“Aging Out” of Special Education
California Education Code Section 56026
Month Student Turns 22 Years Old | Status/End /Date of Service |
January – June | June 30th Eligible through the end of current fiscal year (including Extended School Year within the fiscal year) |
July, August, or September | June 30th Eligible through the end of current fiscal year (including Extended School Year within the fiscal year) |
October, November, or December | Eligibility ends December 31st of the current school year |
Examples:
Student’s program ends at the end of the school year including any ESY within the fiscal year (June 30th)
Student’s program concludes at the end of the school year including any ESY within the fiscal year (June 30th). Student does not begin new school year or any ESY after June 30th despite being 21 years old
Student’s program ends December 31 of that current school year
Note: IEP’s need to be written to reflect the dates above, including the date on which services will end.
