  • Ofcom has taken on the regulation of video on demand services including channels such as: All4, Sky’s Now TV and Netflix’s streaming services, which will increase the resources available to cover their issues.

The rules VOD service programmes have to follow:

  • Protection of under 18s with no “prohibited material” that would be rejected by the BBFC
  • They cannot incite hatred
  • They must comply with commercial reference regulations in their programmes
  • There is also rules on what adverts can be shown on the subscription services

  • Netflix’s operators have guaranteed that over 20% of their indicative content will be European to create a “new wave” of on-demand service providers. They have also ensured that this new original content will not be hidden and will be very prominent on their site.
  • “Overall, strengthening the promotion of European works for on-demand services will lead to a broader and more diverse offer for Europeans,”

  • After launching Netflix into 130 new countries the EU declared that 20% of the on-demand service must be made up of European content to support local entertainment. This disrupted Netflix’s sales revenue as they rely so heavily on the success of American films and TV dramas and henceforth made a more level playing field for other VOD services.
