The following privacy policy ("Privacy Policy") applies to the content, products and services listed on, and your use of, www.creativebeing.com, including any content, functionality and services offered on or via www.creativebeing.com ( "Website") and through our Creative Being applications ("Apps") or via any other delivery methods to you. Such content, product and services are collectively referred to herein as the “Service” or “Services”.
  2. This Privacy Policy is used to inform you of our policies regarding the collection, use, and disclosure of any Personal Information of anyone who decides to use any of our Services. If you choose to use our Service, then you agree to the collection and use of information in relation to this policy.
  3. The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at www.creativebeing.com unless otherwise defined in this Privacy Policy.
  4. As stated in our Terms and conditions all Creative Being Services are provided “as is” and “as available”. The information contained in the Services is for general information purposes only.

  1. Personal Data Collection
  1. Personal data (as defined in the General Data Protection Regulation (“GDPR”). Creative Being may collect and process about you includes

  1. For App users of the Services as part of an account provided as part of a company agreement (“Company account”), company data (in addition to data in 2.1) will be collected and processed by us which includes your

  2. Company email address
  3. Company department
  4. Location/Company office
  1. The app does use third party services that may collect information used to identify you, including transaction information from third-party app market providers used to install our app or purchase a subscription.

  1. Creative Being does not collect or process personal debit or credit card data as regards in-app purchases. Our app market providers collect payment card with regards to in-app purchases made through the apps.

  1. Data we collect automatically
  1. Creative Being uses analytics software to enable us to understand the functionality and use of our Apps.  This software may collect and use data on your usage of our Services and performance data.  This data may be linked to any personal data you provide within the App.
  2. When you visit the website and use our Apps, Creative Being may also collect certain data through the use of “cookies” and other automated means. Such data may comprise of the following:
  1. date and time
  2. originating IP address
  3. domain name
  4. type of device
  5. browser and operating system used (if provided by the browser)
  6. URL of the referring page (if provided by the browser)
  7. object requested
  8. completion status of the request
  9. geographic location
  10. language preferences.
  1. Creative Being also obtains information about you from other sources, including transaction information from third-party app market providers used to install our app or purchase a subscription.

  1. App Log Data

Creative Being wants to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

  1. Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.
  2. This Service does not use these “cookies” explicitly. However, the Website or App may use third party code and libraries that use “cookies” to collect information and improve their services.

  7. completing research via a questionnaire or survey either in-app or via email
  8. requesting promotional information from us

Creative Being does not collect data which is, by its nature, particularly sensitive (e.g. genetic data, biometric data, data revealing racial or ethnic origin, political opinions, sex life, sexual orientation, religion or other beliefs, data concerning health, criminal background or trade union membership) unless it is volunteered by you.
  2. Creative Being may use certain sensitive personal data where you have given your explicit consent to us doing so, to better serve and meet your needs. Such sensitive data is only used by Creative Being for the purpose of providing the services you request and will not be shared or used by us for any other purposes.

  1. If you participate in a survey you may be asked to provide information which may include Personal Information. All information collected in our surveys is provided by you voluntarily. Creative Being may use such information to measure and improve our Services.

  1. Uses of information as part of a Company account
  1. If you register and/or use the Services through a Company account “Company Subscription” the Company will have access to
  1. Your name
  2. Your email address
  3. Your app usage and activity (if requested by and permissioned via your Company)
  1. To verify your registration via a Company account Creative Being may verify your account via a third-party platform and allow the third party access the personal data provided in order to perform the verification.  

  1. Other Service Providers
  1. Creative Being may employ third-party companies and individuals for the following reasons:
  1. To facilitate provision of our Service
  2. To provide the Service on our behalf
  3. To perform Service-related services; or
  4. To assist us in analysing how our Service is used.
  1. Creative Being wants to inform users of this Service that these third parties may have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated by Creative Being not to disclose or use the information for any other purpose and maintain its confidentiality and security.

  1. Creative Being Services may contain links to third-party website or services that are not owned or controlled by Creative Being. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, Creative Being strongly advise you to review the Privacy Policy of these websites. Creative Being has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services.

  1. Children’s Privacy
  1. These Services do not address anyone under the age of 13. Creative Being does not knowingly collect personally identifiable information from children under 13. In the case Creative Being discovers that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided Creative Being with personal information, please contact us at admin@creativebeing.com so that we will be able to do the necessary actions.

  1. Creative Being values your trust in providing us your name, email address and mobile number as Personal Information, thus we strive to use reasonable means of protecting it. However, information transmitted via the internet or electronic methods cannot be completely secure and we cannot guarantee its absolute security.
  2. Once Creative Being has received your information, we store your data using AWS services which are industry-leading for data security and show that all AWS services can be used in compliance with the GDPR. Creative Being reserves the right, at our sole discretion, to change storage provider without notifying you but we will ensure comparable levels of security and compliance are maintained.
  3. When creating and account and choosing a password, you are responsible for keeping your password and any other account details confidential.
  4. The Personal Information that Creative Being collects is used for providing and improving the Service. Creative Being will not use or share your information with anyone except as described in this Privacy Policy.
  5. Data will be kept only as long as necessary for the purposes that it was collected.
  1. Personal data relating to your account will not be retained if you request your account to be deleted.

  1. GDPR gives certain rights to applicable individual users regarding your personal data. Creative Being has applicable procedures to enable applicable individual users to exercise those rights. These include, but are not limited to:

  1. Creative Being will respond to any request in a timely manner as stated by the GDPR.
  2. To request the access, deletion or an objection to use of your personal information that Creative Being has please email admin@creativebeing.com.
  3. To unsubscribe from an account or withdraw consent to marketing communications you can follow the opt-out instructions in the App or email your request to admin@creativebeing.com.
  4. In the event of a deletion request, Creative Being will permanently anonymise your data such that it can never be reconstructed to identify you as an individual
  5. You have the right to file a complaint with the supervisory authority about data protection practices.

  1. Legal Basis of Data Processing
  1. For applicable individual users the legal bases for processing are set out in Article 6 of the GDPR.  When Creative Being uses or processes your personal data, we do so;
  1. To perform our responsibilities under the Terms and Conditions (Contract) between you and Creative Being to provide the Services you have requested.
  2. To meet our legitimate interests in processing your personal data including to provide timely materials, information and customer service about your account and Creative Being Services and collect data regarding Service usage for the purpose of improvements to Creative Being Services, or;
  3. When Creative Being has your consent to do so.

  1. Creative Being reserves the right, at our sole discretion, to change, modify or replace this Privacy Policy at any time. Thus, you are advised to review this page periodically for any changes. Creative Being will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
