Response:

Six officials have been suspended with full pay.

The Public Service Disciplinary Code sets out the considerations for suspension with full pay.  A suspension is a precautionary measure that does not constitute a judgement, and must be on full pay. Disciplinary hearings are underway.

The Chairperson of the hearing makes the final recommendation where-after appropriate action is taken. In cases where evidence indicates the commission of criminal offences, matters are reported to the SAPS. The salary of the six officials amounts to R2,830,814.08 per annum.

Whilst there is currently no employee suspended with full pay, two employees were suspended for part of the period in question whilst serious and complex allegations against them were investigated.

(b) One employee had been on suspension for more than six months, from 21 June 2013 to March 2015. The employee appealed against the charges and on reviewing the case, it was realised that the employee ought not to have been suspended.  The matter was settled resolved. The suspension has since been lifted and the official concerned has returned to work.

 

(2)        (a) The employee is a Deputy Director-General

               (b)  The employee was suspended with full pay.

               (c)  The amount paid to the employee during the period of suspension was R2 167 675.30.

951.      Ms E R Wilson (DA) to ask the Minister of Social Development:

(1)        With reference to the 274 labour relations cases that were reported between 1 April and 30 September 2014 and the 107 cases that were carried over from the first quarter, how many SA Social Security Agency (SASSA) staff members (a) were suspended for alleged (i) fraud and (ii) corruption, (b) appeared before disciplinary committees or (c) have been taken to court;

(2)        (a) how many SASSA staff members were suspended but have returned to work without facing disciplinary procedures and (b) why;

(3)        (a) how many labour disputes were lodged against SASSA for suspensions which did not result in a disciplinary enquiry, (b) what was the resultant cost in respect of each province and (c) what is SASSA doing to ensure that fruitless and wasteful expenditure does not result from similar situations in the future? Reply:

(1)        (a) Since 2012, 265 staff members were suspended for alleged (i) fraud and (ii) corruption.

            (b) 169 staff members appeared before disciplinary committees.

            (c) 35 officials were taken to court.

(2)        (a)  80 Staff members were suspended. Their suspensions had to be uplifted because of the 60 day stipulation that had been exceeded. It was challenged by labour due to the complex nature of the forensic investigations.

            (b) Once the final report is received, both criminal and disciplinary process will be re-instituted.

(3)        (a) Two (2) labour disputes were lodged in the Eastern and Western Cape respectively.  

            (b) The cases are still progress and a cost award has not been issued yet.

            (c) The SASSA Disciplinary and Procedure (approved by the CEO in February 2013) Paragraph 6.3.2 (b) on Precautionary suspension states as follows:

“If an employee is placed on a precautionary suspension, the employer must within 60 days hold a disciplinary hearing with due consideration of the complexity of the matter and the length of the investigation. Should a need arise, the chairperson of the hearing may decide on any further postponement.”

This policy will be applied in future similar cases.

In two other cases, Tembisa and Upington, where disputes were lodged by officials against the sanctions of dismissal in fraud related misconduct, the CCMA awarded in favour of SASSA.

REPLY:

No members of the State Security Agency (SSA) have been placed on suspension since 1 January 2014. There is however six members who were placed on suspension prior to the date above and whose disciplinary processes have commenced.

Reply:

Department of Science and Technology had suspension with full salary as follows:

  1. Six officials were put on precautionary suspension from 25 November 2014. The suspension of two officials was uplifted on 16 February 2015 and four remained on suspension. The disciplinary process resumed on 13 March 2015.

 

  1. The total cost of salaries for the six officials per month for the period November 2014 to February 2015 was R 656 353.64. The total cost of salaries per month for the period of March is R79 077.50.

                A total of one (1) precautionary suspension case was recorded in the Department of Cooperative Governance (DCoG) from 1 January 2014 to date. The information is as follows:

 

  1. One (1) official has been suspended with full pay in the Department of Cooperative Governance from 02 February 2015 to date, after serious allegations of fraud in relation to travel claims submitted from 2014, were reported.

 

  1. The total cost of the suspension from 02 February 2015 to date is: R41 258.60. The employee was dismissed on 05 March 2015.

DTA

                A total of one (1) precautionary suspension case was recorded in the Department of Traditional Affairs (DTA) from 1 January 2014 to date. The information is as follows:

 

  1. One (1) official has been suspended with full pay in the Department of Traditional Affairs from 18 November 2014 to date, after serious allegations of dishonesty and failure to disclose all registrable interests, were reported.
  1. The total cost of suspension from 18 November 2014 to date is: R280 195.96

The disciplinary hearing has begun, whilst the employee is on suspension.
