By commissioning (Prices found here: https://shorturl.at/faesartistry) me (Fae) you agree to the ToS below. Please ask me if you are unclear about any of the terms stated below.

I, the artist, reserve the right to refuse any and all commissions.

ToS apply to NON-COMMERCIAL use and work.

Ordering Your Commission/Content

If you are interested in a commission, please contact me on any of my sites.

When you write me, please:

• Include preferred name and pronouns you would like to go by
• Provide commission references: Visual reference and/or brief description, and preferred color palette (when applicable).
• Write in a clear, precise, and kind manner.

Any ill behavior will not be tolerated and your commission will be canceled if it occurs.

I will hold a spot for commission for 24 hours, and if I do not hear from you or receive references I will give up your slot to the next interested commissioner.
Please have references that are clear and complete.
If you do not provide a preferred color palette (when applicable), I may decline your commission, feeling like I will not be able to successfully complete it.

Please remember that I reserve the right to decline any commission type for any reason. You are allowed to ask why I declined your commission, but I may choose not to provide a reason.

Communication
All communication regarding commissions are to be made through the preferred site you contact me on.

I will, if necessary, block commissioners that I feel are harassing me (i.e. rude and negative comments, abusive behavior, ect.). In this situation, I will also cancel the commission, and refund the commissioner minus whatever progress I have made on their commission.

Commission Content Guidelines

• No requests for content associated with or depicting hate speech (i.e. racism, sexism, etc.).
• Requests for content of OCs are allowed, but only OCs you have permission to get commissioned.
• Backgrounds will be simple colors, unless discussed prior to payment. Specific backgrounds will add to the commission price.
• Fanart content requests are not allowed.
• Gore content requests are allowed, but will be priced higher than SFW commissions and are not guaranteed to be accepted.
• NSFW content requests are allowed, but will be priced higher than SFW commissions and are not guaranteed to be accepted.
• NSFW content requests CAN NOT and WILL NOT include any underage characters.
• Fetish requests are allowed, will be priced higher than SFW commissions and are not guaranteed to be accepted.

Payments
Do not send the payment until I have agreed to take your commission.
I only accept USD, and only accept payments through Venmo.

If you commission a larger or more expensive piece, we may work out a payment plan with proper planning and agreement. Otherwise, all payments are to be paid in full, upfront.
I reserve the right to cancel a commission if the payment has not been made in a timely manner. I understand that you might have some trouble sending the payment over, so I will allow a cushion of 2 days, or 36 hours, once I have received the first contact from you. If you fail to contact or pay me within this time frame, I will cancel the commission.
Price ranges on my commissions will generally be consistent, but depending on the complexity and type of commission, the final price can vary.

Cancellations & Refunds
After payment has been received, the commissioner is not allowed to cancel the commission. However, I have the right to cancel and refund the money for your commission at any time.

If the commission is canceled prior to any work on the commission, the payment will be refunded in full. If work has been done prior to cancellation, the works-worth of payment shall be deducted from the refund.

Creation Process (Revisions, Deadlines, WIPs, Etc.)

If errors are made because of a poor reference or incomplete description, I am not required to correct it.

Mistakes or incorrect details made on my behalf will be corrected with no charge. However, if there is something about the commission you wish for me to change, you may request it but I will charge you per revision. I also have the right to decline this request.

You cannot revise anything once I’ve begun coloring the commission.

If you wish to set up a deadline, it has to be communicated and agreed upon prior to payment. Deadlines affect the price and can be refused if I believe that the deadline is unreasonable, or I cannot meet it.
If the deadline is not met, I will provide a full refund - excluding transaction fees - for the commission.

Completion of a commission can take up to 3 months, depending on factors such as; Health, order of commissions, complexity, work, school or family issues.
If any of the things stated above occurs you will be notified ASAP.

With exceptions of sketches, each commission type will receive a sketch stage for approval and right to revision.

I am not obligated to provide further WIPs, and reserve the right to refuse. Further WIPs will only be given if the commissioner personally asks for them and if the price exceeds 40$.

WIPs might be given as well if I wonder about the commission.

Image Rights/Copyright/Usage Policies

All my commissions will have my signature on them, no exceptions.

Unless it is agreed before the initiation of the commission, all rights to the artwork belong to me. I have the right to post it where I please, unless the commissioner explicitly requests it (a private commission). If it is a private commission, please make me aware that that is what you want. Private commissions are not permitted to be posted on public websites under any circumstances, and will be charged differently.

Otherwise, I, the artist, reserve the right to:

• Use the final commission and process work in my portfolio, on social media sites, on websites, in galleries, etc.
• Repost and use art in digital or physical forms wherever I please.
  I, the artist, hold every right to the produced drawing, not the commissioner.

The commissioner can not use the commissioned image for any merchandise, reproduction, or organizations. They can not change or edit the image in any way or take credit for it.

The commissioner is allowed:

• Personal use of the artwork.
• To print the art, and claim the right of their character(s), but not the drawing itself.
• Use the art to promote themselves, with proper credit given to the artist.

If you break the copyright infringement in any way, every right you had to the drawing will be retracted.

The following is considered Copyright infringement:

• Reproducing/using the copyrighted artwork to make money.
• Taking Credit for the creation of the artwork.
• Removing any watermarks/signatures.
• Altering the artwork without my, the artist's, consent.

Every client has the possibility to buy full rights to commissioned artwork. Purchasing of Commercial rights to the artwork will always be 200% of original price.

Commercial Rights allow you to:

• Make any sort of merch with the artwork
• Use the artwork in books, covers, or as props
• Change the artwork to your liking and promote your own brand with it.

Credit is still required for usage of the artwork, even if altered or edited.
