do so subject to the terms and conditions of use and privacy policies for such third parties. We encourage you to familiarize yourself with third parties’ privacy policies and terms of use before you provide your information to them.

UPDATES TO THIS PRIVACY POLICY

From time to time, we may update this Privacy Policy to reflect our practices and to comply with applicable law. In the event of any substantive or material changes, we will communicate these changes to you by posting the updated Privacy Policy on the Platform and/or notifying you of the change via the Platform, email, or other methods.

The “Last Updated” date at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective as of the date we post the revised Privacy Policy unless a different effective date is provided. To the extent permitted by applicable law, your continued use of the Platform following such notice constitutes your agreement to follow and be bound by the updated Privacy Policy. If you do not agree with the changes, stop using our Platform.
