Release and Waiver for Liability and Indemnity Agreement

The undersigned (“Member”) acknowledges that the Holyoke Canoe Club (“Club”) has agreed to allow the Member to store the Member’s property during the dates supplied below for the fee designated below. In agreeing to store the Member’s property on Club property in an area assigned by the Club, the Member, for themself and any personal representative, heirs, and next of kin, hereby acknowledges, agrees, and represents the following:

RELEASE   I agree to release, waive, discharge, and covenant not to sue the Club, its directors, officers, employees, and agents from all liability to me, my personal representative, heirs, and next of kin for any loss, theft, damage, claim, or demands therefore on account of injury to my property, whether caused by the weather, negligence of the Club, or otherwise during the dates provided below.

INDEMNIFICATION   I agree to indemnify and save and hold harmless the Club from any loss, liability, theft, damage or cost that may incur due to my storing my property, upon or about the Club’s premises, whether caused by the weather, negligence of the Club, or otherwise.

ACCEPTANCE OF RISK   I understand that the Club never intended nor designed the assigned area to be used as a storage facility and I acknowledge that the Club does not guarantee the security of the property  being stored. In addition, I realize that the Club property is not locked, secured, or guarded. Therefore, I agree to assume full responsibility for and risk of property damage due to the weather, negligence of the Club, or otherwise while my vehicle(s) is stored on Club property.

POLICY   I acknowledge that the agreement to park in the designated parking area is valid only during the period supplied below and is only applicable for the vehicle(s) listed below. The Club must receive payment prior to property storage. The Club reserves the right to have the vehicle(s) towed at the Member’s expense if it is not removed from the Club by the end-date on this PROPERTY STORAGE agreement.      

CONTACT PERSON   I agree to supply a contact person and a phone number in my absence so that, in the event of an emergency, the contact person will be responsible for my property. The Member further expressly agrees that the foregoing RELEASE, WAIVER, AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as Massachusetts law allows and that, if any portion is held invalid, it is agreed that the balance shall continue in full legal force and effect.
