Overview

On Monday November 29th, the new Department of Homeland Security (DHS) policy for how ICE will conduct immigration enforcement in our communities goes into effect. These guidelines for prosecutorial discretion (PD) in what’s known as the PD memo, are critical to reducing deportations, ending family separation, and keeping our communities safe.

These new guidelines reflect the hard-won efforts of organizers and advocates to shift towards more protections of the last 10 years, as categorical criminal convictions are no longer a strict basis for deportation. This means that there is room for organizers and community members to stay in the fight and submit deportation cases for review that in the past were not eligible.  

Ahead of the new policy going into effect, we want all impacted people to know about the opportunities to submit their cases. We also want to create space for organizers and advocates to submit member cases for review and obtain support in the public campaigns. Use the sample graphics and captions in the following toolkit to take action with us on our demands of the new DHS guidelines and amplify specific local cases in need of support.

DEMANDS: DHS and ICE must honor the adopted guidelines for prosecutorial discretion, end cruelties and harms to immigrant communities, engage with advocates and immigrant communities on next steps.

 About Enrique:

Enrique Meneses is a 38 year old man who was incarcerated for 17 years, and is currently in ICE custody despite his sentence being commuted by California State Governor, Gavin Newsom. Though serving his time, and deemed rehabilitated by state officials, Enrique was immediately detained by ICE upon his release in November 2020. During his incarceration, Enrique served as a counselor for other incarcerated people to help lead them towards rehabilitation as well. While in detention, he has been a leading advocate for worker rights & healthcare access and has faced increased retaliation by ICE and Geo Group staff as a result. He has been purposefully deprived of his anxiety medication as well as access to mental health services. Currently, ICE is threatening to transfer him further away from his legal counsel and his community.

Enrique has been a leader both at the correctional facility and at the detention center, and continues to advocate for himself and for the other detainees. His community is demanding that Enrique be granted prosecutorial discretion, released from detention, and allowed to remain in the U.S. with loved ones.  About Israel:

Israel Arrascue is a 43 year old Peruvian man who has been detained since October 2019 and is currently at the Northwest Detention Center in Tacoma Washington. Israel’s physical and mental health have deteriorated significantly since being detained by ICE, and it is urgent that he be released so that he can seek treatment for his conditions. Along with his asthma condition, which has been worsened due to anxiety and depression, Israel has been diagnosed with pre-diabetes and hypertension, both conditions that he did not have before being in detention.  

Israel has an eighteen year old daughter who relies on him for financial and emotional support. His prolonged separation from his community has caused both his daughter and her mother to suffer greatly, and they are calling on ICE to grant him prosecutorial discretion and release him from detention today.

When @LaResistenciaNW submitted Israel’s case for prosecutorial discretion, qualifying under the new DHS process, ICE denied his request without even reading his file. We demand ICE revisit his case and release Israel from custody!

 About Patrick:

Patrick is a 37 year old man who was incarcerated for twelve years and has been in ICE detention for two years. Patrick has spent a total of fourteen years away from his family. He is a father, a husband, and a community member who has demonstrated that he has fully rehabilitated. Patrick is the only father figure in the lives of his three stepchildren and they are suffering emotionally at not having Patrick home. In detention, Patrick has done his best to be there for his stepchildren by calling and writing letters, even helping them with their homework through the phone. No child should live with constant fear of losing their parents, and yet his children live this fear daily. They are hurting and struggling in different ways at the thought that Patrick may be sent to Haiti where he would be in danger. Having Patrick home would also help his wife, Laura, not work long hours so that they could all spend more time as a family. She is about to close on a house and needs all the support she can get to provide the best life for her children. Patrick is a hard worker and once out, he would be able to help Laura provide for their children. While incarcerated, Patrick received several professional certifications, and was also a counselor’s assistant, advising other people incarcerated against drinking and using drugs. He even has a job offer lined up upon release.

Deporting Alex to a country from which he was granted refugee status in 2001 for witnessing traumatizing events while living through Sierra Leone’s civil war. It would be inhumane and incomprehensible to deport him. Alex suffers from depression and PTSD as a direct result of the torture he experienced in Sierra Leone and he has fully made the United States his home for safety. Alex needs and deserves support and care to deal with his past actions- Alex worked hard to rehabilitate himself in prison.
