Terms and Condition
§1. General provisions
- These terms and conditions govern the organization of the EIT Raw Materials Incubator (hereinafter referred to as the “Programme”). By entering a Programme, entrants (hereinafter “you”, “your” etc.) agree to be bound by these Terms.
- By entering the Programme, you hereby warrant that all information submitted by you is true, current and complete.
- The Programme is supported by the Startup Hub Poland Foundation with its office at Senatorska 2 St., 00-075 Warsaw, Poland, entered into the register of associations kept by the District Court for the capital city of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, under KRS number 0000433935, REGON 146312580, NIP 5213637149.
§2. Definitions
- Applicant – an entrant that submits the application to the Programme. The application can be submitted by all individuals and teams of natural persons citizens of the EIT RIS eligible countries (researchers, master and PhD students or research groups from universities and research organizations; professionals, entrepreneurs or idea owners with an idea/solution targeting Innovation Themes and wanting to start a company)
- Application Form – an application form available on the website https://startuphub.pl/eit-rawmaterials/ that enables Applicant to declare its willingness to be a part of the Programme by submitting it in the electronic form via the hereinabove website.
- Participant – means the Applicant that has been qualified to the Programme after being evaluated by Evaluation Committee.
- Project – innovative, competitive solution corresponding with Innovation Themes, being a subject of the evaluation in the Programme, of which intellectual proprietary rights belong fully to the Applicant.
§3. Qualifying Entrants
- To qualify to enter the Programme your Project should correspond with at least one of the Innovation Themes, that is:
- Circular Economy - New technologies or services that make it possible to substitute or use lower quantities of critical or toxic materials in key industries
- Recycling Substitution - Technologies and solutions for materials supply from secondary sources and recycling
- Processing - Technologies and solutions for mineral and metal processing and for improved materials production
- Mining - Technologies and solutions for more efficient, responsible and sustainable modern mining
- Exploration - Technologies and solutions for improved and new mineral exploration
- Submitting an application is entirely free of charge.
- The applications can be submitted either by a single idea holder or a team represented by a contact person.
- The number of entries per person is unlimited. Incomplete or indecipherable entries will be void.
- Entrants wishing to submit the full application must complete an online Application Form indicating their personal details, the form is available at https://startuphub.pl/eit-rawmaterials/
- The information provided to the Organizer through Application Form is the sole basis for assessment of the application submitted by the Project’s holder.
§4. Programme
- The Organizer will go through the Application Form and if the Project seems to be a good fit to one of the EIT RawMaterials programmes, the Organizer will recommend it directly to the EIT RawMaterials programme.
§5. Intellectual property
- By accepting these Terms and Conditions, the Applicant declares and warrants that their Project (or with their participation), both as a whole and as each of its elements, does not infringe the rights of third parties, including the right to image protection, personal and property copyrights, rights arising from inventions, utility models, industrial designs, trademarks, geographical indications and integrated circuit topography.
- By submitting an Application Form, submitter grants rights to the Organizer only for purposes related to the organization and promotion of the program, free of charge and unlimited in time license to use elements of the Project - the logo, designation of the website or other designation identifying the given Project or its creators.
§6. Responsibilities
- The Participant is solely responsible for any damages resulting from their culpable failure to comply with the legal provisions or the provisions of these Terms and Conditions, including damaged property entrusted for use during the program.
- Organizer has the right to exclude a Participant from the program if:
- The Participant does not comply with the provisions of these Terms and Conditions
- The Participant is under the influence of alcohol or intoxicants during any meetings or activities organized within the Program.
- The Participant's behavior otherwise violates good manners or principles of social coexistence.
- The Organizer's decision to exclude the Participant from the Program is final and is not subject to further verification.
§7 Personal image release
- Each Project’s holder declares that they agreed to have recorded-on photos and video materials in relation to the Program, which may be shared, distributed, displayed and processed or otherwise disseminated free of charge by Startup Hub Poland, as well as third parties involved in the Program.
- The declaration above applies to the usage by Startup Hub Poland, as well as third parties involved in the Program of the recorded-on photos and video materials for the commercial, marketing, promotional and other related activities, in particular the electronic and printed labeled materials (i.e. brochures, fliers, folders, reports, internal publicity), materials shared via internet and intranet websites, mass-media activities along with the other HR and corporate communication-related purposes of the materials shared via the electronic sites and in printed forms, at any time and in any place within the Poland’s borders and abroad.
- The above consent also includes the use of fragments of photographs, reducing their resolution and compression.
- Applicant will procure that each individual or a team member declares that the right to grant permits for the dissemination of their image is not limited by the third party rights.
