This Equipment Rental Agreement (“Agreement”) is made and entered into as of ___________,20____, by and between _________________________ (“Renter”), and FNKY-LYTZ LLC (“Owner”).

1. EQUIPMENT:

Owner agrees to rent to Renter, And Renter agrees to rent from Owner, The following equipment, Which is identified by its unique serial numbers.

2. TERM: 

The rental term shall commence on ______________,20_____ [Start Date] and terminate on ______________,20_____ [End Date], unless extended by mutual agreement of the parties in writing.

3. RENTAL PAYMENTS:

Renter shall pay Owner rental fees in the amount of $________________, Payable in advance, For the Rental Term. In the event of any late payment, Renter shall be responsible for all costs of collection, Including reasonable attorney’s fees.

4. USE OF EQUIPMENT:

Renter agrees to use the Equipment in a careful and proper manner and to comply with all applicable laws, Rules, And regulations regarding the use of the Equipment. Some items may have a tracking device for loss prevention. Renter shall not permit the Equipment to be used by any unauthorized person or for any unlawful purpose.

5. LATE AND CLEANING FEE:

Late fee on this will have to be a full day rental if there is no other booking on late day. If there is a booking that day then the fee will be double due to me having to rent and provide for that venue.

Cleaning fee will be billed at $40 per hour to cover labor and cleaning products.

6. LOSS OR DAMAGE TO EQUIPMENT: 

Renter shall be responsible for any loss of or damage to the Equipment during the Rental Term, Whether caused by Renter or any other person. Renter shall immediately notify Owner in the event of any loss of or damage to the Equipment and shall pay Owner the reasonable costs of repair or replacement.

7. INSURANCE:

Renter shall maintain comprehensive general liability insurance covering all activities conducted by Renter and all persons using the Equipment during the Rental Term, With limits of liability not less than $_________________ per occurrence. Renter shall provide Owner with evidence of such insurance prior to the commencement of the Rental Term.

8. INDEMNIFICATION:

Renter shall indemnify and hold harmless Owner, Its officers, Directors, Employees, Agents, Sub-contractors and affiliates, From and against any and all claims, Damages, Losses, And expenses arising out of or in connection with Renter’s use of the Equipment, Including but not limited to any claims arising out of personal injury, Property damage, Or breach of any applicable law.

9. OWNERSHIP:

The Equipment shall at all times remain the property of Owner, and Renter shall have no right, Title, Or interest in or to the Equipment except as expressly set forth herein.

10. DEFAULT:

If Renter breaches any provision of this Agreement, Owner may terminate this Agreement and retake possession of the Equipment without notice or demand, And Renter shall be liable for any damages resulting from such breach. Equipment must stay at listed venue  

11. GOVERNING LAW:

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, Without giving effect to any choice or conflict of law provision or rule.

12. ENTIRE AGREEMENT:

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or representations, Whether oral or written, Relating to the subject matter of this Agreement.

        13. CANCELLATION:

If the renter decides to cancel the.   entertainment services, They must provide notice by phone or email, Cancellations made less than 3 days before the event will result in a forfeiture of the deposit.

        14. INSUFFICIENT FUNDS/DISPUTES

Renter shall be liable for any and all costs, including collection fees resulting in an "insufficient funds" check, Invalid credit/debit disputes and reasonable attorney's fees and costs incurred in enforcing this contract.

        15. SAFE USE OF EQUIPMENT:

Renter is responsible for ensuring that the venue has adequate power supply, Space, Local and state permits and other requirements necessary for equipment. The client must also provide a safe working environment.

       16. SETUP AND TEARDOWN

Renter agrees to verify that setup and teardown can happen at given times. This a 24 hour rental from a set time to set time and your rental time includes the setup and teardown of equipment.
