 Thank you for your email to David Leslie.

 The situation here is that the telecoms mast is permitted development under planning legislation and therefore not does not require planning permission. As such, no enforcement action can be taken. Even had the drawings accurately shown where it was to be placed, the mast would still have been permitted development.

 However, we have been approached by the telecoms operator who is keen to find a solution  and we are waiting to hear about further details in this regard. I can confirm that the sensitivity of the site is acknowledged.

I refer to application 18/01275/PNT where the decision was "Permitted Development". While I note that the applicant claimed that there were no suitable alternative location available because "no LPA mast register was available", nor "an ndustry site database" and had flagged the application as "green" - claims which could perhaps been queried during processing - it has now come to light that the above ground structure and equipment has been located contrary to the approved drawings (please see email below for details).

This serious error so close to such a sensitive site must not be resolved with a cheap compromise based on technical and cost arguments. I understand that the applicant - following our email below - is now in touch with your department to establish possible ways forward. I hope your department will be able to help the applicant find a solution, and will not shirk from enforcement action, if necessary.

I would be grateful, if you could confirm that (a) you have had recent contact with the applicant regarding this issue and (b) that any solution sanctioned by your department will take the sensitivity of the site (and its Conservation Area status) fully into account.
