ADA VIOLATION COMPLAINT

Please take notice of this as my formal complaint to the Waukesha County Courthouse of ADA violations and privacy violations.

On October 16, 2020 I contacted the Clerk of Courts Monica Paz requesting next steps for filing my ADA accommodation request.

On October 31, 2020 I contacted the Clerk of Courts again regarding my request and stating that I needed the accommodation in reference to the hearing on October 27, 2020.

On November 2, 2020 at 8:20 AM the Clerk of Court emailed me ignoring my ADA accommodation request and telling me to contact the court reporter.

On November 2, 2020 at 8:23 AM I responded to the Clerk of Court that I contacted the Clerk of Court requesting to file an ADA accommodation.

On November 2, 2020 at 8:43 AM the Clerk of Court provided the form GF-153 ADA with the ADA Accommodation Request form.

On November 2, 2020 at 11:21 AM I provided the Clerk of Court with the filled out request form.

On November 2, 2020 at 11:30 AM the Clerk of Court responded that I should file my ADA accommodation for Judge Aprahamian to review.

On November 2, 2020 at 11:36 AM I responded asking for explanation and the court policy for ADA accomodations and procedures.

On November 2, 2020 at 11:53 AM the Clerk of Court responded with the following: “Waukesha County follows the Wisconsin Court Systems Notice Under Americans with Disabilities Act- Title II Public Programs, Services and Activities with is located at: https://www.wicourts.gov/services/public/docs/adapolicy.pdf. Based on this I will accept the filing and be referring your request to Judge Aprahamian for determination.”

On November 2, 2020 at 11:58 AM I responded: “As stated in the document you sent: ‘Each county also has it’s own ADA policies and grievance procedures applicable to county facilities, staff and services. The Deputy Director of State Courts for Court Operations serves as the ADA State Coordinator for the Circuit Courts, providing technical assistance and information about accessibility of court services.’ Please send me Waukesha County Policies and procedures.

On November 10, 2020 at 11:21 AM the Clerk of Court send an attached response letter that stated I made an open records request for the policy and denied it claiming the Clerk of Court is not the custodian of records responsive to the request.

On November 2, 2020 the Clerk of Court had my ADA accommodation request filed publicly in case 2018FA296 in violation of ADA accommodations and privacy violations.

I am writing this complaint that an ADA accommodations violation of procedure has occurred as well as a privacy violation to have the Waukesha Clerk of Courts:

  1. attempt to ignore a ADA accommodation request
  2. not provide the Waukesha County ADA Compliance and Complaint Procedure and
  3. violate the Waukesha County ADA Compliance and Complaint Procedure which states “The Human Resources Manager is designated to coordinate compliance and serves as the ADA Coordinator. Information concerning the provisions of the Americans with Disabilities Act, the rights provided thereunder, should be directed to the Human Resources Manager.
  4. Violate procedure and privacy by publicly filing it in case 2018FA296
  5. Denied request for Waukesha ADA Compliance and Complaint Procedures

This also serves as a complaint on Judge Michael J. Aprahamian for directing an ADA accommodation request to be filed publicly in a family case record against Waukesha County ADA Statement of Compliance and Complaint procedures.

Remedy requested are as follows:

  1. ADA request removed from the public file in 2018FA296 and do what is necessary to be sure any archived images are removed from the internet
  2. Have the proper procedures followed for the ADA accommodation request including a meeting with the Waukesha ADA Coordinator.
  3. I request Judge Michael J. Aprahamian be removed from case 2018FA296
  4. I request that Monica Paz be removed as the Clerk of Court for violating duties of that role.

This is notice that the facts represented are accurate and further proof can be provided in support of this complaint.
