1. CONCOURS EUROVISION SMOOT CONTEST 2024 – CONDITIONS DE VOTE EN LIGNE

Le vote en ligne du Concours Eurovision Smoot Contest 2024, y compris ses fonctionnalités de vote, auquel les présentes conditions générales s’appliquent, est coordonné par

l’Union Smoothoise de Radio-Télévision supervisée par Aziourty et DjRedstone

(ci-après « USR »).

et est accessible via vote.smoot.fr.

Les membres du public du monde entier peuvent voter au Concours Eurovision Smoot Contest 2024 (ci-après « Votant » ou « Vous ») en votant en ligne via la Plateforme correspondante (le « Service de vote »).

En accédant au service de vote et en votant en ligne au Concours Eurovision Smoot Contest 2024, vous acceptez expressément d'être lié par les présentes conditions générales et vous vous engagez à ne pas interférer avec le vote et/ou les règles énoncées ci-dessous.

  1. La première phase du vote débutera à 12h00 CET le 29 Juillet 2024 et se terminera le samedi 10 Août 2024 à 19h59 CET, juste avant le début du spectacle en direct. Les votants pourront regarder toutes les vidéos des chansons participantes via la chaîne YouTube.

La phase deux du vote s'ouvrira après que le dernier artiste ait performé pendant le spectacle en direct. Le vote sera ouvert pendant environ 40 minutes. Au cours de la phase deux, les électeurs voteront sur la base des chansons interprétées pendant le spectacle en direct.

  1. Vous êtes invités à voter pour vos performances préférées via le service de vote. Vous pouvez enregistrer votre vote en cliquant électroniquement sur les chansons pour lesquelles vous souhaitez voter et leur attribuer un certain nombre de votes. Vous pouvez voter pour la chanson représentant votre propre pays. Vous ne pouvez voter qu'une seule fois par Phase et pour que votre vote soit pris en compte, vous devez répartir un total de 12 votes parmi votre ou vos performances préférées.

  1. Lorsque vous votez 1 fois pour un pays, celui-ci reçoit 1 vote. Cependant, cette année, la procédure d’attribution des points change légèrement afin de garder un résultat le plus équilibré possible. Ce nouveau système est le même qu’au concours “Junior Eurovision Song Contest” et permet un “poids” égal entre le vote du jury et le vote du public.
    Le vote du jury représente toujours 50% (    696 points) du résultat final et le public représente les 50% (696 points) restants. Chaque membre du jury attribue 12, 10, 8, 7, 6, 5, 4, 3, 2, 1 points, ce qui fait un total de 58 points par jury. Il y a 12 jurys donc au total, il y aura 696 points à attribuer par les membres du jury. Cela veut donc dire qu’il y a aussi 696 points disponibles à attribuer au public afin de garder un résultat 50-50. Pour cela, les pourcentages du télévote seront convertis en points où 100% correspond à 696 points.
    Seuls les points entiers sont pris en compte pour le calcul du résultat final. En raison des effets d'arrondi lors du calcul du produit du pourcentage et des points disponibles, le total des points attribués par le public mondial peut différer légèrement des points disponibles (de quelques points seulement).
    Le pays avec le plus de points sera déclaré vainqueur ! Les résultats du vote seront annoncés par les hôtes du Concours Eurovision Smoot Contest 2024 lors du spectacle en direct. Les hôtes présenteront la somme des points qu'un artiste a reçu des votes du public dans tous les pays du monde.

  1. Pour éviter toute ambiguïté, la participation au Vote n'est pas un concours et aucun prix ne sera décerné aux votants.

  1. Tout vote exprimé en dehors des phases de vote désignées (telles qu'annoncées par l'USR et telles qu'elles peuvent être modifiées de temps à autre) et/ou tout vote qui n'inclura pas le nombre requis de votes (12) ne sera pas pris en compte dans la détermination du résultat final du vote. L'éligibilité de tout vote est à la seule discrétion de l'USR.

  1. L'USR se réserve le droit d'annuler et/ou d'annuler des votes ou de suspendre le vote et/ou le service de vote si elle a des motifs raisonnables de soupçonner qu'un vote frauduleux a eu lieu ou que des votes ont été exprimés par le biais d'un abus, d'une faille ou de problèmes dans le Vote ou s'il considère qu'il y a eu une tentative de falsifier le Vote et/ou le Service de Vote.

