Dock Rules 2017

  1. Introduction
  1. These dock rules are to clarify the intentions of the club in assigning docks and managing dock usage.
  2. These dock rules supersede any previous dock rules.
  3. These dock rules may be updated by the Board of Directors from time to time as needed.
  4. Failure to follow these dock rules may result in the termination of dock privileges and forfeiture of dock fees.
  5. The Board of Directors has the final authority regarding dock assignments, termination of dock assignment, forfeitures of fees, etc.
  6. The docks are designed for sailboats that are not considered launchable from a trailer. Dock assignment to centerboard class, multi-hulls and power boats may be considered at the discretion of the Board of Directors.
  1. Definitions
  1. Applicant: A person who owns the majority of a boat for which a dock application has been submitted. If there is any doubt as to the ownership of the boat, it will be the applicant's responsibility to provide satisfactory proof of ownership. When applying for a dock, the seniority date of the majority owner of the boat for which the dock application is being made will be considered for the dock assignment purposes.
  2. Member in Good Standing: current on all fees and accomplished point goal (125 points) for prior year.
  3. Membership Seniority: determined by the date that each member paid their initiation fee and dues.
  4. Harbormaster: Chairperson of Harbor Committee appointed by WJSC Commodore
  5. Dock Status: In-Residence (by dock holder), On Waiver (by dock holder), Vacant (no dock holder)
  6. Assignment Status: Permanent, Annual
  7. Permanent Dock: Dock assignment carried from the previous season where application is submitted and fees are paid by March general meeting.
  8. Waivered Dock: a Dock that may be occupied temporarily by a member on the waiting list. Assignment of a boat from the waiting list to a waivered dock is for the current season only. Assignment to a waivered dock is not a permanent assignment.
  9. Waiting List: Compiled by the Harbormaster at the end of the March general meeting. The list includes any applications for boats not having a permanent dock assignment from the previous season. The list is ranked by member seniority. Applications received after the due date are added to the end of the list in the sequence that they were received.
  1. Dock Applications
  1. You must be a member in good standing and have completed the dock application before a dock assignment will be made.
  2. Applicant agrees to maintain liability insurance on their boats stored at WJSC. Proof of liability insurance must be provided to the Harbormaster prior to bringing boats on Windjammers Sailing Club property.
  3. It is not the responsibility of the Harbormaster to notify you about missing information, fees or points.
  4. It  is your responsibility to communicate with the Harbormaster regarding all issues, including, but not limited to, submittal of dock applications, payment of all fees, notification of dock vacancies, and the intention to leave your boat in the harbor past docks-out.
  5. Dock applications are not complete until the signed application, with proof of liability insurance attached, and fees are received by the Harbormaster. Dock applications will be accepted after January 1 and are due by the end of the March regular monthly meeting, In order to maintain a permanent dock assignment from the previous season, a permanent dock holder must submit a completed application by the due date. If such application is received after the due date, the dock holder will be placed on the waiting list losing their permanent dock assignment.
  1. Dock Assignment
  1. All dock assignments are made by the Harbormaster and the Board of Directors.
  2. The Harbormaster shall present all dock assignments, terminations and extenuating circumstances to the Board of Directors for final approval.
  3. Final dock assignments will be approved at the regularly scheduled March Board of Directors meeting.
  4. Dock vacancies will be filled in order of membership seniority. In the event of a tie in seniority, names will be chosen randomly. The assignments are guaranteed for the season.
  5. Your seniority entitles you to one boat assignment. You may apply for a second boat assignment for the current season if there are no other members waiting for a dock assignment. The assignments are guaranteed for the season. The second dock is an annual (not permanent) dock
  6. After a permanent dock assignment has been made, you may retain that dock in future years provided that you remain a member in good standing and submit a dock application in accordance with Section III E.
  7. If you are assigned a 30 foot dock and plan to get a smaller boat, the Harbormaster may assign you to a 25 foot dock so that members requesting a 30 foot dock for a larger boat may use the facility. If you are affected by this rule, the Harbormaster will notify you in writing at least seven (7) days before the regularly scheduled March Board of Directors meeting so that you can attend the meeting if necessary.
  8. If you do not occupy your dock by May 31, the Harbormaster may temporarily assign that dock to the next boat on the waiting list. It is your responsibility to provide the Harbormaster with a one-week notice of the planned date of occupancy.
  9. You may not sublease or otherwise assign the rights to the dock, even in the event of transfer of ownership of the boat.
  10. Non-members may be assigned docks on an annual basis as they become available and are guaranteed the assigned dock for the entire season. Non-members are placed on the waiting list each season they request a dock.
  1. Transient Dock Users
  1. Members who are planning to use the harbor on a transient basis are required to notify the Harbormaster in advance to ensure that the rights of the dock holders are not infringed upon and required fees are paid.
