**You have the right to accept or refuse this contract **

Welcome ! We are looking forward to working with you. Please read this information carefully. The purpose of this Agreement is to set forth the details about working together so that we both are clear as to what each of our respective roles are and how our communication will take place so that our time will be positive, productive, and comfortable.

This agreement is made between you, the purchaser of an online Course [such as Should I Stay or Should I Go or Feminine Cyclical and Seasonal Flow Syncing] and Claudia-Sam Cataford Sauvé doing business as Claudia-Sam Soul Coaching.

By purchasing a Course, we both legally agree to the following:

1. Course Description.

Inclusions:

• Access to a membership site with a variety of modules, lessons, workbooks, audio files, quiz questions and text to be consumed at your own pace

2. Expectations.

You can expect that Claudia-Sam and her team will:

• Update any course content when necessary

If you wish to have one-on-one voice conversations with your Soul Connection Coach, Claudia-Sam, it is a possibility in her one-on-one coaching services. Ask about this option by reaching out to team@claudiasamsoulcoaching.com 

Claudia-Sam expects that you will:

• Be open to new ideas and willing to stretch and grow, and follow a “no excuses” policy. Take 100% responsibility for your success or failure to achieve your goals. The more you commit to you and show up for yourself, the faster you’ll see results.
• Keep all and any coaching material to yourself and do not share them with friends or others.
• Be respectful, kind, not bring any political or societal issues to the coaching container, nor show any signs of racism or hate

3 – Cancellations & Refunds

Our time together is important, and I value each and every one of my clients. By purchasing a Course, you commit to investing in yourself and making yourself a priority. Please keep in mind that refunds are not available.

4 - Investment and Payment.

1. Investment: You agree that you are financially willing and able to invest in the Course you purchased by choice, and that by doing so, you are not incurring any economic hardship upon yourself in any way.
2. Payment Authorization and Receipt: If paying by credit card, you give me permission to automatically charge your credit card as payment for your Course, without any additional authorization.
3. Missed Payment: If payment is not received or if there is a problem with the payment transaction or method, you will not have access to the Membership Site and Course.

5 - Confidentiality.

Confidentiality is important to us. We will keep all information exchanged between us confidential, unless: (1) someone has a legitimate reason to know such information as a member of my team or staff, (2) when required by law, or (3) you have given me prior written permission to use your personal testimonial.

6 - Intellectual Property Rights.

Claudia-Sam retains all ownership and intellectual property rights for all coaching content and materials provided to you through the Course(s), including all copyrights and any trademarks belonging to her. The content and materials are being provided to you for your individual use only and with a single-user license which means that you are not allowed or authorized to share, copy, sell, post, distribute, reproduce, duplicate, trade, resell, exploit, or otherwise disseminate any portion of the Course(s) like audio pocket soul coaching, videos, workbooks, visuals, resources shared, module content, electronically or otherwise,  without Claudia-Sam’s prior written permission.

7 - Personal Responsibility, Disclaimer & Release of Claims.

1. Personal Responsibility & Assumption of Risk: You acknowledge that you take full responsibility for yourself and all decisions made before, during and after joining the Course. You accept full responsibility for your choices, actions and results before, during and after taking the Course, and you knowingly assume all of the risks of the sessions related to your use, misuse, or non-use of what we do during the sessions or of any materials shared. You understand and agree that you are solely responsible for your results.

2. Disclaimer: Any materials shared in the Courses are being provided as self-help tools for your own use and for informational and educational purposes only. There are many factors that influence results, so no guarantees can be made as to the results you will experience through this package. You agree that Claudia-Sam, Claudia-Sam Soul Coaching and the team are not responsible for your physical, mental, emotional and spiritual health, for your financial earnings or losses, for relationship heartbreaks or wins, or for any other result or outcome that you may experience through these sessions. Nothing related to the Course you purchased is intended to be considered medical, mental health, legal, financial, or religious advice in any way. For specific questions related to a medical or mental health situation, consult your own medical or mental health professional. For specific questions related to your financial, legal or tax situation, consult your own attorney, accountant, and/or financial advisor. For specific questions related to religion, spirituality, or faith, consult your own clergy member or spiritual healer. Do not start or stop taking any medications because of anything you have read or received through the Course. Any recommendation of any products is simply offered for educational purposes, and you need to check with your own medical professional before using any of these products on, in or near your body in any way.

