Acknowledgements:

We acknowledge the following to ensure that coming into this room we are all informed of what guides our practice in this space and we encourage that these acknowledgements are carried out with our comments, affirmations and considerations in this space. We also encourage that the acknowledgments and practice we carry out here you will take with you in all the spaces and places you are in.

  1. Land acknowledgement:  We acknowledge the land that we seek to remediate is on the sovereign land of the Unkechaug Nation. We acknowledge that the land that we occupy in the way that we occupy is based on a system of genocide. That colonialism is violent and it continues today. We must not only acknowledge the violence we must stand together to struggle against it with the guidance from the Indigenous people and demand Brookhaven Town consult with the Unkechaug Nation on the way forward to remediate the landfill.  We acknowledge #landback initiatives!  native-land.ca. please acknowledge the ancestral land you are currently on.
  2. Black Lives Matter & Honoring George Floyd acknowledgement  The Brookhaven Landfill Action and Remediation Group was formed in support of and a part of a direct action plan to protect Black lives of the people in North Bellport after the murder of George Floyd. George Floyd was not a martyr for our cause. George Floyd deserved to live. We honor his life through this work.  His death reminds us that if we do not fight to protect black lives, black lives will continue to be disregarded and prematurely ended through state sanctioned violence.  We acknowledge that Black Lives Matter!
  3. North Bellport acknowledgement: We acknowledge that the community of North Bellport is one of the fenceline communities to the Brookhaven landfill. North Bellport is a diverse community with a large Black, Indigenous and Latinx presence. The North Bellport community shoulders disproportionate harm as opposed to other neighboring communities. Therefore, this group must center the needs of North Bellport community members in this struggle to close down, clean up and stop the transfer of waste to another community.
  4. Environmental Justice: 17 Principles of Environmental Justice established October 24-27, 1991.  We acknowledge these 17 principles as a way to guide our work. Environmental justice = BLM
  5. Environmental Racism:  The father of the term environmental justice, Dr. Robert Bullard, referred to the Brookhaven Landfill as “a textbook case of environmental racism.” We also have referred to the Brookhaven landfill as a “monument to racism on Long Island” ~ Abena Asare. Hannah Thomas refers to the issues of the landfill as a “design of White supremacy.”
  6. Pronouns acknowledgment:  why pronouns? “…we ask cisgender people to lead the change by sharing pronouns. It normalizes the process, has little risk, and actually makes for a safer environment for everyone.”
  7. Rest: Last week of each month

Moe: Gov. Hochul continues to be terrible for indigenous folks.

Ryan: The Montaukett Nation wasn’t very disheartened with the Gov. Hochul’s veto. In fact immediately after Hochul vetoed it, she scheduled a meeting with the nation. The nation is actually looking forward to the increased energy around government to government relations that has emerged. Similarly with unmarked burials bills, the folks from Shinnecock etc. are working effectively on next steps.

Moe: I’m looking for the cumulative impacts bill being useful in the ongoing efforts.

John: Is there more details on the unmarked grave bills?

Ryan: Actually the bill was vetoed. My understanding was that Hochul, with her ties to real estate developers, they tried to insert a clause that if remains were found, the property owner after a particular short time, would have the power to do what they want with the remains. Chief Harry Wallace could not accept such a clause.

John: Is there a possibility of transferring the remains?

Moe: NY State is one of the few states that doesn’t have a law like this protecting unmarked burials. Black and Indigenous people have been oppressed, and people’s remains have been treated disrespectfully and so the effort is to try to address this larger history.

Mike Ewall: The  language in the cumulative impacts law might be helpful in getting DEC to deny renewal permits... see last part about "no permit may be approved or renewed...."

https://www.nysenate.gov/legislation/bills/2021/S8830

Section 7 of the bill adds a new section 70-0118 to the environmental conservation law adding definitions for "disadvantaged communities" and "existing burden report;" requiring the department of environmental conservation to prepare or cause to be prepared an existing burden report for major projects that may cause or contribute to, either directly or indirectly, a disproportionate or inequitable or both disproportionate and inequitable pollution burden on a disadvantaged community; and providing that no permit may be approved or renewed by the department if it may cause or contribute to, either directly or indirectly, a disproportionate or inequitable or both disproportionate and inequitable pollution burden on a disadvantaged community.