L'USR se réserve le droit de modifier, d'annuler ou de suspendre le Vote et/ou le Service de vote à tout moment à sa propre discrétion et sans préavis. L'USR a le droit de substituer une méthode de sélection 2 alternative à son entière discrétion. En outre, si, pour une raison quelconque, le système de vote en ligne échoue, l'USR aura le droit de suspendre, d'annuler ou de réinitialiser les votes ou de mettre en œuvre un plan d'urgence à sa seule discrétion et à tout moment.

En cas de litige et constatation de votes multiples provenant d’une même personne, seul son premier vote sera pris en compte et les votes frauduleux seront annulés.

  1. Le système de vote en ligne pour le ESC 2024 est sûr et sécurisé. Aucune inscription n’est requise. Aucune donnée privée ne doit y être entrée.

  1. La décision de l'USR concernant toutes les questions relatives aux votes et/ou au Vote est définitive.

  1. L'USR ne peut accepter aucune responsabilité pour toute défaillance technique ou dysfonctionnement ou tout autre problème avec le service de vote, tout système en ligne, serveur, fournisseur ou autre qui pourrait entraîner la perte ou l'enregistrement ou l'enregistrement incorrect d'un vote. L'USR ne sera pas responsable envers les Électeurs de son incapacité à fournir le Vote pour quelque raison que ce soit. Le bon fonctionnement du site web peut être à tout moment consultable via ce lien.

  1. Les informations recueillies par l’USR après avoir voté sont les suivantes : la date et l’heure, le pays à partir duquel vous votez (adresse IP chiffrée) et les pays (chansons) pour lesquels vous avez voté. Ces données sont traitées et enregistrées par l'USR pour calculer les résultats finaux officiels du concours Eurovision Smoot Contest 2024 et effectuer des statistiques agrégées sur le vote. Ces données collectées par l'USR sont en conformité avec les lois de protection des données personnelles.

  1. Après avoir soumis votre vote, celui-ci est soumis à une vérification. Idéalement, votre navigateur devrait vous informer de la validation correcte et de l'enregistrement de votre vote, ou signaler une erreur dans le processus. Cependant, selon votre type de navigateur, il est possible que celui-ci se rafraîchisse sans afficher la confirmation de votre vote. Vous pouvez donc être certain que, malgré l'absence de confirmation visuelle, votre vote a bien été reçu et enregistré avec succès. Le rafraîchissement de la page sans confirmation visuelle ne constitue qu'un problème d'affichage n'impactant nullement l'enregistrement du vote.

  1. L'USR se réserve le droit de modifier l'une ou quelconque des présentes conditions générales et le processus de vote sans préavis à tout votant. En continuant à participer au Vote, chaque votant sera réputé avoir accepté les conditions générales modifiées et/ou modifiées, qui seront publiées sur ce site Web.

  1. Les présentes conditions générales entrent en vigueur le 1er Juillet 2024. Nous nous réservons le droit, à notre entière discrétion, de changer, modifier, ajouter ou supprimer des parties de ces conditions générales à tout moment.

2. EUROVISION SMOOT CONTEST 2024 – ONLINE VOTING TERMS AND CONDITIONS

The 2024 Eurovision Smoot Contest Online Voting, including its voting features, to which these Terms and Conditions apply, is coordinated by

the Smoothoise Broadcasting Union supervised by Aziourty and DjRedstone

(hereinafter « SBU »).

and is accessible via vote.smoot.fr.

Members of the public from all around the world may vote in the 2024 Eurovision Smoot Contest (hereinafter the « Voter » or « You ») by casting votes online via the relevant Platform (the « Voting Service »).

By accessing the polls and voting online in the 2024 Eurovision Smoot Contest, you hereby expressly agree to be bound by these Terms and Conditions and undertake not to interfere with the Voting and/or the rules set out hereunder.

  1. Window One of the Voting will start at 12:00 CET on Monday 29 July 2024. and close on Saturday 10 August 2024 at 19:59 CET, just before the live Show starts. Voters will be able to view the videos of the participating songs via the Youtube channel.

Window Two of the Voting will open after the last artist has performed during the live Show. Voting will be open for approximately 40 minutes. During the Window Two, Voters will vote on the basis of the songs as performed during the live Show.