3. Technology Disclaimer: We try to ensure that the availability and delivery of our Website and its Content is uninterrupted and error-free. However, we cannot guarantee that your access will not be suspended or restricted from time to time, including to allow for repairs, maintenance or updates, although, of course, we will try to limit the frequency and duration of suspension or restriction. To the fullest extent permitted by law, we will not be liable to you for damages or refunds, or for any other recourse, should our Website or its Content become unavailable or access to them becomes slow or incomplete due to any reason, such a system back-up procedures, internet traffic volume, upgrades, overload of requests to the servers, general network failures or delays, or any other cause which may from time to time make our Website or its Content inaccessible to you. Especially when it comes to external websites, clouds and mobile apps not hosted by Claudia-Sam or Claudia-Sam Soul Coaching and for which technology Claudia-Sam has no decision-making control over such as Telegram, Facebook, Instagram, Zoom, Gmail, Google Drive, Yahoo, Outlook, What’s App, YouTube, and/or MemberVault.

4. Limitation of Liability, Indemnification, and Release of Claims: Claudia-Sam and Claudia-Sam Soul Coaching and the team will not be held responsible in any way for the information that you request or receive through the Course you purchased, including her services, products, and any coaching materials and any other information you have received from or through her related to these sessions. You agree that you fully and completely hold harmless, indemnify and release me from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, that you ever had, now have or may have against Claudia-Sam, her business or team in the future that may arise from your participation in said Course, including all services, products, and Coaching Materials, to the extent permitted by applicable law.

5. Submitting Questions and Being Coached: Claudia-Sam and her team will do their best to address your question, within 72h on weekdays of your share via email or within the membership site, when sent via email at cs@claudiasamsoulcoaching.com. Claudia-Sam cannot guarantee that your request will be personally tended to or that she will be able to answer all of your questions. In a Course, she will address the themes that come up. One-on-one Telegram support is only available for Claudia-Sam’s one-on-one clients. Please ask about one-on-one support if you would like to guarantee personalized ongoing support.

Other Important Terms.

Notice: All correspondence or notice required regarding the Course(s) shall be made to Claudia-Sam’s team by e-mail at team@claudiasamsoulcoaching.com and to you at the e-mail address you provided during your enrollment in the Course. Should your e-mail address, billing information, or contact information change at any time throughout the package, it is your responsibility to provide your updated information to me within 3 days of any change.

Entire Agreement, Assignment, Survivability and Waiver: This Agreement contains our entire agreement. This Agreement may be modified or amended at any time as long as the amendment is in writing and signed by both of us. You may not assign your rights or obligations under this Agreement to anyone else, and the obligations under this Agreement shall survive indefinitely unless otherwise stated in this Agreement. If Claudia-Sam chooses to waive or not enforce one or more terms of this Agreement, it does not in any way limit her right to later enforce every part of this Agreement.

Governing Law: This Agreement shall be construed according to the laws of the County of New Zealand.

Dispute Resolution: Should we ever have any differences; it is hoped that we could work them out amiably through e-mail correspondence. However, if we are unable to seek resolution in 14 days, you will have the option to resort to mediation or to seize the competent court in the judicial district of Nelson, New Zealand.

Non-Disparagement: You agree to not publicly or privately make any negative or critical comments about Claudia-Sam coaching programs, her business or her person, or to communicate with any other individual, company or entity in a way that disparages the program or harms her reputation in any way, including on social media.

By purchasing a Course, you agree to this Agreement and to its terms, and both you and Claudia-Sam acknowledge that you have read, understand, agree to and accept all of the terms in this Agreement. You agree that you have had the opportunity to ask any questions prior to signing.
