- New COVID-19 Employer Reporting Requirement (AB 685 signed September 17, 2020)- Under AB 685, California employers are required to provide specific notices to employees exposed to COVID-19 within one business day of becoming aware of the exposure. Additional information here.
- San Francisco Enacts Ordinance Protecting Workers and Applicants from COVID-19 Related Adverse Actions and Discrimination on September 11, 2020.
- Gov. Newsom signed into law AB 1867, which mandates certain employers to provide COVID-19 Supplemental Paid Sick Leave to eligible employees that are not covered by the federal Families First Coronavirus Response Act (the “FFCRA”) on September 9, 2020.
How to Access Final Paychecks
- Private Sector Employee (California)
- If you have been laid off or have been terminated by your employer, your employer must pay you all wages (including accrued vacation) immediately at the time of termination. Cal. Labor Code Section 201 and 227.3.
- If you quit without giving 72 hours prior notice, your employer must pay all wages due within 72 hours of quitting. You may request that you’re your final wage payment be mailed to a designated address. If you quit and give at least 72 hours prior notice and quit on the day given in the notice, you must be given all wages due to you at the time of quitting. Labor Code Section 202.
- You may file a wage claim for nonpayment of wages. Here is information on how to file a wage claim.
- You may also consult with a labor and employment attorney of your choice. UCLA Student Legal Services provides legal assistance to students seeking to file a wage claim. See the Legal Services section of this resource guide.
- The University is considered a state employer and as such, if you were hired by the University, federal law would apply.
- Employers are not required by federal law to give former employees their final paycheck immediately. If the payday for the last pay period for which you’ve worked has passed and you have not yet been paid, you may contact the Department of Labor (DOL).
- You may recover unpaid wages under the Fair Labor Standards Act (FLSA). See here for more information.
UAW Form - How to file a successful Wage Claim
The key behind a successful wage claim within the UC employment system is SB 698, passed in Fall of 2019 by UAW. SB 698 allows private-sector labor laws (specifically section 204 of the labor code) to mandate timely and complete pay for the workers of the University of California. This means we can now file a claim against the university for late or unpaid wages. If you are a student worker at a private employer, these laws apply to you as well, and while we are walking through the wage claims process at the UC, similar steps would take place at any employer (similar forms, etc.).
From UAW 2865, the wage claim process is as follows:
- This is a copy of the form that you fill out, and here is a sample form.
- Here is a copy of UAW 2865’s collective bargaining agreement with the University of California, should you currently be a reader, tutor, or teaching assistant/graduate student instructor.
- You can file your claim by mail or online, and you can find contact information for regional offices here.
- Within thirty (30) days of the filing of the complaint, the deputy shall notify the parties as to the specific action which will initially be taken regarding the claim (which, again, are further described here)
- referral to a conference
- referral to a hearing
- dismissal of the claim
- Should your claim prevail, the University will provide your missed wages. Additionally, the University shall accrue the following penalties, which they will pay back to the state, or sometimes to you:
- $100 for one violation
- $200 + .25 times the amount of wages withheld for each violation thereafter.
It is worth noting that the claims form is long, and a bit confusing. Some information asked for is relatively unreasonable, such as exact hour breakdowns/paystubs from years ago. To make the process easier, attached here as well is an annotated PDF we’ve created for you of one of said wage claim documents, highlighted and with notes attached.

Benefits For Workers Impacted By COVID-19
Overview of Available Benefits Programs
Disability Insurance
Loss of wages because you are unable to work due to non-work related illness or quarantine related to COVID-19
Paid Family Leave
Loss of wages for not being able to work because you are caring for an ill or quarantined family member with COVID-19. Citizenship and immigration status do not affect eligibility.
Unemployment Insurance
Lost your job or have had your hours reduced for reasons related to COVID-19
- Partial wage replacement benefit for workers who are/were employed as employees
California Paid Sick Leave
Unable to work because you or your family member is sick, must take care of a child whose school and childcare is unavailable, or victim of domestic violence, sexual assault, or stalking per Labor Code Sec. 230(c) & 230.1(a))
- All employers (regardless of size) are required to provide Cal. Paid Sick Leave to all eligible employees.

- If CPSL is denied by your employer, you may file a wage claim.
Local Government Supplemental Paid Sick Leave for COVID-19
For employees reside in the city of Los Angeles, unincorporated areas of Los Angeles County, San Francisco or San Jose
- Los Angeles (Remains in effect until two calendar weeks after the COVID-19 local emergency expires.)
- San Francisco (Extended through February 12, 2021)
- San Jose (Extended through June 31, 2021)
Workers Compensation
This bill would define “injury” for an employee to include illness or death resulting from the 2019 novel coronavirus disease (COVID-19) under specified circumstances, until January 1, 2023. (Senate Bill No. 1159)

Filing Unemployment
Disclaimer: EDD was recently audited by an independent company who found that there were various mismanagements and their “lack of advanced planning led to significant delays in its payment of [unemployment insurance] claims” (LA Times). More info here
General Unemployment Application Resources: Comprehensive guide for student workers on the unemployment application process. The below resources and links pertain to basic information about the general steps, components, and expectations you should be aware of when filing your unemployment claims. While there are a few adjustments and exceptions created in response to COVID-19, such as extending benefits to college students through new legislation and programs, a majority of the unemployment application process remains the same. Be wary of the state in which you reside when applying for unemployment as the eligibility criteria and steps you will need to take are specific to where you live. There are also some additional links to helpful FAQs and fact sheets for those interested in learning more about unemployment insurance benefits.
Guide to Applying for unemployment benefits (general, California only)
- Claims begin Sunday of the week student became unemployed
- When filing for UI benefits, you must have earned enough wages during the base period to establish a claim, and be:
- Totally or partially unemployed.
- Unemployed through no fault of your own.
- Physically able to work.
- Available for work.
- Ready and willing to accept work immediately.

- Waiting Period – The 7-day waiting period is waived for claims beginning on or after January 19, 2020. After you submit your first two-week continued certification, you will be paid for the first week of your claim.
- Work Search – You are not required to look for work each week to be eligible for benefits.

Pandemic Unemployment Assistance (PUA)
- PUA program helps unemployed Californians who are business owners, independent contractors, self-employed workers, freelancers, individuals with limited work history, gig workers, and others not usually eligible for regular state UI benefits.
- You may also qualify for PUA if you have found to be ineligible for Unemployment Insurance, have filed for UI but received a notice that you have $0 in benefits, or have qualified for regular UI benefits but have collected all eligible benefits. PUA accounts for college students who previously did not qualify for state UI benefits.