  2. Harbormaster may rent vacant dock space to members ($10 per day) and to non-members ($20 per day)
  3. All transient boat fees are payable to Windjammers Sailing Club. 
  4. Dock holders are encouraged to notify the Harbormaster when they plan to leave their dock vacant for more than 2 days.
  5. You are encouraged to notify the Harbormaster about those individuals who owe transient dock fees.
  6. Free transient dockage may be provided for sailors participating in club-sponsored regattas.
  1. Decision and Appeals Process
  1. Appeals must be submitted in writing to the Board of Directors on a form prescribed by the Board.
  2. Appeals of Decisions of the WJSC board concerning Dock Applications under Section III and Dock Assignments under Section IV must be made by the aggrieved member for consideration by the Board at the regularly scheduled March Board of Directors meeting.
  3. All decisions by the Board of Directors are final.
  1. Size of Boat Limitations
  1. Each dock in the harbor has both length and beam restrictions as indicated in Addendum 1 below. If you plan to acquire a boat in excess of the length and/or beam restrictions WJSC will attempt to accommodate it as long as it does not create a hardship for the adjacent dock holders or other members navigating the harbor. Vacant Larger docks may be assigned to smaller boats.
  2. Changing to a larger or smaller boat can affect a dock assignment. Before buying another boat that you plan to keep in the harbor you must discuss with the Harbormaster if there is a vacant dock that will accommodate the proposed boat. If there are no vacant docks that can safely accommodate it, then it is your responsibility to find a dock holder willing to trade docks. It is your responsibility to notify the Harbormaster of trades prior to changing docks. All such trades are subject to the approval of the Board of Directors.
  3. Dock fees are set annually by the Board of Directors and are based on dock size, not boat size.
  1. Abandoned Docks, Low Water Dock Waivers and Personal Dock Waivers:
  1. Abandoned Dock
  1. If the Harbormaster determines that you have abandoned your dock without a proper waiver request, the Harbormaster will notify you in writing that your assignment to the dock is being terminated for the season.
  2. Within ten (10) days, you must provide the Harbormaster with a completed waiver request. If the Harbormaster does not receive a waiver request within this time, your permanent assignment rights will be terminated and the dock will be deemed vacant.
  1. Low Water Dock Waiver
  1. In low water conditions, as determined by the BOD, the Board of Directors may grant annual waivers for a maximum of three consecutive years. The low-water waivers must be requested in writing to the Harbormaster. To retain the dock for the next year, you must remain a member in good standing during the year on waiver.
  2. For the upcoming sailing season, if the written waiver request is submitted by the end of the March regular general monthly meeting and the Board of Directors has determined that low water waivers will be issued, you will be refunded the entire dock fee if the dock is subsequently assigned to a boat on the waiting list for the season.
  3. If there are more low-water dock waiver requests than dock applicants on the waiting list, then refunds will be made in order of seniority. Low water waivers received after the first regularly scheduled general meeting will be handled in the order received. If your dock is subsequently assigned to a boat on the waiting list, your dock fees will be refunded, less a $50 service fee.
  1. Personal Dock Waiver
  1. If you have permanent dock assignment, you may request a one-year waiver from dock assignment for personal reasons and retain your permanent dock assignment status for the following season. The request must be made in writing to the Harbormaster by the end of the March monthly general meeting.
  2. To retain your permanent dock assignment for the next year, you must remain a member in good standing during the year that waiver applies. The waiver may be granted for one year only and cannot be repeated for the subsequent three years.
  3. If you request a personal dock waiver after Memorial Day weekend, your dock fees will be refunded, less a $100.00 service fee, if the dock is subsequently assigned to a boat on the waiting list.
  1. Boat and Dock Safety Requirement
  1. It is imperative that all dock lines and gear used to secure your boat are in good condition and suitable for the safety of your boat and those in the surrounding area. The Harbormaster will provide a written warning if problems exist. If you do not take corrective action, the Board may take action to ensure that safety issues are resolved which may lead to forfeiture of your Dock rights in the current and future seasons.
  2. Should you jeopardize the safety of others or their property through the manner in which you handle your boat or yourself, you may be ordered to vacate the dock space and forfeit your dock fees.
  3. You are responsible for keeping your dock and adjacent breakwaters free of trash, weeds and other debris.
  4. For the good and welfare of the club, it may be necessary for the safety of the boats, to temporarily remove a boat from its dock. Moving a boat from its dock will be accomplished by direction of the Harbormaster.
  1. Docks Out
  1. It is the dock applicant's responsibility to remove their boat so as not to hinder or delay dock removal in the fall. If a dock applicant wishes to leave a boat in the harbor beyond the scheduled outer docks removal date, the dock applicant must inform the Harbormaster in writing. The dock applicant is responsible for the safe removal and storage of the dock if an outer dock cannot be stored on the scheduled docks out date.
  1. Other Terms And Conditions
  1. Boats are not allowed on WJSC property without a completed Dock or Drysail boat application.
  2. WJSC reserves the right to remove abandoned boats from Club property after due notice is given to owner.
