Travel Collection España SA Terms & Conditions

  1. Users Acknowledgment and Acceptance of Terms 

Upon payment of your deposit and receipt of booking confirmation, a contract will exist between you and Travel Collection España SA with the following terms and conditions. If any part of this contract is found to be invalid or unenforceable, the remainder of it will not be affected and will remain valid and enforceable.

When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions and agree on behalf of everyone traveling in your party to be bound by them.

Completion of payment, or acknowledgment via WeTravel when applicable, will be treated by us as confirmation that you have read, understood, and accepted these booking conditions.

  1. Description of services

Travel Collection España SA arranges various services as described on our website including, but not limited to, the organization and booking of travel arrangements to Spain. Fees for the various services are determined after your travel needs are assessed, and may change from time to time. Travel Collection España SA agrees to provide all services noted as included in your final proposal and paid for at the time of booking. Please note, the following services are not included in the services Travel Collection España SA provides or the rate you pay to Travel Collection España SA: Airfare (international and domestic), passport fees; baggage fees; items of a personal nature, such as valet/laundry, phone/fax communications; items not on the regular menus; expenses of hotels, meals, guides, buses, cars, railroad, boats, etc., for sightseeing not explicitly listed as included in the itinerary; trip insurance; after tour gratuities to guide and a vehicle driver.

  1. Responsibility Clause

You understand that Travel Collection España SA does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van, car or other transportation companies, local ground operators, providers or organizers of optional or included excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. As a result, Travel Collection España SA assumes no responsibility for and cannot be held liable for any personal injury, death, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned by reason of (1) any wrongful, negligent, willful, or unauthorized acts or omissions on the part of any of the tour suppliers, or other employees agents, (2) any defect in or failure of any vehicle, equipment, instrument owned, operated or otherwise by any of these suppliers, or (3) any wrongful, willful, or negligent act or omissions on any part of any other party not under the supervision or control of the Operator.

You agree that Travel Collection España SA is not responsible for any injury, financial or other loss or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, fire, inclement weather, health pandemics, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as horseback riding, zip lining, paddle boarding, surfing, swimming, kayaking, sailing, canoeing, whitewater rafting, hiking, bicycling, rappelling, canyoning/canyoneering, fishing, cruising, camping, helicopter tours, 4×4 Jeep/ATV tours, sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, pandemics, epidemics or the threat thereof, insolvency of or other defaults by suppliers of services, or for any other cause beyond the direct control of Travel Collection España SA. In addition, you agree to release Travel Collection España SA from its own negligence and assume all risk thereof. Travel Collection España SA reserves the right to change hotels or other features of the trip’s itinerary if Travel Collection España SA believes it will enhance the safety, comfort or enjoyment of the trip. The provisions in this Limitation of Liability clause, as well as those in the following Assumption of Risk clause, supersede any contrary information or wording in these Terms & Conditions.

  1. Assumption of Risk

You acknowledge that your participation in international travel and the activities included in your itinerary entail known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to yourself, to property, or to third parties. You understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activities you have chosen to include in your trip. Therefore, you accept and assume full responsibility for any and all risks of illness, injury, or death and of the negligence of Travel Collection España SA and agree to hold harmless and release Travel Collection España SA both from claims of third-party negligence and claims concerning Travel Collection España SA’s own negligence.

  1. Force Majeure

You understand that if Travel Collection España SA is prevented directly or indirectly from performing any of its obligations under this agreement due to acts of God, acts of government, fire, inclement weather, health pandemics, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or for any other cause outside of Travel Collection España SA’s reasonable control, they will be under no liability whatsoever to you and may, at Travel Collection España SA’s sole discretion, by written notice to you, either cancel the trip or take any other reasonable action to ensure everyone’s safety. Under such circumstances you may not be eligible for a refund of any amounts paid to Travel Collection España SA for the trip, and in no event will Travel Collection España SA be responsible for any other amount, including airfare, or any other losses or claimed damages.

  1. Travel Insurance

You certify that you have adequate travel and medical insurance to cover any injury or damage that you may cause or suffer while participating, or else you agree to bear the costs of such injury or damage. You further certify that you have no medical or physical conditions that would interfere with your safety on this trip, or otherwise personally bear the costs that may directly or indirectly be incurred by any such condition.

  1. Conduct on Site

You agree that Travel Collection España SA reserves the right to terminate without notice the trip of any client whose behavior is such that it is likely in Travel Collection España SA’s opinion to cause distress, damage, danger or annoyance to Travel Collection España SA’s customers, employees, agent’s property or a third party. Furthermore, you understand that if you are prevented from traveling because, in the opinion of a person in authority, you appear to be unfit to travel or cause distress or discomfort to other passengers, then Travel Collection España SA’s responsibility for my trip ceases. In such a case, you are not eligible for any refunds.