Bellport and Brookhaven Hamlet have a long history of environmental activism, beginning with the Brookhaven Village Association founded in 1906, and the Bellport Village Improvement Society of the 1900. With Birdsall Otis Edey’s work on keeping the highway north of South Country Road, thereby saving the character of Bellport Village, her forward thinking has made a difference in the quality of life in Bellport.

Maurice Wertheim took his love of fishing and his hunting lodge called “Stealaway” located in Southaven, to amass land along the scenic Carmans River. He donated it to the US Government as a gift to the American people in 1947, now The Wertheim National Refuge.

Naturalist Dennis Puleston’s illustrations of the fish and fowl of the south shore and his passion for the endangered ospreys due to the DDT crisis were instrumental in the founding of the Environmental Defense Fund in 1967. Art Cooley, another founding member of EDF, gathered local support and founded Students for Environmental Quality at Bellport High School in the 1970’s. Many SEQ students went on to careers in the environmental and sciences and the law.

The Post-Morrow Foundation, dedicated to keeping the rural countryside safe from suburban encroachment, has preserved the woodlands, meadows, and marshland in our area, enjoyed by all its residents. Elisabeth Post-Morrow and Thomas Morrow left their legacy in the capable hands of President Bruce Wallace and Vice President Tom Williams who continue this mission.

In 2015, Katia Read and Thomas Schultz founded Friends of Bellport Bay

to save the oyster population and the water quality of the bays.

CEED, Center for Environmental Education and Discovery, on South Country Road in Brookhaven Hamlet is dedicated to connecting with nature and nurturing families with their focus on conservation and community.

The farmland preservation movement has saved land from suburban development and graced us with three working farms, due to the efforts of Sean Pilger and the team of HOG farm, Isabella Rossellini and Elettra Wiedemann and Patty Gentry of Mama Farm/Early Girl Farm, and Deer Run Farms, operated by five generations of the Nolan family farm since 1898.

These are the people, who for over a hundred years, have had the vision and have worked hard to save the environment, protect our waterfront, and preserve the rural quality of life that we enjoy today in the Bellport-Brookhaven-East Patchogue area.

BLARG WEEKLY MEETING NOTES 2023 Bob is taking notes-February 16, 2023

Monique gave a presentation on Black History and the origin of the environmental justice movement, very excellent. There are 17 principles first set forth in 1991.

Next was the latest Town Hall meeting yesterday. Many BLARG members gave statements.

A discussion took place on next steps. The suggestion was made to bring children at future Town meetings.

Another suggestion was that we distribute the recording of the Town Hall meeting to other groups.

Several journalists have become involved with the landfill issue.

Help Suffolk is an agency dealing with the shelter.

Bill Kokell recounted his experiences in service during the Korean conflict and the fact that there was much racism in the service at the time.

Further discussions took place on next steps.

Someone talked about the shelter. That person stated that Andrew Cuomo was involved when Help Suffolk was started.

Dennis-thanks to everyone for all the statements made at the Town Hall meeting yesterday.

Barbara-Thought all speakers were terrific yesterday. Barbara made the suggestion to pre-read one’s comments before the presentation and shorten it, if necessary.

Jennifer-public comment portion was extended yesterday.

Lisa- The notion of “circular economy” is good and could be used repeatedly.

Hannah-we need to have another protest in North Bellport. There is a need for more testing-the last testing was in 2017 at the Long School. Hannah has grandchildren that attend the Long school.

Christine-responding to Hannah’s questions.  The community is not getting information on their concerns.

Hannah said in earlier times the local churches would interact with the Town. This no longer happens.

NYS DEC Draft Solid Waste Management Plan

Bob: thinks we need to push the zero waste concept but also recognize it’s “utopian”.

Monique: we can push for the strongest EPR legislation we can get (not just rely on “personal responsibility”).

