EMAIL PROTEST: #JUNKTERRORLAW AT THE DEPARTMENT OF JUSTICE

The Anti-Terror Law has been passed. This law has numerous provisions that are unconstitutional, and has been called out by several legal bodies.

President Atty. Domingo Cayosa of the Integrated Bar of the Philippines (IBP) has stated that the creation of an Anti-Terror Council (as stated in the law) is unconstitutional because it nullifies the check and balance function of the Judicial branch of government. Cayosa also noted that even under Martial Law, when the privilege of the writ of habeas corpus is suspended, the constitution requires that an arrested person be charged within three days - under the Anti-Terror Law, persons can be arrested without warrant, detained for up to 14 days, extendable by 10 days, before bringing them before a judge.

Demand that the Department of Justice review the law and write Implementing Rules and Regulations that protect our right to free speech.

Dear Secretary Menardo Guevarra,

As the appointed Secretary of Justice, responsible for upholding the rule of law in the Philippines, I urge you to review the Anti-Terror Law (SB 1083/HB 6875) and with that, protect the fundamental rights of the Filipinos to freedom of speech, as stipulated in Article 3 Sec 4 of the 1987 Philippine Constitution.

I am concerned with the Anti-Terror Law, as it has not adequately defined what a "terrorist" is and what constitutes "terrorism." With the way the Bill is now, any person or organization could be tagged as a terrorist, arrested without warrant, and detained for 14 days.

The bill grants the police too much power. I am especially concerned about this because our president has routinely protected the interests of the police over the lives of ordinary citizens.

As this government's principal legal counsel, we urge you to review the law in line with our constitution. We urge you to develop Implementing Rules and Regulations that address the unconstitutional sections of the bill, and ensure the protection of the Filipino people.