  1. You are invited to vote for your favourite performances via the Voting Service. You can register your vote by electronically clicking on the songs you wish to vote for. You can vote for the song representing your own country. You can only vote once during each Window and in order for your vote to be taken into account, you have to vote for 3 songs.

  1. When you vote 1 time for a country, it receives 1 vote. However, this year, the procedure for awarding points is changing slightly in order to keep the result as balanced as possible. This new system is heavily inspired by the Junior Eurovision Song Contest.
    The jury's vote always represents 50% (    696 points) of the final result and the public represents the remaining 50% (696 points). Each member of the jury awards 12, 10, 8, 7, 6, 5, 4, 3, 2, 1 points, which makes a total of 58 points per jury. There are 12 juries so in total there will be 696 points to be awarded by the members of the jury. This therefore means that there are also 696 available points to be awarded to the public in order to keep a 50-50 result. For this, the percentages of the televote will be converted into points where 100% corresponds to 696 points.
    Only whole points are taken into account when calculating the final result. Due to rounding effects when calculating the product of percentage and available points, the total points awarded by the global audience may differ slightly from the available points (by just a few points).
    The country with the most points will be declared the winner! The voting results will be announced by the hosts of the Eurovision Smoot Contest 2024 during the live     show. The hosts will present the sum of points that an artist received from public votes in all countries around the world.

  1. For the avoidance of doubt, the participation in the Voting is not a competition and there shall be no prize awarded to the Voters.

  1. Any vote cast outside of the designated voting windows (as announced by USR and as may be amended from time to time) and/or any vote that does not include the required number of votes (12) will not be taken into account in determining the final result of the vote. The eligibility of any vote is at the sole discretion of USR.

  1. The SBU reserves the right to discard and/or cancel votes or suspend the Voting and/or the Voting Service if it has reasonable grounds to suspect that fraudulent voting has occurred or that votes have been cast through an abuse, loophole or bugs in the Voting or if it considers there has been any attempt to rig the Voting and/or the Voting Service.

The SBU reserves the right to change, cancel or suspend the Voting and/or the Voting Service at any time at its own discretion without prior notice. The SBU has the right to substitute an alternative selection method at its absolute discretion. In addition, if, for any reason, the online voting system fails, the SBU shall be entitled to suspend, withdraw, cancel or re-set the votes or to action a contingency plan at its sole discretion and at any time.

In the event of a dispute and identification of multiple votes originating from the same individual, only their initial vote will be considered.

  1. The online voting system for the ESC 2024 is safe and secure. No registration is required. No private data must be entered.

  1. The SBU’s decision in relation to all matters relating to the votes and/or the Voting is final.

  1. The SBU cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with the Voting Service, any on-line system, server, provider or otherwise which may result in any vote being lost or not properly registered or recorded. The SBU shall not be liable to Voters for its failure to provide the Voting for any reason whatsoever. The proper functioning of the website can be consulted at any time via this link.

  1. The information collected by the USR after voting includes: the date and time, the country from which you are voting (encrypted IP address), and the countries (songs) for which you have voted. These data are processed and recorded by the USR to calculate the official final results of the Eurovision Smoot Contest 2024 and to perform aggregated statistics on the vote. The data collected by the USR complies with personal data protection laws.

  1. After submitting your vote, it undergoes a verification process. Ideally, your browser should inform you of the correct validation and recording of your vote or indicate an error in the process. However, depending on your browser type, it's possible that it may refresh without displaying the confirmation of your vote. Therefore, you can be certain that, despite the absence of visual confirmation, your vote has been received and recorded successfully. The page refreshing without visual confirmation is only a display issue and does not affect the recording of the vote.

  1. The SBU reserves the right to amend or vary any of these Terms and Conditions and the Voting process without prior notice to any Voter. By continuing to participate in the Voting, each Voter will be deemed to have accepted the amended and/or varied terms and conditions, which will be posted on this website.

  1. In case of questions, concerns, or any other issues related to the Eurovision Smoot Contest online voting process, please contact our team at the following email address: eurovisionsmootcontest@gmail.com.

  1. These Terms and Conditions are governed by the organizers of the Eurovision Smoot Contest representing the SBU and are applicable to online voting in the 2024 Eurovision Smoot Contest.

  1. These Terms and Conditions are drafted in English and French. In the event of any inconsistencies between the two versions, the French version shall prevail.

  1. These Terms and Conditions are effective from 1 July 2024. We reserve the right, at our complete discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time.