Mike E: Extended Producer Responsibility is a good theory, but doesn't work out well in practice, as industry ends up controlling the program, and they don't like reuse (which means they can't sell more stuff), and are happy to greenwash burning stuff, or downcycling, without prioritizing the Zero Waste Hierarchy and the highest and best use of materials. Vanessa: folks are invited to join our NYS Solid Waste Management Plan Brainstorm next Tues 5:30pm — here is the registration page: https://zoom.us/meeting/register/tJIpcOytqjgvHNVw0iFX1tNX0CIM5lK2tTDM

Comments on NYS Draft Solid Waste Management Plan from ZW Capital District: https://docs.google.com/document/d/1kIT1HHFqMWcNJ7tINMQNyvYd8X2XYbeleWY5vFA1-RE/edit?usp=drivesdk

Monique: kudos to Vanessa for giving a great speech in Albany.

John McN: Over several decades, people’s behavior *has* changed in that it’s now normal to put out more than just one can. So new habits are possible.

Mike E: Read 40 of 80 pages so far.  Found four main issues:

  1. The need to have zero waste as a goal and the Zero Waste Definition and Hierarchy as a framework.  Zero Waste is not utopian, it’s a goal. Doesn’t mean we’ll get to zero, it’s the idea that we’re not going to stop trying. 90% seems to be a practical goal.
  2. In the plan, there’s a clear preference for incineration over landfill, it should be the other way around.
  3. The plan pushes for more dumping of toxic sewage sludge (“biosolids”) on farm fields, which Maine banned last year because of farms being permanently contaminated with PFAS.
  4. How does NY stop being the biggest exporter of waste?

Need a consensus agenda that can bring groups together instead of dividing the anti-landfill and anti-incinerator movements from each other in the state.  The
Seneca Lake Guardian letter was released with very problematic language they promised to change, which pits landfill and incinerator communities against each other by calling for no landfills to exist in NYS after 2030 (which means burning and exporting everything).  They also promised to include anti-incinerator language, which was removed.  LIPC signed onto it, and probably didn’t realize the promised changes didn’t happen.  The meeting on Tuesday to work on comments on the SWMP will be the basis for fleshing out the consensus agenda for communities fighting incinerators and landfills in NYS.

Abena: invited folks to say whether we want to use BLARG time or separate time to continue discussion of this draft plan.

Cumulative Impacts with Chris Sellers (20 min 6:20 pm)

Coburn’s definition of cumulative exposure as consider[ing] “multiple hazards, effects, pathways, and populations, including socioeconomic and race-related stressors”

NYS passed a Cumulative Impacts Law in 2022.

Flat (more or less) line graph of “cumulative” mentions in EPA database suggests resistance in govt agencies to employing this notion, despite rise of incidence of “cumulative” term in science research database.

“Determination of Social and Environmental Impacts in Your Community: Useful Investigative Tools” is the MPH students’ capstone presentation being given next Monday.

Abena gave this recap of BLARG’s experience of state DEC: a few years ago, when the permit for the landfill was up, we talked about trying to include EJ processes, and DEC reps said okay, yes, and then a few months later they said no, they won’t include even those basic EJ processes regarding the landfill.

Chris: My hope is that it’ll be harder for them to take that stance, given this new law.

Mike E: Anyone have a link to the text of the new law referenced here?

https://www.eenews.net/articles/n-y-enacts-landmark-gas-ban-carbon-trading-program/

I'd be interested to see how this might impact existing incinerators.  Are they all grandfathered?  How will they not be forced to close by 2040 if the state is to reach "100 percent carbon-free power grid in 2040?"  Of course, they'll probably fall apart of old age by then…

Monique: was hoping the language would be done by now, but haven’t heard anything recently.

Mike E: also wondered what about the landfills that are burning gas for electricity, how will the “carbon-free power grid by 2040” affect that?

