PRIVACY POLICY – CANCER FOUNDATION

OVERVIEW

Cancer Foundation operates https://cancerfoundation.org.za/ (“the Website”) and is committed to protecting your privacy and complying with all applicable data protection and privacy laws. We take your privacy seriously and this Privacy Policy will inform you as to how we process your Personal Information and tell you about your privacy rights and how the law protects you (as data subject).

This Privacy Policy governs our policies and practices with respect to the personally identifiable information (“Personal Information” or “Data”) and other data that is collected, processed and/or received by Cancer Foundation from you (the “User(s)”) in connection with our services (the “Service(s)”) and the use of our website located at the domain name www.cancerfoundation.org.za. This includes any personal information processed when you send to us or receive from us other electronic communications (i.e. emails, SMS, electronic forms, Facebook, Instagram, Internet browser or LinkedIn).

Further this policy governs the rules regarding disclosure and sharing of personal data by Cancer Foundation.

By submitting Personal Information to us and agreeing to our Terms it will be seen as your consent to us to lawfully process your Personal Information in accordance with the Protection of Personal Information Act and any other applicable law.

We keep our Privacy Policy under regular review. Any changes made to our Privacy Policy in future will be made without further notice to you but will be posted on our website or made available during your engagement with Cancer Foundation. The new version will apply the moment it is published on our website or incorporated by reference in any communication.

COLLECT

We collect personal information and data about you when you interact with our website and when you input your details and information as part of using the Services we provide. The personal information will be collected and processed after you have filled in our online forms and submitted same on our website.

purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax,

accounting or reporting requirements. We may retain your Personal Information for a longer

period in the event of a complaint or if we reasonably believe there is a prospect of litigation in

respect of our relationship with you.

To determine the appropriate retention period for Personal Information, we consider the

amount, nature and sensitivity of the Personal Information, the potential risk of harm from

unauthorised use or disclosure of your Personal Information, the purposes for which we process

your Personal Information and whether we can achieve those purposes through other means,

and the applicable legal, regulatory, tax, accounting, or other requirements.

By law we have to keep basic information about our members (including Contact, Identity and

Transaction Data) for seven years after they cease being members.

In some circumstances you can ask us to delete your data: see your legal rights below for further

information.

In some circumstances we will anonymise your Personal Information (so that it can no longer be

associated with you) for research or statistical purposes, in which case we may use this

information indefinitely without further notice to you.

SHARE

We consider your personal information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Information with certain third parties. This will typically occur when sharing your personal information is necessary to fulfil the Services which you are requesting from us.  

If a service provider or partner needs to access information about you to perform services on our behalf, they do so under close instruction from us, including policies and procedures designed to protect your information.

Cancer Foundation only shares Personal Information with other companies or individuals outside of Cancer Foundation in the following circumstances:

  1. satisfy any applicable law, regulation, legal process, or enforceable governmental request;
  2. enforce applicable Terms of Use, including investigation of potential violations thereof;
  3. detect, prevent, or otherwise address fraud, security, or technical issues; or
  4. protect against imminent harm to the rights, property, or safety of Cancer Foundation, users of this website or the public as required or permitted by law.

The Partner or Service Provider with which we share your personal information and data with will be expressly specified on each form you submit containing your personal information, and displayed again when on the thank-you page after submitting the form. Some of the third parties we may share your personal information with include inter alia the following:-

Cancer Foundation may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of winding up. Alternatively, we may seek to acquire other businesses or merge with them. If

a change happens to our business, then the new owners may use your Personal Information

accordance with the law. We do not allow our Third-Party service providers to use your Personal

for specified purposes and in accordance with our instructions.

In the event that there has been a breach regarding the privacy of your personal information, Cancer Foundation will notify you immediately if it becomes aware of or has reasonable grounds to believe that the Personal Data provided by you has been accessed or acquired by an unauthorised person and take all appropriate steps to limit the compromise of Personal Data and to restore the integrity of the affected information systems as quickly as possible. As soon as reasonably possible thereafter, Cancer Foundation shall assist you to report all relevant facts relating to the compromise.

YOUR LEGAL RIGHTS

Under certain circumstances, you have the following rights under data protection laws in relation

to your Personal Information:-

  1. Request access to Personal Information (commonly known as a "data subject access request"). This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.

  1. Request Correction of the Personal Information that we hold about you. This enables you to

have any incomplete or inaccurate data we hold about you corrected, though we may need

to verify the accuracy of the new data you provide to us.

  1. Request erasure of your Personal Information: This enables you to ask us to delete or remove Personal Information where there is no good reason for us continuing to process it, or you otherwise have a legitimate objection to the continued processing of your personal information. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

  1. Object to processing of your Personal Information where we are relying on a legitimate

interest (or those of a third-party) and there is something about your particular situation

which makes you want to object to processing on this ground, as you feel it impacts on your

fundamental rights and freedoms. You also have the right to object where we are processing

your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