Additionally, you acknowledge that any accommodations arranged by Travel Collection España SA are solely for the use of the guests shown on the final confirmation provided by Travel Collection España SA. Subletting or changing of room assignments is prohibited.

You also acknowledge that Travel Collection España SA does not accept any responsibility for any excursions or tours which you may choose to book outside of the itinerary and program arranged by Travel Collection España SA. In such cases, your contract will be with the operators of such excursions directly and Travel Collection España SA is not responsible for the provision of the excursions or for anything that may happen during the course of their provision by other operators.

  1. Passport and Visa Requirements

You acknowledge that each traveler is personally responsible to ensure they fulfill all travel requirements including for a valid passport, visa, and immunizations. You absolve Travel Collection España SA of any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.

  1. Intellectual Property

For the purpose of these Terms and Conditions, "content" is defined as any information, communications, software, photos, video, graphics, music, sounds, and other material and services that can be viewed by users on our site. This includes, but is in no way limited to, message boards and other original content.

By accepting these Terms and Conditions, you acknowledge and agree that all content presented to you on this site is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws, and is our property. You are only permitted to use the content as expressly authorized by us or the specific content provider. Except for the electronic copy of your itinerary we share prior to arrival and the physical copy of your itinerary you’ll receive upon arrival, you may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any documents or information from this site in any form or by any means without prior written permission from us or the specific content provider, and you are solely responsible for obtaining permission before reusing any copyrighted material that is available on this site. Any unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws.

  1. Registration Data and Privacy

In order to access some of the services on this site or speak with us about making your travel arrangements, you will be required to fill out our booking registration form and/or send us information via email, which requests certain information and data ("Registration Data"). Maintaining and updating your Registration Data is required. By registering, you agree that all information provided in the Registration Data is true and accurate and that upon purchasing our services you will maintain and update this information as required in order to keep it current, complete, and accurate.

You also grant us the right to disclose, for purposes of arranging your trip, to third parties certain Registration Data about you. The information we obtain through your use of this site, including your Registration Data, is subject to our Privacy Policy, which is specifically incorporated by reference into these Terms and Conditions.

  1. Photo, Video, and other Media Release:

By taking part in the trip, you irrevocably grant Travel Collection España SA and their agents and representatives all rights to use, reproduce, display, exhibit, publish, distribute, and/or produce derivative works based on your image, likeness, and voice as recorded by any camera and/or on any video, audio, and/or other media (collectively, “Likeness”) worldwide, in perpetuity, without compensation, payment, or other additional consideration of any kind, for any lawful purpose, including without limitation for marketing and trade purposes. Additionally, you grant permission to Travel Collection España SA and other trip participants to share any videos and photographs that you post on public social media channels and use them for promotion and/or commercial purposes without recourse or compensation to you.

  1. Booking and Cancellation Terms

Trip Price. You will be advised of the total cost of your trip before the trip is confirmed. Your trip is confirmed when you pay your deposit, and the balance of the trip cost must be paid at least 60 days before the trip start date. If the balance is not paid in time, Travel Collection España SA shall cancel your travel arrangements and shall retain your deposit.

Trip Changes. If you wish to change your travel arrangements in any way after submitting your deposit payment, you understand that your total trip cost will be adjusted to reflect the updated itinerary and related costs. Travel Collection España SA will do its utmost to make these changes happen, but it may not always be possible.

Cancellation Policy.

The 30% deposit is non-refundable.

  1. Subcontracting and Provision of Services by Travel Collection Group Companies

The user acknowledges and accepts that, for the proper provision of some of the services offered on this website, Travel Collection España SA may subcontract or delegate the execution of such services to associated companies, subsidiaries or other entities that are part of the same corporate group. Consequently, certain services or parts thereof may be performed by these companies, which undertake to act under the same standards of quality, contractual conditions and regulatory compliance established by Travel Collection España SA.

You also agree that the payment gateway used to process payments through this website is owned by a Travel Collection group company, and that such payment gateway will be subject to the policies and conditions that such company establishes for the management of payments and transactions.

Travel Collection España SA guarantees that the group companies responsible for the provision of these services will comply with all applicable legal regulations, as well as with the contractual agreements necessary to ensure the correct execution and quality of the service provided, including the secure and confidential management of payments through the payment gateway.

Payment Options. Travel Collection España SA accepts payment via all major credit cards (MasterCard, Visa, American Express) as well as international wire transfers.