Dear President Harris, Commissioner Seggos, and Director Keddell-Tuckey,

I am a member of Brookhaven Landfill Action and Remediaiton Group (BLARG) and I am writing to request a comment submission deadline extension on the proposed Disadvantaged Communities Investments and Benefits Reporting Guidance. As indicated in NY State's Final Scoping Plan, interagency coordination and consultation with affected communities to ensure the effective delivery of these resources to disadvantaged communities will be critical to their success.  BLARG is a grassroots group in the heart of Brookhaven Census tract identified as a disadvantaged community.  We do not see any interagency coordination or consultation with this process.  The webinar was insufficient as many of our members were not able to attend and ask their own questions.   While the current submission deadline is by close of business on March 15th, we at BLARG would like to request an extension until April 5th, 2024 formally.

“I am _____ calling from _____.  I am calling to express my concern about the letter sent to the Town of Brookhaven from the NYS Department of Conservation dated August 8, 2023.

This letter was sent to the Town of Brookhaven notifying the Town of Brookhaven of a mandate calling for “corrective measures” in the matter of the second plume that was discovered back in 2017.

In that letter it states:  “The corrective measures assessment must include a list of possible corrective measures including, but not limited to, landfill closure in accordance with 6 NYCRR Part 363-9 and landfill reclamation in accordance with 6 NYCRR Part 363-11, and an assessment of the effectiveness of each corrective measure.”

I believe this is the corrective measure that the town must take. I believe the closure and remediation must come with no less than a comprehensive zero waste management plan that achieves environmental justice and open inclusive public meetings through the closure, remediation and zero waste planning process. I believe that this must start immediately to ensure least harm through this process.”

  1. Khadija report back on the  GAIA membership meeting/conference in San Francisco the week of Feb 19th.

Thank you for allowing me to take this trip. It was a unique opportunity to meet GAIA and the member org. I learned so much information. I so excited to share. I have so many power points. It was an honor to be with them. We heard from an org that was successful in shutting down the incinerator in their area. I was introduced to a filmmaker who is interested in the closure of the landfill so hopefully they will  reach out to us. The main topic is zero waste. What I learned is to get to close landfill incinerators and other manufacturing facilities that are polluting communities. Stop the manufacturing all the things that are causing the pollution. I wish you all were there. I made a lot of connection and a lot of sharing. I keep getting emails for things that may pertain to us or not. There are too many warehouses popping up in our area.

  1. Many thank yous in the chat
  2. Will continue to follow up on the leads and opportunities that manifest over time

  1. Ed Romaine, Dan Panico, Gov. Hochul and others all white got together to celebrate a $4.5 million grant the town received to revitalize North Bellport.  In the words of Hannah Thomas this has all the markings of a “design of white supremacy’ in the making. The Greater Bellport Coalition got together to hear what the community would like to see.  Dennis attended the meeting and reported the SC leg Dominick Thorne will be putting together an advisory group.  Lets see who is on it…

Dennis:  attended the Greater Bellport Coalition meeting and wanted to know where the money is going for. I was hoping that we could get an adult center for the seniors. There was a gentleman who want to start a mentorship program. Our kids from the 6th grade are struggling. Co chair Regina for an adult center we will need more money. We don’t need a bagel shop

  1. Monique:  this could be a renewable energy hub and even an cooling center.
  2. Hildur:  I work for cornell coop regional clean energy hub. Funds are available. We can connect offline

Abena:  this is the same bill that has been offered in the last two or three years to allow the huge yaphank waste transfer station. Fighting the same fight year after year(3 years) How do we get this bill killed?

This was county land sold to Northpoint. Now owned by winters bros The conservation easement predates their ownership. They will “swap” the easement to move it around the waste transfer station. They say they will have more Greenspace from 60 acres in the middle to 66 acres around the waste transfer station.

Has anyone looked at the impact.

This is the same acreage that has been clear cut and almost a blight. This is part of a the game plan to make it look unattractive. Some people think this area is spoiled already.

Is there escorted through

Who has fought against this bill?  Yes BVA CCE and other south country groups

And what about the DeC?  This doesn’t concern Dec because they own the land. They bought the land knowing about the conservation easement. How can we work on NOT seeing this bill reintroduced.

Put together a one pager together and get it to Albany.
