Eligibility: This campaign is open only to (1) legal residents of California who (x) do not reside within seventy-five (75) miles of Sacramento, California (unless residing closer to San Francisco, CA than Sacramento, CA) or within seventy-five (75) miles of Los Angeles, California; (2) are at least eighteen (18) years old at the time of entry; and (3) those who follow both @sftru and @Chase_Center on Instagram, OR both @sftru and @ChaseCenter on Twitter, and comment according to the “How to Enter” requirements stated in the original social media posts. This Campaign is not open to employees and officers of San Francisco Transit Riders, Golden State Warriors, LLC, Golden State Valkyries LLC, GSW Arena LLC, NBA Properties, Inc., the National Basketball Association (the “NBA”), and the NBA member teams (collectively, the “GSW and NBA Entities”), or any of its respective affiliates or agents or their immediate family members (spouses, parents, children and siblings and their spouses) or members of the same household (whether related or not) as such individuals not eligible to enter or win. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
Agreement to Rules: By entering the Campaign, the Contestant (“You”) agrees: (i) to be bound by these Official Rules, including entry requirements; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of his/her rights to bring any claim, action or proceeding against any of the San Francisco Transit Riders and GSW and NBA Entities (together, “Released Parties”) in connection with the Campaign; and (iv) to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Campaign, including, but not limited to, any Campaign-related activity or element thereof, and the entrant’s entries, participation or inability to participate in the Campaign; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a prize (or any component thereof); (d) any change in the prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or willful misconduct by entrant.
Campaign Period: Entries will be accepted online starting on September 1, 2024, 7:00 am PT and ending on September 30, 2024, 11:59 pm PT.
How to Enter: The entry must fulfill all Campaign requirements, such as following both @sftru and @Chase_Center on Instagram, OR both @sftru and @ChaseCenter on Twitter, and commenting according to the “How to Enter” requirements stated in the original social media posts, to be eligible to win a prize. You may enter only once. There is a limit of one (1) entry per person during the Campaign Period. If more than one (1) entry is received from the same person, the entries may, in SF Transit’s sole discretion, be disqualified. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified.
Alternative Method of Entry: In addition to entering the sweepstakes via the above method, entrants may also enter the sweepstakes by mailing in a 3x5 index card listing the entrant’s first name and last name to P.O. Box 193341, San Francisco, CA 94119. Index cards must be received by 11:59 pm PT on September 30, 2024.
Prizes: The four Winners of the Campaign will receive one signed Jonathan Kuminga photo ($140 value), one signed Brandin Podziemski photo ($65 value), one signed Andrew Wiggins photo ($80 value), OR a Grand Prize of a signed Draymond Green basketball ($500 value) AND 2 suite tickets to a Golden State Warriors game next season ($8,000 to $30,000 value). Actual/appraised value may differ at the time of prize award. No cash or other prize substitution shall be permitted except at San Francisco Transit Riders' discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of the prize constitutes permission for San Francisco Transit Riders and GSW and NBA Entities to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.
Without Warranty: WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS CAMPAIGN, INCLUDING THE PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
Odds: The odds of winning depend on the number of eligible entries received.
Winner Selection and Notification: The winner will be selected by a random drawing under the supervision of San Francisco Transit Riders. The winner will be notified by Direct Message or my phone, if applicable, within five (5) business days following the selection of the Winner. San Francisco Transit Riders and GSW shall have no liability for Winner’s failure to receive notices due to spam, junk email, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 30 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by the Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT San Francisco Transit Riders SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Rights Granted by You: By entering this content, you understand and agree that San Francisco Transit Riders and GSW and NBA Entities, anyone acting on behalf of San Francisco Transit Riders and GSW and NBA Entities, and San Francisco Transit Riders and GSW and NBA Entities’ licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent.
Terms & Conditions: San Francisco Transit Riders reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond San Francisco Transit Riders control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, San Francisco Transit Riders may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by San Francisco Transit Riders. San Francisco Transit Riders reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. San Francisco Transit Riders have the right, in their sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such an attempt be made, San Francisco Transit Riders reserves the right to seek damages to the fullest extent permitted by law.
Right to Modify or Cancel: If, for any reason, the Campaign is not capable of running as planned, San Francisco Transit Riders reserves the right, at its sole and absolute discretion, to cancel, terminate, modify, or suspend the Campaign and/or proceed with the Campaign, including the selection of one or more winner(s) in a manner it deems fair and reasonable, including the selection of a winner from among eligible entries received prior to such cancellation, termination, modification or suspension. In no event will more prizes be awarded than are stated in these Official Rules. In the event that, due to technical, typographical, mechanical, administrative, printing, production, computer, or other errors, there are more winners than are stated in these Official Rules, a random drawing among the claimants will be held to determine the winner.
Limitation of Liability: By entering, You agree to release and hold harmless San Francisco Transit Riders, GSW and NBA Entities and their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
Disputes: THIS CAMPAIGN IS GOVERNED BY THE LAWS OF THE UNITED STATES AND CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resorting to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances shall the participant be permitted to obtain awards for and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.
Winner List: To learn of the winner, entrants should mail a self-addressed stamped business envelope to P.O. Box 193341, San Francisco, CA 94119. Winner List requests must be received no later than Friday, October 18, 2024.
