Terms of Service

By taking a commission/YCH/adoptable/etc. or participating in auction or raffle you accept all listed terms

General Rules

• I draw for you only in digital. I provide you with digital goods and it does not require shipping
• If you are taking NSFW art/commission/YCH/adoptable/etc. you confirm that you and your character(s) are over 18 years old. I do not do NSFW for minors or with them
• While drawing I will send you a sketch and other WIPs (work in progress) for approval. Total number of free edits is 3. During a sketch I can make significant changes, but after this only small ones can be free, the rest for extra payment
• If you notice my mistake (and the correct version is clearly displayed on the references you sent me), I will make all necessary edits to fix this for free. Although if you notice this mistake only after more than one WIP, I may ask for an extra fee. I send you WIPs for a reason, please be respectful and careful
• You can see my queue on Trello, but it’s not first come - first served. I might do some commissions faster , although I usually stick to the order
• Please remember that your character might look different in my own art style. I can’t make an exact copy of your reference and like any artist I interpret reality in my own way. I hope you will respect this <3
• Your commission usually will be completed in 2-40 days depending on its complexity and my current queue. I will notify you if i need more time
• Any visual character reference required. Arts with your character is acceptable as reference too
• Please be careful and forward the references where all the necessary information is visible, if the reference does not represent something that I need - I will do it as I think is right, even if your gallery has the right example. If some parts don’t depicted on your ref you should tell me how I should draw this
• I can work without drawn visual references of your character for an extra 30% (because I am dyslexic, so it’s quite difficult for me to work with descriptions). But you still need to provide me with some photos and/or drawings that describe what you want to see (e.g. dog breed photo, clothes photo etc.)
• All characters on my art belongs to it’s owners
• You can order from me a pic with your own character, any fan character from games/cartoons etc. or your friend’s char (you must be sure that they are not against using their character in this way. If there is a conflict, all responsibility lies with the customer)
• I am not responsible if you gave me for YCH or commission a stolen character. By agreeing with ToS they confirm having all rights to this character or permission from owner to use this character
• I have the right not to accept an order without explaining the reason
• I do not claim any right to the authorship of the character, but I remain the author of the drawing, until it is spelled out in the contract of alienation of rights

Payment Rules

• I accept payment via Boosty, Buy me a coffee or Patreon (via custom pledge). Payment guide
• I will start drawing only after full payment. And it’s not refundable, but I can do some reasonable edits to make you satisfied
• I can make a half refund if I haven't started working on your commission yet
• If for some reason I am not able to complete your order, I can make a full or half refund depending on circumstances
• For goods over $350 a payment plan is acceptable. Terms discussed individually
• Depending on the amount, the timeline of the payment plan differs. Unless otherwise stated: For $350-$450 you have one month to make full payment and you need to pay at least $100 during the first week. For bigger amounts time can be increased to a couple or even several months, but you need to pay at least $400 per month
• I would appreciate some tips. This would help me a lot! But tips does not obligate me to do any additional work, it is a voluntary donation
• If you hide your bid or if you don't pay for several times, you will be added to a block-list
• Chargebacks without my approval will automatically put you on my block-list

Auctions Rules

• Please keep your bids under a special comment I left 'Bids here' (or something similar)
• To owerbid the previous bidder or to AB you need to answer to the comment with the biggest bid
• Deleting bids without prior agreement with me will lead to your permanent ban
• Payment after the ending of the auction must be made within 48 hours
• You can delay your payment for some time (discussed individually) but you have to pay at least 20% within 48 hours. And this amount not refundable even if you refuse to take the good

Posting and usage of images Rules

• My drawings are for private use only (unless the opposite is stated), write to me for more info if you want to use my works in commercial way (I don't mind if you print it out and put it on your wall or make prints of it, but you are not allowed to sell any item using my artwork or use it for profit in any other way)
• Rights for commercial usage of my works will cost you extra. Usually it’s about extra 100-200%
• When the job is done you will get all files in High and Low resolution (except for some cases). Please use low resolution ones to upload on the internet
• You can post an artwork on any website until you gain no commercial profit from it and give me a credit every time
• To credit me as a creator please use my social links. Preferable links: http://www.furaffinity.net/user/completealienation/ | https://twitter.com/ca_furry | https://www.deviantart.com/completealienation . Stating my nickname is not sufficient, you should give the working link to my gallery or galleries
• You may not make any edits to my works. Even adding a text with the name of your character or your nickname. If you need to make any changes to the finished work you have to ask me for this and I will do this for a reasonable amount of money. I also can give a permission to handle my work to the other artist for edits if I can't or won't do this edits by myself, but you have to ask me first and receive my written permission to this
• You have the right to print my works but for personal use only (unless the opposite is stated)
• I can make anonymous commissions (not to post your name, but I still will post the image). It's completely free, just tell me
• I can make private commissions (not post artwork anywhere) for an extra 100% of commission price
• I can postpone posting an artwork for a while (but not more than 2 month)
• I receive the right to post original files in high and low resolution on my Patreon and other sites and socials along with steps of creation, time lapse videos and resources files (unless this is a private commission). If you want me not to post extra stuff related to your commission except low resolution pictures it will cost you extra 10%
• I receive the right to use finished commissions and YCHs in noncommercial ways including but not limited to promotion images
• I receive the right to use all works in journals, artbooks, zine, etc. both digital and printed

Adoptable Rules

• After payment you will receive full rights to the character but not to the drawing
• You can make any alterations to the design, but if you want to change the drawing you should ask me first
• Posting and usage rules are the same as for commissions
• If you are going to use character in commercial project it will cost you extra (usually it’s about extra 100-200%)
• You can freely resell or trade the character but you still have to credit me as a creator
• All rules about design usage transfer after resale or trade
• Payment plan is acceptable on adoptables as well. But you will receive full rights to the character with all references and pictures only after full payment. You can see more info about payment plans in ‘Payment Rules’ section
• No refunds. You may not ask your money back after I've sold you the character and gave unwatermarked files no matter how many time have passed
• If you no longer need the character and you can’t or won’t sell or trade it, I can accept it back and return you the 30% of paid amount. After this the character will be put back on sale or I’ll leave it for my personal use
• Do not create new species based on my adoptables

Dispute Resolution

• I hope that this TOS will resolve all disputes with customers before they arise
• If you are dissatisfied with something - feel free to write to me and I will do everything that's possible to resolve the conflict
